      On June 30, 2023 a contract was signed to have a garage conversion completed by M&F Construction. I paid them deposits totaling $23,850. Since no work had been done on the project by November I requested a return of my deposit. They immediately responded by saying work would begin the week before Thanksgiving. The manager and two male workers did show up and worked one day with assurances that the after Thanksgiving a full crew would be out to finish the project. No one showed. In January 2024 I sent a certified letter to M&f's home office in *****, **. Stating I felt they were in breach of contract and wanted my deposit minus a $1500.00 allowance for one day worked and supplies. They did not reply in writing as requested but instead called me in February saying they were ready to finish the job. My sister had just passed and I said I would contact them later to discuss the future of the project. My executor duties and memorial service for my sister in ******* took up most of March. I contacted M&F late April and said I was ready to go ahead with the project. They worked May 2nd. but by the end of May, they had only worked that one day. I complained. They sent someone to do some sheetrock work. It was beyond horrible. The work was shoddy at best. I no longer felt they could complete the project in a timely manner and with quality work. June ******* I retained ***************************** at ********* Law Firm to stop them from doing any more work and to return my deposit minus materials and labor. I am not sure what ****** has done. ******** calls to her have not been returned. I believe M&F should be reimbursed for receipts for materials. and perhaps a token amount for the poor workmanship. I have engaged another contractor who is fixing the mess made by *** and who will be finishing the project.

                               May 12th, 2024 M & F set forth & met with *************************** to evaluate the project.
                               May 15th, 2023 M & F submitted a bid via email.
                              June 30th, 2023 Appt. set to contract the project. M &F went over all details of the contract & discussed an
                              approximate time frame to start in 60 to 90 days due to projects on the scheduling calendar prior to *******
                              Watsons.
                              Sept 25th, 2023 M & F delivered materials & began to work on project.
                              Sept. 25 end of Nov. 2023 M & F continued to work on project.
                              Dec. 1st, 2023 Met with *************************** to discuss a few changes that she wanted to make.
                              Dec. 2023 Jan. 2024 M & F continued working on project.
                               Jan. 2024 M & F received a letter from *************************** stating  for M & F to stop work until she contacted us.
                               Feb. 2024 Mar. 2024 M & F continued to attempt to contact  *************************** with no response.
                               April 15th, 2024   M & F contacted *************************** via phone & an appt. was set forth to meet to discuss changes
                               that the homeowner wanted to make.
                               April 19th, 2024 Signed a second contract documenting the changes made.
                               May , 2024 M & F worked on project.
                               May 24th, 2024 M & F received a text message from *************************** asking if we would be able to have the project
                                completed the end of the first week in July, 2024. M & F responded via text with a response of Yes.
                               June,  1st June 12th,2024 M & F continued to work on project.
                               June 13th, 2024 M & F arrived to work but was denied access due to a note posted on the front door stating  M & F
                               Construction no entry allowed.
                               June 13th, 2024 M & F was contacted by ***********; ******** with ********* Law Firm via phone.****** stated for
                               M & F to stop all work.

                              *************************** is clearly in Breach of Contract. M & F was denied access to the property so M & F was not able to             
                              satisfy the contract. M &F was given a written approval  allowing us time to complete the project by the end of
                              the first week of July, 2024. Please see attached a picture of the letter posted on the front door of the property
                              denying us access. M & F will not agree to any refund which is clearly stated in both of the contracts with *******

      I find M&F's reply amusing. The text they used was altered. I have given a picture of the entire text complete with the date it was sent. Yes, I did give M&F until July to complete the project. I had hoped that after almost a year they

      The picture of the text sent by M&F in their reply made me smile. I have sent a picture of the complete text I sent M&F, with the date sent, right off my phone. By comparison, you can see they deleted a lot of the information. In case my pictures don't come through, the text reads : *************************** here. I am at my house and am appalled to discover no work has been done in the last three weeks. Do you realize in thirty six days it will be a year since the inital contract was signed. A YEAR!! to complete a 4-6 week project. My patience has reached its limits. Will your company fulfill its part of the contract by the first week of July? that gives you five weeks. A simple yes or no will suffice. They replied YES. I did give M&F until July to complete the project. I had hoped they would step up and do the right thing. The text was sent May 24th. On the 13th of June I went to the house to check on their progress. That was when I discovered the garage in a total mess. Sheetrock, taping and mudding that was so subpar it was embarrassing. I am not the tech person. There are many more pictures I couldn't include. If the company can't do simple things like mud and taping correctly, I was afraid of what kind of mess the more complicated things like wiring and plumbing would be. On June 13th, I contacted ********* Law Firm. They advised me to post a sign saying M&F were no longer allowed on the property. M&F were contacted and told to return the garage door opener and the key to the house. They haven't. As a result of that failure, I have had to lock the garage door from the inside and go to the expense of having the door locks changed. I do not believe I should be forced to accept subpar workmanship and to continue to let M&F work on the project. I firmly believe they are now and have been for a year in default of the contract. I also believe they should be given a time limit in which to return my deposit. I am in the process of building a packet of information to send to the Oklahoma State Board of Licensure. Another avenue would be to contact FIVE on Your Side  News Program and see when they last did a piece on construction contractors. This garage conversion was to be for my sister, *******************. A week after signing the contract June of last year, she was diagnosed with terminal cancer. It was to be her place of peace and quiet surrounded by all her treasures. When she passed in January of this year, M&F had only worked one day on the project. M&F knew but didn't care. I am still sad and angry. I have found a contractor that will fix the mess M&F made and complete the project. What kind of resolution do I want? My deposit returned and if I could think of a way to stop M&F from doing this to someone else, I would. ***************************

