    Business Response

    Hello,

Ms. *********** was released from her lease obligation via the health related early release clause of her resident handbook.

Normally, breaking a lease mid term would result in a buyout fee equivalent to 2 months rent, a required 60 day notice period, and repayment of any concessions received during that lease period. Due to her providing the appropriate documentation, the clause reduces these fees to the following: buyout fee equivalent to 85% of the rent, a 30 day notice period, the repayment of concessions. Her 30 day notice was fulfilled, so the only items billed on her final statement were the reduced termination fee and the billing of her concession received on move in. Please see attached supporting documentation for the charges:

Lease contract, buyout agreement, concession form

Resident handbook - Early Release details are highlighted on page 5

Final account statement - reflecting the final charges per the health related early release

Please let me know if additional documentation is needed.

    Thank you,

    Business Response

    Hello,

The completed lease document is available for viewing at any time in the resident portal, or at the resident office. Signing electronically gives the opportunity for our residents review the full document at their own pace before signing, and to ensure that what they are signing is accurate and that they agree to listed terms.

Various lease term options are available, however the quote provided at time of application was for a 15 month lease term. This is attached.

While the handbook was signed after initial move in, this is the document that allowed for the discounted early release with the medical provision. Without the signed handbook, the buyout agreement included in the lease (2 months rent buyout fee and 60 day notice period) would apply.

    Thank you,

    Lita

I am rejecting this response because: nothing was said about the things that were supposed to be provided but were not provided, such as a secure living environment (their security system never worked), as a result my car was broken into, they made me have to walk through mud & water to get to my car, they knocked a whole in the wall and put a vent over it and the plaster dust that came through the vents made a health issue, I paid cable each month and it didn't work for the last 6 months of my stay, and because they didn't care for the property, I fell and broke my knee having to spend time in hospital and rehab, we paid for trash pickup but half the time they didn't come but we never received a credit, they are good at taking money but they never give any of it back when services are not provided.  I followed the instructions given to me by management for a medical lease release, I have never heard of this person, Lita Vesely.

    Sincerely,

    Betty Bridgewater
