On 9/27/2022, I signed a contract with Fulltime Contractor with Jason Olinger as CEO of the company to replace my roof on my home, which is also my business. He gave me a quote of ********* to replace my roof. According to his contract, he would start the job in 3-5 weeks and once started would be completed in 5-7 business days. I paid in full.I received a text on 10/13/2022 that the materials would be delivered on 10/18/2022 and that his install team would be there on 10/19/2022 to start on the roof and that it would take ***** days to complete due to the size of the crew and that they would be working M-F. One person showed up. I also rearranged my client appointments as my home is also my business. He also sent another text that his project manager would clarify the work schedule, which never happened. He also went into detail about the weather and would like to get that done before it changed. We had 10 days of good weather. One person showed up on 10/18/2022 and was here from 8;30AM to 8:45 AM and left for the rest of the day. He oversaw the delivery of materials. I did not see anyone until 10/26 at 8:30 AM and he left at 10:00AM, back at 11:00Am and left again at 1:00PM. He took off the roof approximately 2 feet around outside of the south side of roof. He put paper around the 2 feet with no tack down. This was completed in the next 2 days. His worker was here on 10/27/2022 from 8:30AM, left at 9:30AM back at 9:45AM left at 10:00 AM back at 11:00AM, came back at 1:00Pm with another worker and left at 4:23PM. That was the last time I saw any worker. I have text and phone calls throughout this exchange and sometimes Jason Olinger would get back to me and sometimes he wouldnt. Jason Olinger sent me a message on 10/28/2022 that he needed ******** and went down to 3500.00.This is what he came up with on 11/2/2022 which was just typed out:He only wants to return ******** for no new roof.I have it itemize but won't allow me to put in here.Business Response

The updated project timeline was communicated to the homeowner and was mainly due to the weather. We do not remove roofing materials while its raining in an effort to avoid leaks. We did a complete tear-off of one entire section of the home and then installed the self-adhered waterproof membrane in its place (as described in the work order agreement).
The working schedule for this job was constantly changing due to inconsistent weather conditions. As for my availability and responsiveness to the homeowner, Im really not sure where that is coming from as I am always very responsive to every client that I work with.Once we removed one entire section of the roof, we uncovered multiple layers of roofing materials. Our working agreement included the removal of 1 layer. I notified the homeowner immediately and explained the changes needed to our agreement and then presented her with multiple options for how we can proceed. She opted to proceed with the least expensive option for $3500. I did not discount the most expensive option to arrive at the price of the least expensive option. There were multiple options that I explained in detail during a phone conversation with the homeowner. The next day she decided to cancel our agreement and requested a full refund.
In an effort to honor her request to cancel the agreement, I explained that I would have to charge her for the materials that were already purchased and the labor hours that were already invested. It is clearly stated in the signed agreement, Should Owner cancel this Agreement more than three business days after they sign it, Owner shall be liable for all costs incurred by Contractor as a result of said unexcused cancellation, plus 10% of the contract price.
I then provided the homeowner via email with a breakdown of all costs incurred. Additionally, I offered to discuss other possible options in an effort to find a reasonable solution. She replied to that email stating I have reviewed the amount of money that you would reimburse, and I will not agree to this. I have contacted the BBB and have filed a complaint with them, they are aware of this situation.
My reply to that email was, I understand. Thank you for the update. I did mention in my last email to you that I would be happy to discuss other possible solutions to resolve this matter with you. If you're interested in exploring that with me, just let me know so we can schedule a call. Thank you.At this point, I am still willing to discuss other possible options with the homeowner in an effort to arrive at a reasonable resolution to this matter.

I am rejecting this response because:Jason Olinger did not communicate to me an updated timeline. We had 10 days of good weather from 10/19/22 to 10/31/22 to work on my roof. They should have been working on my roof Instead of working on my roof he wasted 10 days, and he sent me a notice on 10/28/2022 that I needed to pay additional moneys. I informed him I could not afford it, and nothing has been done to my roof and that was on 10/28/22. He did a small corner of my roof, which I have pictures and the waterproof membrane was not even adhered to the roof. Backing was not taken off to adhere to roof.
For ********* my entire roof should have been included in that price and completed, yet he wanted more money to complete my roof. I have a couple of estimates 1 in writing for ********* to do a complete roof. I asked for a materials list, which he typed up on a piece of paper, I want the invoice for the materials list. He stated I signed a 3-day cancelation notice; I would like a copy of that also. I do not have one in my DocuSign contract he sent to me. He has my money and I have no roof and I DO NOT trust him at all to even complete it. It is not my fault he could not find a crew of more than one person. His project manager only worked on my roof maybe a total of 6 hours and that was on 10/26/22 and 10/27/22. I guess he leaves me with no choice except to file a complaint with the CCB.
The only acceptable resolution is for Jason Olinger to receive ******* for his time, he is to pick up his materials since I dont have an invoice for it. Those are my terms. He is entitled to some money for his time, but no more than the amount specified.
He e-mailed me with what appears to be a new contract and wants a zoom meeting. I will not meet him on a meeting of any kind unless its in writing and with a mediator present.Sincerely,

