      I hired Tindell & Co as a property management company for a home I was renting. While my house was empty and under their care from January to February 2024 one of their employees ran my water bill at $1327.67. Tindell insisted I had a water leak. I hired American Leak Detection at $250 on 3/19/2024 and they performed extensive testing. It was determined there were no leaks in my home. I spoke with my water company and they said the only way for that much water usage was if someone had left a water faucet continuously on for weeks. I asked Tindell to pay for my water bill since I was paying for their services which included managing the state of my home and the cost to have a leak detection company prove that there were no leaks. Tindell refused and said it was not their problem. My contract with them clearly states:U. To manage the Property in accordance with standards of reasonable care and diligence and to furnish the services of its organization 122 for the management and operation of the Property.Clearly this excessive water usage is gross negligence and lack of reasonable care and a violation of my contract.I am asking for reimbursement of the water bill I had to pay from their neglect and the cost to have a leak detection company come out and prove their negligence.

      In response to the complaint filed by ******* *******

      We understand the frustration and financial impact caused by receiving a large water bill after you moved out of your home and we assure you that we have no interest or incentive to enter your rental property and leave the water running while it is vacant. In January 2024 was a month of freezing temperatures and Ms. ********* home was vacant during this period.  After the winter freeze weekend the property manager assessed the home and noted that all plumbing visually appeared to be fine but he did determine  the master bathroom sink was not running. On January 23 the property manager created a work order for which service was provided to replace that faucet. 

      Our team was showing this property to prospective renters and on site at multiple occurrences to show the property.  At no time was an active leak identified nor were faucets left running. 

      In January 2024 this was a new rental property under our management at the time, and we were not familiar with the typical water usage or billing history for the property.  Property owner ******* ******* received all invoices for the water bill directly and Tindell & ** had no knowledge of anything out of the sorts until Ms. ******* notified us.  Once the property owner notified our office about the high water usage, we promptly requested a copy of the bill to assess the situation.  The invoice provided to us included service dates of December 16th through February 15th, 2024.  Tindell & ** took on management of this property on December 28th, 2024 at which time Ms. ******* was still moving out of the home and likely utilizing the water service.  At this time Ms. ******* did report to us that she did not want a For rent sign placed on the property as she feared vandalism from a prior occupant of the home.  Ms. ******* is requesting 100% reimbursement of a water bill for which there was a period of time that we did not even manage this property and for a matter out of our control and not created by Tindell & ** nor any of it's staff. 

      Our team took immediate action to troubleshoot the concern. We dispatched both maintenance personnel and the property manager to inspect the property.  At this time it was advised by Tindell & ** that the property owner dispatch American Leak Detection to assess and determine if there is a water leak we could then locate.  As reported American Leak Detection was not able to locate a leak but they did advise consulting with a plumber and installing a installing a Technician noted that the water pressure for the home is elevated (~ 110 psi) and no pressure reducing valve was located on the system. *** recommends consulting with a plumber to have a PRV installed on the system.  ******************* terminated management we are unaware if this action was ever taken on her property. 

      While we regret that Ms. ******* feels this situation could have been handled differently, we hope that all can understand that we rely on notifications of utility concerns to address such issues.  We have limited access to the property as we are only on site during showings.  As reported at no time during showings or upon any maintenance access was any water utilized beyond normal function and at no time were any faucets left running. 

      Furthermore the ******************* agreement that Ms. ******* included clearly states that Tindell & ** will assume no financial responsibility for the property nor any issues arising from the management of the property. 

      Thank you for bringing this to our attention. We hope this helps clarify the steps we took and our approach to managing this issue.

      I am rejecting this response because:

      I've included an image of the water bill that was sent to Tindell - note the usage of the entire month of Dec (while I occupied my home until 12/22) and then note the water usage Jan and Feb while my home was empty and under the care of Tindell. My renters have occupied the home for the past10 months with zero reports of excessive water bills. I would also like to note that I had a very unpleasant and contentious interaction with my assigned property manager ****** *********. I was informed on 2/19 that he was let go. He had full access to my home and as Tindell states was in my home several times during the months January and February.

      The only conclusion to my home consuming, while empty and while under the care of Tindell is gross negligence by a Tindell employee.

      Ms. ********* response indicates that ****** ********* was the only party to access the home but that detail is simply inaccurate.  In addition to ****** ******** accessing the home, so did our maintenance crews, other showing agents and prospective tenants.  At no time was the water left running by Tindell & ** or any of its affiliates.  Our agents are trained to identify issues in the property and promptly report them.  ****** ********* accessed the property on January 20th and reported a bathroom faucet was not working; he created a work order for that faucet to be repaired.  Maintenance staff accessed the property later that week to replace the faucet and at no time was the water running. 
      Immediately upon the notification from Ms. ******* on March 13th of the increased water bill, Tindell advised American Leak Detection be dispatched.  American leak detection was dispatched.  


