    On July 1, 2023 ****'s Construction (recommended by my insurance agent) replaced the roof on my house and damaged my gutters and my newly installed pergola and is refusing to make the repairs. I received a rudimentary non detail estimate with no mention of payment or procedures and was forced to find my own shingles (see texts - which was my 1st red flag). I have paid them $5000 and now they are threating a lien if I do not pay the remainder without repairing the damage. I provided them before/after pictures for proof and they sent out 1 person who saw some damage and just tightened some screws but when I emailed pictures of more damage ****'s would not send that guy back out. They sent a second guy and he confirmed the damage (the main beam attached to the roof was cut in half - see jpeg) but now ****'s is saying I am refusing him to make repairs which is false and now they are refusing to make the needed repairs and are demanding payment. My insurance agent is involved and trying to assist but not having any luck in convincing this company to act in a profession manner. I have texts and emails to prove this 6 weeks nightmare. I will be happy to make final payment when the damage that they have caused has been repaired to my satisfaction.

    Our contract that was sent to the client's state that the work that would be completed is on the paperwork from the insurance adjuster plus we included the client's pergola that the insurance company did not cover under the replacement cost.

    *On the Pergola, we have sent someone there on several occasions and she has not "been satisfied". 1st trip the issue was the screws:  someone went to tighten them and make them less noticeable. Later because she spoke with my employee, and she did not agree with the repairs he was going to make:  The cut that she claims we made is a split from where the original wood connects to the other piece as no piece of wood is a fully complete piece for the perimeter of the pergola. This is where my employee said we can double the wood to enforce it and cover the split. She was not satisfied with this and turn him away not because it was at 8 pm.

    *I have uploaded the insurance section that says the gutters did have marring but not puncture, which is why it was not covered under the estimate.

    *On the payment there was a verbal agreement that after the work is completed the 1st payment from the insurance is due to us. The 2nd payment should be given to us after the insurance company releases the depreciation check.

    *on the "was forced to find my own shingles (see texts - which was my 1st red flag-" The warehouse did not have the color she requested in stock; an alternative was offered but not required to be accepted. In the roofing industry, it is highly normal for a client to choose the color they want on their home. So much so that the shingle manufactures have visual ad to show what the color will look like on each home.  Since this is their home not ours and we cannot make a client put the color we say and often have clients that ****** search different brands to ensure they get exactly what they want. We also have the invoice that shows we purchased the shingles and paid with our account.

    The owner of ****'s construction came out to our house and we came to the agreement that the costs of the needed repairs would be deducted from the final balance due so this case can be closed.
