    In July of 2022 I hired Emmanuel Site Works to excavate my build site in preparation for ************* the next year. As per the agreed contract I paid $16,618.00 for the company to provide me with a build site. Emmanuel Site Works failed to cut the build pad to the proper specifications to fit the home as per the plans. They also did not use adequate amounts of gravel or compaction. Although they were informed I would not be building until the following season they did not provide any sort of drainage from the site ultimately resulting in complete failure. Prior to building I was forced to hire another excavation company to completely repair everything they had done. I will be attaching photos of what they considered a properly dug site vs. what was actually usable in the end. I will also attach the letter I received from the Geo Engineer stating the site is unsuitable for building on.

    We did excavate a house pad for him.  He laid out the site and we cut out the pad according to his specifications.  He waited through the winter to decide to use the pad.  It wasn't up to us to provide drainage for his property.  He shows pictures of the pad after sitting for months through the rainy season.  He didn't show the finished product when it was first finished.  Even after talking to the Engineer, he said he would expect the pad to be soft from the weather of the winter.  If it wasn't satisfactory, then why did he pay us when finished.  If he was happy with it, he didn't let us know.  Looking at the pictures it looks like he decided he wanted a larger pad and wants someone else to pay for it.  He didn't pay us $16,618.00 to do the job.  Part of the payment was to cut down trees and haul off the stumps. If we had known that he wasn't going to use the pad until after winter, we wouldn't have done the job.  We would have told him it would be best to wait.

    I am rejecting this response because:
    The contractor was very clearly informed that I would not be building until the following year. Also I provided a set of plans for the excavation company to follow. As a customer I was not aware that the job was done poorly until my foundation guy and geo engeneer told me that it was unusable.  I payed them because I assumed they had done a job satisfactory to the plans I had provided knowing I was a year out.