Attached is a copy of the original work order. As outlined in the work order, removal of one layer of asphalt shingles was included. Once we removed that (included) layer, we found additional layers that were not a part of the original agreement. That is why change order options were presented to the homeowner. Changes for the project and how we handle them is explained on page 5 under the Terms and Conditions section of the agreement.
Also explained in the agreement (on page 6), under the payment terms section, is an explanation of the cancelation policy, which the homeowner agreed to by signing the agreement.
After explaining to the homeowner that there are options to resolve this matter, I received a reply message on 11/9 stating: I would like to schedule a time with you to discuss the options regarding the roof. Please let me knows when we can work together to resolve this matter. I would prefer a time around 4:00 pm. Thank you, *****************
I replied to her message that same day (11/9) with a link to my scheduling page. The message read, "Here is a link to my booking page. Please schedule a time that works for you for us to meet. Thank you. By following the link she is able to book a meeting time that works for both of us. Still to this day, she has not scheduled a time to meet with me to discuss options to resolve this matter.Customer Answer

He wanted the ******* additional moneys with no plan in place for what would happen and when my roof would be completed. He therefore breached the contract by not having my roof completed by his own time frame, in ***** days. He did not have a crew and only had 1 person who showed up whenever he wanted to. He has never come up with any plan in writing to complete my roof, therefore because he will not put it in writing, I do not trust him anymore. He tried to get me to do a zoom meeting to discuss options like I am a new client. I am not scheduling a time to speak to him in person, on the phone, because I have asked him several times to provide items in writing and he will not provide anything in writing. The only way I am willing to do anything with this man is in writing because he is not transparent in his actions. I will be happy to sit down with a mediator to discuss other options with him, but since he will not provide anything in writing, I will not speak to him directly as he is not transparent with his actions. As far as page 6 cancelation it states 10% of the contract price which would be ***** instead of *********, but you breached the contract by not completing the project in the time frame that you stated you would do. You and your project manager left all the materials out and not covered or protected as they should be, so you can have them back. You should only be paid for the labor actually completed, which isn't much.

-Full Time Contractor (FTC) Jason Olinger *************** and I signed a contract May 25, 2022 for roof replacement at *********************************************************. Per that agreement "Work will commence in approximately 3-5 weeks from date of signing". As of today, Aug 19th no work has been done except for dropping off several thousand dollars of materials in our driveway, instead of behind a secured gate. (Key location provided to FTC).-Neighbor reported materials stolen to the ************************** just prior to 7/29 with case # P20222412 assigned. I reached out to FTC 7/29 same day upon arriving at this property & learning of this, including via voicemail, text, and email,. I also included Jason on many emails with Officer ****** requesting Jason's assistance, and he finally picked up the phone ~1 week or more of us attempting to reach him daily. With latest reschedule job was supposed to start this week, and he has not responded to daily attempts to reach him, beginning on Monday.We've paid ~$5k deposit, but MORE IMPORTANTLY our existing roof is not likely to make it through another winter as we've lost shingles, and shingles 'seem' paper thin (1mm actually). Jason is not located in CB, but he assured me it would not be a problem in completing the work on time.My ******** would rank him as low as possible on communication and commitment-follow-through, and materials remain exposed to theft where his 'crew chief' has yet to take an inventory of missing materials needed for the police report & to ensure no further delay.PLEASE HELP -Job was to have been started in June, with 5-7 days to conclude the work. Still no response from Jason, and too late in the season to line up another roofer, which he assured me would not be an issue.Business Response

Full Time Contractors completed our roof before the rains hit, and their work seems excellent. Jason is very professional, and has in-depth-expertise of roofing systems. (Really stood out from his competitors). I believe the issue in my case is that it is very difficult to hire roofers, HVAC installers, and painters in Coos Bay. (We ran into delays with HVAC & exterior painters as well). I'd consider working with him again, but if in Coos Bay county, inquire about the current CB labor market at time of going out for bids'.
