Heres the updated explanation with the additional details:I hired a contractor, ***** Dukan, to build an ADU for my childcare. The agreement was made on September 5th, 2024, and we paid an advance to him$5,300 by check and then an additional $3,000 on September 20th. After he started the project, we reached the point where a permit was needed, and I discovered that ***** did not have a valid license. We attempted to resolve this by finding someone to sign off on the work, but upon reviewing the project, we found several major issues, including the fact that the structure was built without a foundation. As a result, we had to demolish everything. We lost over $15,000, which included the down payment and materials. Although we tried to negotiate a solution, ***** insisted on being paid more money to fix the mistakes, and we were unable to come to an agreement.

    Business Response

    Date: 10/24/2024

Hello, my name is ****. I received a letter from BBB today and I am preparing a quick response. The complainant is not acting truthfully and we are seeking help from a lawyer. We do not actually have a license yet, but I have already bought the book and am studying for it. Tomorrow I have an appointment with a lawyer who will help me with the process. From the beginning, this lady knew that she did not have a license to carry out a large project, but she called me and insisted on it. She knew that I did not have a license and I can prove it through the conversations I had with her. My partner and I were called by her to do a small job in her house and she insisted that we build this additional room and said that she would tell the city and the inspection that it was done by a member of her family. Only after the inspection was done and required a foundation did she change her mind. I suggested two people who are licensed to help with this issue and they said that a concrete foundation would be needed. It was at that moment that she started acting in a way that blamed me and ********. She said that the house was found to be in ruins and yet she requested that the children be removed from the premises. I argued with her that this was very dangerous but she ignored it and did not remove the children from the premises. I am 53 years old and my partner is 45. We are struggling to be as honest as possible.

Above all, we apologize for working without a license, but I am starting the process. I am married and have two young daughters and it is very difficult to choose a job, but I can say with certainty that we have never and will never run away from our responsibilities.

I do not speak fluent English and I need an interpreter to help me with all this. The only thing I can promise you is that this woman acted in bad faith the entire time and is lying about almost everything she said.

She gave me a deposit and knew from the beginning that we did not have a license and only changed it after the inspection required a license and asked me if I had a friend to sign this for us.

I have a photo and all the conversations I had with her, including audio.

Is there a physical place I can go to clarify things better and present the evidence?

For now, thank you very much for contacting me and I await the guidelines to know how to proceed. I am filing a lawsuit for defamation, slander and non-payment on her part.

I will not attach some of the evidence I have that she is lying and acting in bad faith because it is in Portuguese and you would not understand. But if it is possible to take it and present it in person, I would like to bring it to you.

Thank you and have a good day!

    Tell us why here...

    Dear Better Business Bureau,
Thank you for reaching out. I wanted to clarify that the services provided by R&F "Remodeling and Repairs" were fully paid for using ***** funds. The entity managing the ***** has been informed of the issues, and they are prepared to pursue the owner directly to recoup the costs incurred. My company has already supplied all necessary testimonials and documentation to support their action.
Given these steps, I do not require further conciliation at this time. Thank you for your assistance.
    Sincerely,
    ***** ********
