    8/27. I received a E-mail with multiple quotes for different transmission rebuild options and a list of parts that were to be installed in the extreme duty option.9/9 I called to confirm moving forward with the extreme duty transmission quote.9/18 called and left a voicemail asking if they could install a rear main seal since they would have easy access with the transmission removed, received confirmation via txt.9/26 Called to check in and see how everything was going, they didnt have any information for me but said it would be done in another week or two.9/30 called again to see if i could drop off a additional part for them to install if the transmission wasnt installed yet and wanted to see if they were able to get any updates on *** for transmission completion, they said they werent able to get ahold of anyone at the transmission shop but it should be done in a week.10/10 Called again to see about any updates on transmission completion since i had yet to receive one email, message or phone call with any kind of information. Again they had no information but said it should have it done in a week 10/16 I called the transmission company that was shared in the email exchange to find out they didn't have the transmission and knew nothing about Aba auto.10/16 i called Aba to ask what was going on since they sent me a build list from a company they werent using, ***** (owner) got infuriated with me for calling the company whose build sheet he had sent me and said he was just using that sheet as a reference for what they were doing to my trans. When asked again about completion date he said 10/18 or 10/21 it will be ready 10/28 i had received email and txt confirmation the pickup was ready, i paid the rest of balance in full took the pickup home to immediately notice it wasnt fixed so i brought it back on 11/1 after 200 miles of driving. They had the pickup in their possession without any diagnostic until 11/26 when i took it back still broken.

    *****, had brought his Dodge truck in for some transmission issues. After inspection he approved the rebuilt transmission replacement. after we gave him the info from the builder. He was told the timeline that we were given from the builder. He would continue to call and we would give him an update thru what the builder was giving us. We were would tell him any info that we got thru the builder, straight to him. During the time we were waiting , I got a call from a transmission shop that told me ***** was calling around to locate the part. I was offended that he would call around and told him so. After there repair he notified us that there was a problem. The transmission was covered by a warranty and was told to bring it by . After we looked at it he was told there was some diagnostic needed. He was informed that we were working thru the diagnostic. He was unsatisfied with that and came in to the shop and started causing an issue. I wasn't going to argue with him. I explained to him that if he was not going to argue with him. and if he doesn't want to have us go thru the warranty or diagnose the truck then take it and we were not responsible for anything after that. I informed him the information for one of our warranty companies. And after I finally got the warranty info for the builder I sent that to him He agreed as he left that he would not be contacting us about the truck. At no point were we trying to not help him. At no point were we trying to be deceitful or take advantage of him. He got the transmission that he paid for , and the warranty will cover any repairs that it needs.

    I am rejecting this response because: when I initially asked for the estimate and the list of parts that were going to be used in the rebuild I was sent the information from a transmission builder called powertrain solutions and a list of all the parts they use to rebuild a transmission. I went forward with the rebuild thinking that they were the company and list of parts that were being installed in my truck given that was the information provided to me along with estimate. When *** auto could not provide me with an estimated time for completion after exceeding the intitial quoted timeframe by a week I decided to call the transmission company that was provided to me on initial estimate (powertrain solutions). Powertrain solutions told me they did not have my transmission and have not heard of ********, when confronting Owner of *** about this he got frustrated about me calling a company that he mislead me to believe was doing the work on my transmission. I then learned the transmission was actually being built by (transmission exchange *** and I was told by ***** the initial build list of parts I was sent was just what he was basing his build off of he was never actually going to have it sent to powertrain solutions therefore that full list of parts were never going to be installed even though thats what was insinuated from the initial estimate. This is both deceitful and fraudulent behavior.

    Dear ***** *********,

    Pursuant to ORS ******, this letter serves as a formal written demand for a full refund of $7,140.62 related to the transmission rebuild service I paid for at your shop. The work performed was plagued by misrepresentation, excessive delays, improper repairs, and failure to diagnose critical issues, rendering the service unacceptable.

    Key Issues:

    Misrepresentation & Lack of Disclosure You provided an estimate listing a specific transmission rebuild company, yet my transmission was sent to a different shop without my knowledge or consent. This deprived me of the ability to verify the quality of work and parts used.

    Unreasonable Delays & False Justifications The repair was quoted at 3 weeks but took 7 weeks. You cited an additional 8-hours of requested work as a reason for the delay, yet this work was completed before you even received the transmission back. Furthermore, the rear main seal work you referenced has no documentation, further casting doubt on its legitimacy.

    Failure to Diagnose & Additional Delays After driving only 200 miles, I experienced the transmission slipping gears and shutter shifting. When I returned the truck to your shop, you failed to properly inspect the transmission, dismissing my concerns and focusing instead on two unrelated computer codes that did not match my description of the issue. As a result, you kept my truck for another two weeks without addressing the actual transmission failure.

    Proof of Faulty Repairs Due to your failure to resolve the issue, I took my truck to another shop, which rebuilt and reinstalled the transmission within one week. Upon inspection, they found a bent strut inside the transmission, proving that the initial rebuild was defective.

    Your actionsmisleading me about who performed the rebuild, failing to complete the work in the quoted timeframe, refusing to address the actual transmission issue, and ultimately delivering a defective productconstitute negligence, misrepresentation, and deceptive business practices.

    ORS ****** Notice & Legal Consequences

    Pursuant to ORS ******, if this dispute is not resolved within 30 days of this notice, and legal action is required, I will seek not only a full refund but also reimbursement of all attorney fees and court costs. This statute entitles me to recover such costs if I prevail in litigation, and I am fully prepared to pursue legal action if necessary.

    Demand for Refund

    I am demanding a full refund of $7,140.62 to be issued within 7-10 business days from the date of this letter. If I do not receive confirmation of payment by 03/14/2025, I will proceed with initiating legal action.

    I expect a prompt and professional resolution to this matter. Please confirm in writing that you will issue the refund by 03/14/2025.
