      Whitney ********************** was selling her items on an online platform Estate Sales .org. at the beginning of June. She had many buy it now items up for sale and I purchased ***** worth of small pins and brooches. My purchase never arrived. But what I did notice is that she charged my credit card twice!! I reached out to her and finally two weeks ago we connected. She made promises of my items being shipped she provided a tracking number she promised to refund my credit card which then changed to her sending me a prepaid gift card for the double dipping she did. Well as of yesterday the postage has been made but she has never delivered my purchase to her postal station. She claimed they were on the way but thats not true or correct they nothing has moved through the **** system. She says she doesnt issue refunds to the original form of payment but chooses to use gift cards for her business refunds. My CPA and myself are requesting that my original form of payment be refunded. I know after reading her reviews and seeing her news story that my package and my money are not her top priority. She has not been honest through this and now its time to refund me twice.

      We had a contract with this company and had the sale on Sept 16, 17 & 18, 2022. After several excuses we finally got money in bank account on Oct 14, 2022. ******* said she mailed our receipts 3 different times the last time with Fed Ex. She wouldnt provide tracking # so I could follow up. We were receiving all our other mail just not hers. I only have her saying how much was sold no back up. I tried for months to reach her but she wont return calls. Felt I needed to report this.

      My mother lived in *** and passed away recently. I hired True 2 You Estate Sales to do an estate sale at my mother's home. I was given a detailed contract and references by *************************, owner, and the big 3 day sale was set for Jun *****, 2022. It was listed on her ******** business page, on her website. The sale was set up quite well and was pleased with what I saw. We had a great sale, great communication and all seemed very professional. I was so impressed with ******* and there was enough items still available that I asked if we could do a second sale. The second, smaller 2 day sale was on Jun 30 - Jul 1, 2022. After the sale, a buyout offer of $500 was made for any items left and it would be added to the check with the two sales. The contract states "net proceeds shall be paid to the Seller 14 business days following the conclusion of the sale". On July 19, I asked ******* when I should receive payment for the two shows and the buyout which totals $13,960.16 (my portion after deducting her 35% and local taxes). She stated she had given the ok to her CPA for payment. On Friday, July 29, I sent her a text, stating I didn't receive a check yet. Her response on Sat, Jul 30, 2022 said she followed up with her CPA on Thursday, Jul 28, it was mailed **** and I should get it Tuesday, then sent a second text saying "it might be Monday on second thought". It is now Fri, Aug 5, 2022 and I have yet to receive payment. ******* is no longer responding to calls and texts, yet she is continuing to have estates sales as seen on her ******** page and website. I just want payment to close this nightmare in an already emotional, stressful situation.

      We have submitted a replacement payment packet and this is being shipped Thursday August 11th to arrive August 12th. We have been in contact with ****** and **** to explain the delay. Usually clients have one single sale and with hers being multiple then the cleanout being delayed, all counts and proceeds were combined together. Thank you for helping to make sure we get this resolved with ****** and ****. They were lovely clients and we are ready to get this closed out as well.

      I am rejecting this response because the check she sent for payment bounced on Aug 17, 2022. I deposited the larger check first on Aug 15, 2022 and then I was going to deposit the smaller check once the larger cleared but obviously, with the larger check bouncing, I did not deposit the smaller one.  Additionally, I didn't even receive a check for our $500 buyout.  The owner, ******* *****, claims there was no way the check could've bounced and as I pointed out to her, the bank doesn't lie and we have proof of a bounced check.  Just like prior clients who have filed a complaint (including complaints of bounced checks), it's one excuse after another, one promise after another on sending payment.  Multiple texts, calls, promises to pay, not answering calls or texts, just extremely poor follow through.  It must be totally exhausting for her running a business the way she does.  She can eliminate 99% of her issues by simply doing one thing....when you have an estate sale, put the client's portion in an account until payment is due. Golden Rule #1 - Don't touch it.  Send your client a check in the time frame promised.  Check clears.  Everyone's happy.   She only sent the checks bc I filed a police report and an officer from the white collar crimes division contacted her (and she still went ahead and sent a check that would bounce....you've got to be kidding me, who does that except someone who thinks they're above the law).  She says the bounced check occurred because funds weren't transferred from one account to another.  Here's some more free financial business advice (and this goes for anyone writing a check)...Golden Rule #2 - make sure when you write a check (especially one over $12,000) that funds are available to cover when your client deposits the check. In her promise to empty promise to pay text, she stated it says clients are to refrain from posting negative reviews in the estate sale contract that I signed.  The only negative review was the complaint filed with the BBB.  Sorry but that contractual clause was banned by the *** in 2016 and she can be fined for that by the ***; also a complaint filed with the BBB is not a review, it's a complaint asking for help in getting resolution. Another interesting insight, the owner herself didn't sign the checks that were oddly dated Aug 1, 2022 but mailed in a ***** envelope on Aug 12, 2022 (so you had the checks ready to go Aug 1 - yet we asked multiple times between Aug 1 and Aug 12 about payment...just bizarre).  Both checks were signed by *************************** (see attached check that bounced) who says she is an owner of True 2 You Estate Sales on her ******** page (see attached) which also contains photos of her and ******* together; ******* says she is no longer part of the company and no longer a co-owner.  She then goes on to say ***** only answers emails and helps with set-*** but how interesting that she is still allowed to sign your company checks.  Just one dumb, laughable excuse/lie after another.  

