Swift Exteriors has no involvement in Ms. ********* complaints, but is a completely separate business entity that happens also to belong to the Owner of Ms. ********* landlord, Ram Dam Development.  This matter involves a commercial landlord-tenant dispute that has now been turned over to legal counsel.  Ms. ******* has willfully failed and refused to comply with a number of material terms of her lease with Ram Dam Development, including failure to pay her triple net expenses, but also in refusing - despite numerous requests - to provide proof of commercial general liability insurance as set forth in the lease she entered into.  She has engaged in a tirade of harassing behaviors in an effort to avoid compliance with terms of the lease, including numerous abusive emails and text messages and calling the police to the property when Swift Exteriors (tenant of another unit of the property) was hosting an employee Thanksgiving meal.  The landlord has initiated steps preparatory to eviction and, in response, Ms. ********* harassing behaviors have escalated. We respectfully request that her complaint be dismissed as an unfounded, and we believe unlawful, attempt to wrongfully use the BBB to harass the landlord.  For any further information, please contact our legal counsel, ********* ********, at ************************* ************.

    Complaint: ********

I am rejecting this response because: as a landlord he should explain. He coulda explained since this was made..and he hasnt.  He houses his company's swift corp/ Ram dam at ********************** and 600..right next door to me. I'm unit 700..and he uses unit 800 for odd jobs and parties.  and I just don't understand why i had to pay entire bill besides just payimg my portion. ************* says he can't do that as well. I'm reaching out to BBB in total truth and facts.. and i havent harrassed him at all..he only said  that because I reported that he was harassing me with false charges.  He can't pin one time of me harassing him at all. I don't even bother or speak unless I'm paying rent.

He comes in my business ..made 3 hair and ***** appts yet never came to any appt.. hugged me every time I paid rent never warned me or told me he's about to spring an entire water bill on me. How can I make a profit paying him $4500 plus the gas and electricity for my own building hes making me pay his utility too and then threatening if I don't he will change locks on my busines.. even the outdoor electricity. Arent inonly responsible for my building..since he houses his businesses there too and has over 50 employees..and my shop..it's just me.... how do I deserve to pay 100% of everything that's in his name. And since its only 1 pipe to the meter It can't be 100% on me. Yet he made me  threatened to close my doors. Stress for no reason . And I've done nothing at all to get evicted..on his cameras nor mine. I pull up work and leave.and out of no where he is being a bully to me and idk if it's cuz I'm black or a woman. But no one would agree to give up all they money...and for no reason. Nor explanation...He's trying to sabotage my business. Im paying rent &not bothering him. I put so much in to my business ..i just came from a fire. and hes trying to take everything i have just because he thinks I have money. Please help.

    Sincerely,
    ****** *******

In late Nov., ******* appeared at the landlord's office with a family member. She was asked to leave due to irrational behavior. The family member returned to have a discussion about ********* lease. He appreciated that ******* failed to abide by the lease and that she exhibited disruptive behaviors. The family member apparently helped Ms. ******* understand her legal obligations. She paid what was owed and provided proof of insurance that she was several months delinquent in providing. It appears that Ms. ******* now understands her contractual obligations under the lease she signed. Next, with respect to ********* various other allegations, they are demonstrably nonsensical and false. For example, her claim as to the number of employees (50) at a neighboring business (Swift Exteriors) is incorrect. That business has 8 employees. 5 of those employees are construction laborers and work at job sites. Her assertion that the landlord is "the devil" and has harassed her clearly are other falsehoods, consistent with past behaviors and verbal abuse ******* engaged in. There are numerous other examples of ********* false accusations and harassment of the landlord, but those have been turned over to legal counsel to handle rather than reciting them verbatim here.  ******* has received a Cease and Desist notice. We have not experienced any further harassment or problematic behavior since.  If that behavior resurfaces, legal counsel will take further action. Finally, we remind you that ******* lodged her complaints against Swift Exteriors, but Swift Exteriors is not the landlord about which she complains.  We therefore ask that this matter be closed.  If ******* replies, and if her reply is in the nature of the harassment that precipitated the Cease and Desist notice, our attorney will proceed with next steps as opposed to continuing to back-and-forth in this forum.

The complaining party has been evicted from this commercial property.  Her lease was a triple net lease and though she read, signed and initialed all provisions, she apparently continues to refuse to acknowledge her contractual obligation to pay for utilities.  Her eviction arose out of ongoing violations of the lease terms (including smoking marijuana in the building which impacted other units, installing exterior lighting and refusing the landlord's access when the water fountain in her unit had a leak that caused water to run into a neighboring unit). We retained legal counsel to assist us with this process, because the complaining and her boyfriend regularly engaged in harassing and threatening behaviors, which caused other tenants to leave the property for fear of them. For example, when another tenant was hosting a small and quiet Thanksgiving celebration, she called the police, which interrupted and embarrassed the other tenant. A couple of weeks ago, another tenant's employee left when she and her boyfriend were cursing at and threatening the landlord.  At this point, the complaining party no longer has any right to be at the property and it is our hope that her harassing and inappropriate behaviors will come to an end.
