On 09-30-22 we took our dump truck to Amity Truck and Tractor for a DOT inspection and found out that we needed a head gasket replaced. They said they would do it and it was a couple day repair. It took three weeks, and it was one excuse after another as to what was taking so long. Finally I called and there was a heated discussion, they threatened to keep our truck and when we picked it up we had to pay over ***** for a job that should have been *****. Then we took it straight from there to another mechanic shop because the electrical components were not working. Come to find out they left 5 hot wires hanging that were shorting out on the motor. We tried talking to them about it to get some of our money back and for them to pay for the other shops repairs. They said it was our problem and admitted that they new the truck was not finished when it left, but were unwilling to repay us because it was our choice to take somewhere else instead of bringing it back to them. However their mechanic was the one who messed it up and we did not want our truck damaged any further. They also did things that we did not request or ok for them to do. lus the head gasket is still leaking.

      Business Response

To Whom it May ************************ Friday afternoon 9/30/2022, the customer came in for a *** inspection and to receive the estimate we had been working on the previous week to his arrival. During the *** inspection we found the head gasket needed replaced, along with many other items. The customer was still on site so we discussed with him and he approved removal of the head and injectors. We agreed to take the job on but we cautioned the customer that we were extremely busy and would complete as quickly as possible, but with no completion date stated. With the parts/supply chain issues the world faces today, we do not know what to expect and do not make any promises until we have answers. We put the customer ahead of other customers of ours who were not in as much of a rush as this customer had stated. We got started right away Monday morning 10/3/22 with tear down and had the injectors and head delivered to our vendors by 10/5/22.
The customer called daily for updates and was given answers with whatever information we had at the time and understood that we were waiting for our vendors to get back to us with their findings. We let the customer know our findings per our *** inspection. We found that the clutch was out of adjustment and seems like it has been adjusted wrong, found slop in the pinion, found brake drums feel like they are out of round, found the drop axle tires need attention, found drop axle needs bushings, found box/cage for ram moves around a lot, found crack in the dump box, found high beams have moisture in them, found many frayed wires in the engine compartment and in battery box, found steering box to need further inspections to find fix. The customer was told when he arrived to check in and we discussed the extreme deferred maintenance of this vehicle. Unfortunately, we were unable to approve/complete a *** inspection as this truck does not meet the standards to operate on the highway.
Our vendor for injectors had an answer to us by 10/7/22, customer approved this purchase. Our vendor for the head had been in contact with us letting us know they were short staffed, but working on it 10/10/22, the customer was told this information. On 10/11/22 the vendor let us know their findings and the customer was told.
Other parts were ordered 10/12/22 as we now had answers of how to proceed. The vendor who ordered these had shipping delays from their warehouse, customer was told. I personally went to pick up parts that had not been delivered and then a day later went back and got them to speed up the process for our customer.

The customer continued to call in daily to check in, had many conversations with our staff and phone calls with our owner and we continued to move forward with his requests. The customer also showed up to view items we had been finding along the way and was personally shown. The customer added a full service, volt meter check, tightening of steering box, fasten wiring harness behind motor.
10/19/22 The customers wife called in very unhappy to discuss why the truck is not complete and why we are not in contact with the customer. I assured her we have been in contact with her husband the entire time and she was very rude, ******* and angry stating she would pick it up on her time since we were taking our time. I then let her know the truck is not to be released until we have full payment and thanked her for her time. I then called her husband to let him know I would not have another conversation with her as she was very rude to me on the phone.
The customer came in and paid for the *********************** in full and signed a document stating the truck had many other issues, shown to him and noted on their workorder and there were no warranties expressed or implied as they didnt have the time or funds to continue with other repairs.
The customer called the owner of the business after stating there was a **** issue and we let him know to return and we would look into it for him. They brought the vehicle somewhere else and had additional repairs done that we had noted on the workorder and had no approval to fix while at our shop.
Please see supporting documentation. Please let me know if I can help any further.

I am rejecting this response because: When we took the truck to Amity Truck Shop, it was for a Dot inspection. Never did they talk to my husband or I about having done one or give us the normal paperwork to show that one was done. We did however take it to another reputable truck shop in the area and our truck passed the inspection which I can provide the paperwork for that if necessary. When we took our truck to Amity we were aware of the condition of our truck, it's older and with age comes wear, however we have a regular certified truck mechanic that works on our truck and makes needed repairs and when we got our truck back from Amity Truck shop we took it straight to ************ and he was floored at the condition our truck was in. The wiring that was hanging all over the place was not because the truck was old, it was because the wiring had been hacked on by Amity Trucks mechanic and wired up wrong causing the things to short out and blow fuses and not work, it messed up the ignition switch which we did not have any trouble with until we got it back from Amity Truck and we had to buy a new alternator because of the wiring job Amity Truck did. Also, the fan that wasn't working had just been fixed by ************ and I have paperwork for that if necessary, however it was not working when we left Amity Truck.