       

      On the morning of  Aug 18, 2022, ******* texted to offer a Zelle payment of $2,500 for peace of mind and would be going to the bank later that morning to get a cashiers check for the balance. I rejected this offer per the advice of an attorney.  I told her we wanted the full amount in a cashiers check sent ***** as she promised.  She said she would be going the bank later that morning to sign a form to transfer funds between accounts (you dont need to do that for a cashiers check) and issue a cashiers check and send *****.  Its Friday, Aug 19, 2022 and no response from the owner, who is no longer responding to texts.  

       

      In my opinion, the owner(s) is/are habitual scammers.  I even see some of my estate sale items in a current estate sale coming up this weekend...and I still haven't been paid.  If she says those items were part of the $500 buyout, well I havent received payment for that either so shes selling stolen goods.  She just scams one family after another.  If had a business and sent a client a bad check, I would be profusely apologizing and scrambling to make sure I got the situation taken care of immediately and that would be my number one priority.  Not this owner - she pretends its a priority, only to string you along during the day thinking she's really going to do something and then just goes radio silent later that day.  I have even asked multiple times if she even has the funds to pay and not once has she offered a real explanation why she is unable to pay  (I think we all know the answer is lack of funds because she spent all the money and not enough money is coming in to pay clients she owes which is why this is at least the 3rd bounced check to a client (including myself) this year alone that Im aware of).  Completely shameful.

      We are gathering all iformation to respond properly to this complaint. There are some areas that hold truth, however most that do not and the opinion of this client seems to be altered by other false claims. We have had 1 horrid client earlier this year and out of retaliation they had acquaintances submit false reviews and information. This is currently under the review of a superior.       I am rejecting this response because the fact remains that we still have yet to receive payment for our two estate sales (Jun *****, 2022 and Jun 30-Jul 1, 2022) plus $500 buyout. Fact: we have received many, many promises to pay by ************************* since July 19, 2022 and have asked numerous times when we will receive certified payment (including today which has gone unanswered yet once again).  Fact: The only payment received was in the form of a non-negotiable check on Aug 15, 2022 (after we requested certified payment) and that check bounced on Aug 17, 2022.  Fact: we are still waiting on certified payment which was promised yet once again by Monday, Aug 29, 2022.  Fact: payment still hasn't been received as of today, Sep 2, 2022. Fact: we are not being influenced by other clients with "false claims" and "false reviews" and my opinion isn't altered - what I have said in this BBB complaint is factual and based on OUR experience alone in dealing with ************************* as owner of True 2 You Estate Sales but how incredibly disturbing that our experience is very parallel to theirs (great communication before, during, just after the sale but as soon as payment is due to the client...lots of promises to pay, won't answer phone calls, one excuse after another, more waiting on payment that never shows up, and a bounced check). Just more gaslighting on the part of this business owner. All we want is the payment in the form of a certified check with the tracking number for our estate sales including buyout which totals $13,960.16. Once received, we will notify the appropriate agencies and authorities that payment was received,  including the BBB.  

      Here's the bottom line....why haven't we received payment in the form of a certified check to date as promised and when will you send payment?  Can you please answer that directly?
