My uncle purchased a scooter with this company, he paid $2300 using his personal credit card on 1/24/23. He received a receipt that didn’t look like your normal receipt. The only thing noted was the sale price for the equipment, date and type of payment. My uncle called the company to return it, explaining that his back went out, he was in excruciating pain and he can not lift or use it. He’s wanting a wheelchair. Anyway, when he was in the store he talking to the salesman, he was never told that they had no return policy, never once was it mentioned that the sale was final and he couldn’t return it. The receipt had no information regarding a no return policy.

My uncle is 84 years old, and the salesman took advantage of him, the fact that he had NOT been informed that he could not return this very expensive piece of equipment. I called and spoke with the general manager, Carl ******* and he said he don’t take equipment back, I asked did he tell my uncle that he couldn’t return the equipment and he said my uncle didn’t asked. I told him as a salesman he should have explained that to my elderly uncle, that a very important piece of information. I believe this company preys on elderly people. Mr. ******* said he could tell by my tone, that I was like let’s get this done. I have no idea where this comment came from. I spoke firm and with confidence p, and genuinely couldn’t understand why they couldn’t take the new equipment which hasn’t been used back and refund the money back to my uncle’s credit card. Mr. ******* said he can charge him 25% to take it back. I’ve heard of a restocking fee but this was an outrageous fee, because I feel he’s at fault for not explaining their company’s policy on no returns.

I requested a bill of purchase receipt from Mr. ******* and documentation of their no return policy, which isn’t available on their website. He said he would mail this out. We’re looking for it any day. This company need to be investigated for preying on the elderly to make a sale.

I’m also seeking legal advice. We have requested a full refund and we want return scooter. There is absolutely nothing on their website about a no return policy. My uncle is so frustrated and feels he has to keep it. I’m also planning to contact the news, in your corner to publicize this shady business practice of this company.

My case number is ********.  Apparently my uncle is satisfied and has asked me to leave it alone.  He said the company worked out a solution that hes happy with. I still believe they took advantage of him even with the so called solution.  However, Im going to honor his wishes.

Thank you for looking into it. I really appreciate your help.
