I purchased a generac home generator system from Landrys home energy solutiuons on 8/6/2024 for the price of$6997.341.On august 21, 2024, i cancelled the order and again on August 23, 26,and 30th, I cancelled the order due to the fact that *** ****** decided without disclosing to me that he was having the unit delivered to his personal home address when he had told us that we could pick them up at his distributor. He had no way to load the 500lb unit in my truck and suddenly expected me to provide the way to load them.I told him that was not the plan and he had made that decision without consulting with me first. He offered to have his distributor pick them up and then we could as planned pick up at his dealership. On August 26, *** emailed me to let me know that his distributor REFUSED to load the units into our F350 truck stating insurance and safety reasons.Without a way to get the merchandise into our vehicle, there was absolutely no way to complete this purchase, and at this time I have filed a dispute with my bank card company for a credit. As of today *** hasnt even replied the their request for the credit to be issued.I am asking for help to make this right. I have filed a complaint with Generac as well as the state of Oregon Consumer Protection to keep this business from doing this to someone else

    Business Response

    Date: 10/11/2024

This particular client submitted a complaint with the ************* office - File Number 676910, The state of Oregon's AG, with you and with Generac ( I'm an authorize Generac Dealer) all within the 30 day notice I gave her to pick up her two Generators.  She had more than 60 days to pick up her product, but never made the attempt. .  Attached is the 36 pages of emails correspondence with this client

Long story short.  *** ***** bought 2 generators from my home base small business.  I agreed to have the generators picked up from my distributor, but her husbands truck was rejected because of safety reasons.  The pickup truck was not at the proper height for the loading dock and the company would not take liability of loading 500 lb generators into a pickup truck with a forklift.  I tried many ways to satisfy the customers problems, but she stop dealing in good faith and began taunting me with pictures of generators she bought from ****** and threats of reporting me to the BBB and everyone one else that would listen.  As you can see in the emails, she planned (and probably did) to take the generators out of the truck with an excavator and chains.  That said, this client knows nothing about safety and expects everyone to assume her risks (like Cosco).

This client also reported me to her credit card company and had **** put a hold on my checking funds preventing me to pay my payroll, while her Generators sat in my garage.  Being a ***** veteran owned business, a client with more time than sense has jeopardized me paying my workers because she doesn't want to pay a restocking fee of $250 dollars.  After speaking with the Wa. ********** i tried to end this complaint and work with the client to refund all of her money (less the 2.99% credit card charges), but she's intends to burn the house down.

What I would like to know is:  What are my options.  I've asked this person more than once to stop the correspondence and release the $12000 hold on my Account while I have her generators sent back to the supplier.  Is there any recourse my company can take without having to hire legal representation for a 3.5% restocking fee.