      This truth of the matter is that the homeowner is in Breach of Contract. The contract clearly states all the terms &                                      
      conditions to which *************************** agreed to & signed. M & F Construction is well within the confines of our
      contract that clearly discusses the process of change orders, loss of business &refunds. The customer simply failed
      to comply with the terms & conditions. We simply were denied access to the home that prevented us from completing
      the project.  M &F agreed to the deadline completion date of July 7th, 2024  set by ***************************.  M & F had full
      intentions to comply with the date set forth. M & F requests our tools to be released that were left inside of the garage
      as well. If accusations stated by *************************** were correct regarding shoddy work etc.. then why did she sign a second
      contract with M & F on April 19th, 2024?

      April 19, 2024 I signed an amendment to the original contract. As per M&F text, work would begin May 1st. On May 2nd, I did meet with M&F to discuss with their ******* what was to be done. He did some work that day, putting in an opening for a pocket door. Up til that point, workmanship seemed normal or par. On the 24th of May, three weeks, later I stopped by to check on the progress. Nothing more had been done since the the first of the month. I sent the text saying I was appalled to discover no work has been done in the last three weeks, They said yes they could finish it. I had high hopes. Those hopes were quickly dashed. It was on June 13, 2024  I stopped by the house to check on the progress. They put up a lot of sheet rock and taped and mudded it in. Here is where the shoddy work came into play. I took 16 pictures of the mess. It was shameful. If your company can't do a good job on the simple things like sheetrock, what kind of work would be done on more complicated things. I did not want to find out. I had lost confidence in M&F's ability to complete the task at hand. I am sure M&F will say...Oh, we can fix that, but if you are a decent company, you do it right the first time. I went to an attorney and the sign barring M&F access was not put up until the day I discovered the sheetrock mess. I gave M&F a big chunk of money, the garage door opener and a key to the house so they could work as early or as late as they wanted. I made it as easy as possible for them to get the project finished. Today I still wonder why they didn't just finish it last year instead of dragging it out like they have. They were to return the garage door opener and my house key but no they didn't. I had to lock the garage from the inside and go to the expense of changing the locks. M&F talk about loss of revenue. They have over $22,000 for doing what...how many days work and supplies. You can't put a price on the emotional turmoil and heartache this has put me through. Planning with my sister where she would live the remaining time she had, surrounded by all her treasures. After a time of mourning, I decided to go ahead with the project and give M&F a chance to step up, instead they made a mess. No where in the contract does it state that I forfeit the deposit if I cancel the contract. If M&F and I can AGREE on amount for time and supplies for which they have receipts for, then deduct that from the deposit and return the rest. In all good conscience that is the right thing to do.

       The homeowner *************************** signed to two separate contracts to date to which she is obligated to satisfy.         
       M & F completed the second contract.  M & F purchased materials, incurred labor costs & suffered loss of           
       business due to the homeowners choice to lock us out preventing M & F from completing the project. *******
       simply should have followed the procedures documented in the contract that she signed. M & F will not agree
       to a refund due to the customer being in Breach of Contract!

      M&F did not fulfill the second contract which consisted of putting up a five foot wall and creating an opening for a pocket door. Yes, the pocket door opening was created but I have pictures showing stud work for the wall was not done. I took money out of a high yield CD in order to pay M&F. My loss in interest over the year has been $2,200. Doesn't sound like much but it is a lot to me. The only acceptable resolution is for M&F to send a check for $12,000. That will give M&F $10,850 for making a mess of my garage and leaving me in limbo for a year.

                                         M & F will not agree to a refund due to the homeowner being in Breach of Contract.  M & F had full
                                         intensions on completing the project by the completion date set forth by *************************** & agreed to
                                         by M &F.  The homeowner made the choice not to allow us access to the property & stopped us from
                                         working preventing us from completing the project. M & F is well within the confines of our contract!!                                     
                                         ******* simply should have followed the procedures documented in the contract that she signed.

      M&F has been given every opportunity to do the right thing. It is evident that they will not. I still site shoddy workmanship and their inability to get the work done in a timely manner since the signing of the first contract in June of 2023. M&F has stated they will not refund any of my deposit. This complaint has no resolution without it. All information will be shared with both Arkansas and Oklahoma Licensing Boards.