Yes ******** did keep in touch with my husband and always took the time to speak with him but, like I said before, nobody ever really knew what was going on down there and yes she did tell us " we are waiting on *************. So fine I get that but three weeks is not the estimated time we were told in the beginning because if it was we would have taken our truck somewhere else because we can't be down that long. As for the paper we signed that talked about the shape our truck was in, we were told that we had to sign it or they would not let us take our truck off the premises and they threatened my husband with a lawyer. And yes they offered to fix the truck after we had taken it home but they didn't know how long it would take, they would get to it when they could and after we watched their mechanic melt down his tool in our truck, we decided it would be unwise to let them do any further damage to our truck. We have since found out from a number of other drivers etc... that this truck shop does not have a good reputation for knowing what they are doing and being honest, they even have bad reviews on their web page. We simply asked for them to pay for all the things we had to fix due to our truck being worked on at their shop and the mechanic's invoice. That would be the decent thing to do, seeing how we paid out over $7,000.00 to them and still had to take it somewhere else.

      Sincerely,

      *********************

      Business Response

      Date: 11/29/2022

      Good Afternoon,
We received an email that there was a response to our response 11/28/2022. After reviewing here is our response.

While we can sympathize with the position the customer has found themselves in with their truck, we stand behind our previous response and all the details we provided with time stamped notes from our system of conversations we had with the owner ***. I am not sure if his wife ***** knows that this vehicle did NOT have a keyed ignition switch when it arrived to our shop, it had a manual hand switch on the dash to start the truck. We did not work on this area of the vehicle, nor any wiring anywhere on this truck besides re-anchoring the wiring harness that was hanging from firewall with new bolts as per the customer's request. The only wiring we would have done while completing head gasket repair would have been approx. 4-5 wires going to the ****s and temp gauge.
We would like to re-iterate the conversation the owner had with *** about the **** issue, we stated that it was not a problem, to bring it back in for us to look at since they had to leave in such a hurry with the vehicle that day; if its something that occurred at our shop, we would have taken care of; or it could have possibly been something in a switch or wiring deeper down. *** again stated that he was aware of its electrical/wiring condition.
We are glad to hear that they made the necessary repairs to get their DOT inspection completed. We could not give them one as it did not meet state regulations to be on the highway when it left our shop as it needed many further repairs as stated on their workorder.
Regarding the $7,000 bill, it did not only include a head gasket replacement, this included removal of head and 6 injectors, replacement of head, **** ************* gaskets; replacement of all 6 injectors, clean up inside piston sleeve, full service on fuel and oil filters, re-anchor wiring harness, checking volt meter, valve adjustment, full inspection & test drive as these were the items *** requested and we completed.
We are happy to further discuss any questions you may have to bring the customer up to speed and resolve any questions.
In closing we would agree to discount 1 hour of shop time that was offered previously for the **** wiring issue.

I am rejecting this response because: Amity ********************** and Tractor is responsible for the work done by their mechanics. On October 19th we showed up to pick up our truck, we were NOT in a hurry, in fact both ******** and **** left before we did. **** the mechanic was still there when we ATTEMPTED to leave in the truck. Before we could even pull out of the driveway there were a number of things not working on the truck that were working when we dropped our truck off.

I, ***** am aware that the truck did not have a keyed ignition because I have driven this truck before and I start the truck everyday before work. However due to the hot wires that were left dangling all over the motor, the end result of that was us having to replace the ignition, the alternator and have our regular mechanic fix all the wiring which I will include a copy of that invoice today. **** the mechanic tried to fix some of the wiring but he seemed a little lost as to what went where and eventually melted down his meter, he also ran over to the shop and picked up a piece of wiring on the floor then ran back over to the truck and attempted to make it fit some where. After about ***** min. we said enough and drove it to ************.

As for the *** inspection, we took our truck to Carlton ********************** Shop on November 7th. We had no problems passing the inspection. We met all the requirements for the annual vehicle inspection in accordance with 49 CFR part 396.

As far as the $7,000.00 bill goes, we did get estimates for the job that was done and all other estimates stayed under $5,000.00.  We got price checks from ****/Kenworth which is where all our gaskets were ordered and I know how much everything would cost and still we would have come in at under $5,000.00 I have talked to the shop where our heads were done and have checked pricing on everything and still come in under $5,000.00

I have a receipt from Carlton ********************** shop for a valve cover gasket that was replaced the same time as the *** inspection. This had to be replaced because it was continually leaking oil from the time we picked it up from Amity ********************** until a new one was put on. The mechanic at Carlton ********************** said "it looks like an old gasket was used" even though we paid for new ones, so again mor money for repairs that were supposed to be done at Amity.

Yes we were told that we could bring our truck back to you for the needed repairs but after we saw the shape the truck was in and watched as your mechanic further messed things up, we decided it would be foolish on our part to entrust your company with any further mechanical repairs.

It seems as though you are unwilling to take responsibility for the actions of your companies employees, and the damage to our truck, and the cost of all the extra repairs needed after leaving your care. Until those things are taken care of there is no resolving the issue.

      Sincerely

      *********************
