    I am the owner of a small espresso repair company and lease a office from NW FLEX SPACE at their main street location last August. I was late on my rent 1 month and 7 days, I was/am going through a health crisis and was late in all my bills. Without notice I received this and was locked out from all my customers equipment and tools. I am attaching the email that played out their demands. I understand this is legal, but the non truth was the amount I owed. My deposited was **** and with that I only owed $600. I had to scammble to come up with 2k in cashiers check that day to get to my belongings. Then was told I didn't not owe that much and we're holding my money, even the amount they were not owed for 30 days. No one has inspected my unit even though I immidettly moved all my belongings. I feel like I have been extorted and scared into doing what they wanted, with false calms and intimidation. They are illegally holding money I do not owe them. They say this is all legal but I was locked out of my tools with out noticed and forced to not work for 3 days, while moving. Only To pay the amount I was told I legally owed immediately and now have gave them all my spare income and it is the first of the month. Can they do this? They say they are a business to help grow small businesses but it is just a preditory landlord sceme, that only takes investment and the will to take advantage of real small businesses. This is a predatory business. I would like the money that was taken from me and my desposite immidatlly .

    This licensee had four payments rejected for insufficient funds and made four late payments. He made no payment for June 2023 and never reached out to ask for assistance. Our team reached out to him to try to support him and he agreed to a payment plan that broke his monthly payments into two installments, due by the 5th and the 20th, for his future rents (sent June 20 2023). He missed his July partial payment and we began the eviction process under the terms of the contract he agreed to. We have attached a copy of his contract, tenant ledger, and email communications. In total, he owed $2,357.50 at the time of eviction.

    It was communicated to the licensee that he could pay $1,600 toward his arrears and that we would give him access to collect the rest of his property. A copy of the phone call communicating this is provided. That he showed up and handed us $2,000 was a mistake that he made and we had no way to partially draw off of the ************* money order he submitted for payment. We also communicated the $1,600 total to the agent who called on his behalf. The tenant repeatedly demonstrated during our relationship that he could not keep track of details - in the same phone call with him it was clear that he did not understand the terms of the bi-monthly payment plan we setup with him, either. Even with the $2,000 payment, he still owed NW Flex Space $357.50.

    Under his contract, we had the right to pursue August rents from the tenant and chose not to out of consideration of his situation. We also rushed ahead the inspection of his unit, which we had thirty days legally to complete, and have the check with his refund (even though he still technically owes us money under his contract) ready for him to collect today. While he was restricted from accessing the property, members of our team provided him with access to his space so he could collect property in order to meet his obligations to his customers. 

    Deposits are not intended to be used to cover the licensee's rent obligations and until we inspected the unit for damage, we could not apply it toward the past-due balance in the event that the licensee damaged something and it was in need of ************ the inspection was completed last week, the $1,050 deposit was applied toward his remaining balance and he is being issued a refund of $665 (despite legally being on the hook for the August rent obligation we forgave in recognition of his hardship).

    NW Flex Space did everything we could by this customer, more than we had to, and more than anyone else would. He failed to meet obligations he agreed to under his contract repeatedly and could have been evicted much sooner and more harshly if we were a less scrupulous company. If having to meet obligations that you've agreed to is "being extorted," than every single person with a car loan, a mortgage, a lease, a repayment plan, is also being extorted. This complaint is unfounded.
