      On June 29, 2023 I signed a waitlist form for a home (requesting 1800 sq ft or more), paid $3,000 deposit to Touchmark to be on the wait list. I explained to the salesperson that I had also signed waitlist forms at ********* and ********. The form at Touchmark included the word non-refundable but it was explained I needed to be serious and take a home if they had one, it was meant to show that I was serious about considering Touchmark. (My parents lived in a Touchmark for over 15 years and I had a positive view of this company so would have moved there. ) I sold my house the day I was ready in November and there had been no home at Touchmark, but Rockwood had a home available and I bought it and moved in Feb 12. I received my deposit back from ********* in 2 days. I made 3 trips to Touchmark, being assured that it would be worked out. After 3 more contacts I was informed by ******** that my deposit was non-refundable. I wrote the *** in ********* to ask about this practice and did not receive an answer. I have never known of a deposit not being returned if the product wasnt delivered (whether the sales agreement said refundable or non-refundable) and wonder how many senior citizens have been taken advantage of. With over 100 on the waitlist that is a lot of money kept by Touchmark some of the people undoubtably died or had to make another decision, like me, and maybe Touchmark kept their money too. I made a mistake by not scratching out the word non-refundable and realize that. Although by words and actions I was assured that Touchmark is reasonable about this policy, legally I made a mistake by even considering them. I do strongly believe I should receive a refund because Touchmark could not in the timeframe I TOLD them deliver on their end of the contract. At the very least, a company that treats people this way should NOT be rated A+. Thank you. Have a nice day.
