    4/21/22 we signed contracts w/ Evergreen Valley Landscaping (E) and ****** Ladder Construction (J) for a project; E a retaining wall and J a fence. E made all arrangements ****, and both agreed to do our project. With E, we agreed to $13,470 w/ 50% down, and later added a parking pad for $2500, totaling $15,970. Estimated completion date was end of Aug; it's still not done. Initially we worked w/ (former) E owner, ****** ***, and then later w/ (new) E owner, ************************Our complaints against E are many-Poor communication b/w E owners, w/ us, and ****; property damage (E fixed); wall defects (gap-E fixed), negligent backfill (addressed but this may result in further delay of completion); adhesive left on wall (E agreed to remove but hasnt); wall construction inconsistent with our wants.Also E asked for/took rest of payment due 9/6 before completion-contrary to Payment is due upon completion unless alternative arrangements have been made per our signed agreement. We concede we should've reviewed our agreement before paying, but we also feel it was a violation for E to ask for/take remaining payment due before completion.10/18 we spoke w/ ****** and relayed our dissatisfaction. ****** apologized and verbally committed to refund some of our money. Days later, ****** reneged via text saying, "you got a fair deal. After trying to reach ****** for a week plus, we spoke via phone 11/11 and ****** again said he wouldnt refund any of our money. We asked him to arrange for both he, ******, and us to talk more, and he said he would be in touch the next day. Since then we have tried to reach ****** many times w/o success. One of our texts stated, "If you aren't agreeable to refunding a portion of our money, what are you willing to do? We'd like to know your thoughts, and we would also like to share our own." We are dissatisfied and feel dismissed. We desire some compensatory gesture from E-be it monetary or other, and also still want the adhesive residue removed.

    As per the initial complaint, Evergreen Valley Landscaping LLC partnered/has been working with ****** Ladder Construction LLC to complete a retaining wall and fence for our backyard space.  Per the signed bid proposal and contract with Evergreen Valley Landscaping LLC (attachment provided with initial complaint), Evergreen agreed to sufficiently backfill behind the retaining wall so that ****** Ladder Construction LLC could then post and fence the backside perimeter.  Wednesday, 11/30/22 ****** Ladder Construction LLC informed my husband and myself that they could not post and fence along the retaining wall as planned due to insufficient backfill.  More specifically, the backfill was described as "quicksand" (see attached photos) and we were also informed that more soil/sand with compacting is necessitated (up to the bottom of the retaining wall cap - see additional attached photos illustrating current backfill and how this falls well below the level up to the bottom of the retaining wall cap), as well as simply time for the earth to settle.  Evergreen Valley Landscaping LLC first provided us with an estimated project completion date end of August 2022; it is now December, and still our project is incomplete.  Moreover, it is plausible that posting and fence completion will not be advisable in the near future, but rather months from now, taking us well into the new year 2023.  All of this was communicated to both previous and current owners, and current owner, ***********************, texted the evening of 11/30/22 agreeing to talk via telephone the following evening on 12/1/22; ****** did not call as promised, nor did he respond to the multitude of messages we left in our own efforts to reach him.  We also attempted to reach former owner, ****** ***, and also left a message for him, and he too has not responded.  

    Additionally, I discovered this morning that one of the caps has not been secured to the wall (see additional attached photo).  Per our signed contract, there is a warranty of service stating "All work performed on this BID will have a 3 year workmanship guarantee.  The work will be free from defects other than those inherent to the work as specified; and the work will conform to the specifications of the contract document."  

    Our signed bid proposal and contract clearly states

    "Installation of 4-5 tier unexposed side & glue regal cap" and you can see from the pictures there is a cap that is not glued and there appear to be portions of the wall that are exposed that shouldn't be due to insufficient backfill.

    "...base layer wall foundation base fill with 3/4 minus and compact; Back fill pipe with 3/8 minus quarry gravel and install permeable fiber layer" and again, we have been told *************** Ladder Construction LLC that the current backfill is far from sufficient for posting and fencing. 

    We are wholly dissatisfied and feel incredibly dismissed by **************, and Evergreen.  Also, because Evergreen Landscaping LLC ASKED FOR AND ACCEPTED payment in full BEFORE project completion - a direct breech of contract (see original complaint and attached signed bid proposal and agreement) we feel they are unresponsive to our efforts to achieve resolution likely because "they have no skin in the game" so to speak - they have all our money, and we only have a portion of our project.

    Please reopen this complaint, as the business owner, ***********************, has not called us as promised, and all issues remain unresolved. Also, please communicate with my husband, ******************* (ccd) as he will be handling this moving forward. Finally, it seems the information you have for Evergreen Valley LLC is no longer accurate - including physical address and phone number. ***********************, the now current owner, can be reached at *****************.