      American Leak Detection noted the following; 
      On arrival, water services were on to the home
      and no meter movement was observed. Water
      was run at a hose bib to confirm the meter is
      functioning correctly. A static pressure test of
      the system found no pressure loss. Internal
      fixtures and toilets were inspected and tested,
      and no concerns were noted, though the
      downstairs bathroom toilet fill level was
      adjusted down slightly to prevent overfilling the
      tank. The fill valve / flapper system in the
      master bathroom appears to be relatively new;
      however, it is unclear whether this may have
      been a prior issue which has now been
      resolved.

      Technician noted that the water pressure for the
      home is elevated (~ 110 psi) and no pressure
      reducing valve was located on the system. ***
      recommends consulting with a plumber to have
      a PRV installed on the system.

      Tindell & ** was terminated by Ms. ******* at this time.  The last report we have from them regarding this matter was in March of 2024- we are now almost 1 year from the date of the water bill and Ms. ******* is making an attempt to collect a water bill with no proof that Tindell was negligent in any way. 


      Tindell & ** at no time left the water running for the property.  Ms. ******* has no evidence of this matter and there is nothing beyond her assumption to place blame on her management company.  American Leak Detection clearly states it could have been a running toilet.  It could have been a disgruntled past relationship that Ms. ******* disclosed and had concern for damage to the property as a result.  It could have been an error in billing from Ms. ********* water company.  There are numerous assumptions to what could have caused this but it in fact was not caused by Tindell & ** or any of its employees.  
      Furthermore the ******************* agreement clearly includes a hold harmless clause that the owner agrees to hold the agent harmless for invoices and other items that can occur or come up during management.

      I received an email 03/29/23 that they would be entering for an inspection on 04/04/23. After i asked several times, they said they were only **ming in to test for asbestos. Which was alarming. They cut a hole in my wall and left it like that for several weeks. Then they sent an email 04/10/23 saying plumbing would **me from 04/10/23 - 05/05/23. There was no explanation to what was going on. Plumbing came maybe about 3 times and created messes and left things unfinished till today 06/12/23. No one has **me to finish anything. At times only one plumber would **me in because they had no other guys to help so they had Tindell & cos maintenance team help out who are not trained professionals for this job. On 05/11/2023, they sent out a notice they would be shutting Water off from 8 am to 5 pm on 05/12/2023. On 05/12/2023 the water was shut off from 8 am to 10:30 pm. We were not aware of this water shut off. Tindell and ** failed to tell us what was going on. I work overnights so not having water all day, i was not able to use the bathroom, shower after work, drink water. Instead i had to go and buy bottled waters for my dog and i to have water. The only reason they told us why its taking this long is because several of ** have **mplaint about **mmunicating instead of leaving ** in the dark. Our living room and bedroom closet walls have been gutted. All my clothes and other closet items have been taking out my bedroom for the last several months and I cant sleep in it. I have had to sleep on the **uch. Theres also a strong mold stench **ming from both walls. The ripped out walls have left stains on my clothes theatre hard to remove. I work overnights and sleeping on the **uch during the day has effected my health in general and my mental health. Its worsen my bipolar depression since im not getting adequate sleep after taking my prescriptions. Theres drywall remains all over the apartment, holes, pipes and screws outside our doors.

      ************** was advised per written notice of all access and maintenance requirements along with a detailed explanation of the required plumbing work to his building.  ************** resides in a property that has recently had extensive plumbing leaks.  As a result the property owner elected to replace the plumbing and provide residents with a better quality of water and service.  This needed plumbing repair does come with some disturbance and access needs.  As a result ************** was offered a rent concession.  Asbestos testing is required prior to any renovation in the ***************.  Tindell & ** was performing proper due diligence in this obligation by testing for Asbestos.   Tindell & ** employees have performed no maintenance work at the ************************ trained employees of HM Tindell LLC which is a licensed and bonded construction company worked alongside the licensed plumber to perform all required work.  Plumbing inspections have been passed with the **************** 6.14.2023 and all walls are scheduled to be closed up at this time.  ************** is welcome to move out of this unit if he is unwilling to endure the disturbance as a result of the plumbing upgraded to his building.

      Repairs to my apartment unit March 4th 2023 my unit 120 flooded i have renters insurance i was put in a hotel by my insurance Tindell & Co offered to put me in unit 122 they informed me it was newly remoled they stated everything was all brand new that was not true there was only a few things new the hard wood floors, kitchen cabinets, bathroom toilet, bathroom sink, the blinds where cut uneven, now the base molding was coming loose, there was moth larva with worms in the kitchen pantry which were hatching moths all over the place, the shelves in there wasn't cleaned they just painted over them, basically that's what did in many times of coming to my unit , they have left my door unlocked on Thursday 05/12/23, Friday 05/12/23 on this day water starting coming from the light fixture running onto my dining table and bar stools type chairs, floor against the wall, Wednesday 05/18/23 on this day once again the door was left unlocked anyone else could have just opened it and walked in and took what ever they wanted, they leave my apartment a mess and i've asked them to please clean up after themselves they say yes and yet they still don't clean it or after themselves. It's been a struggle with them they keep saying they are doing me a favor i pay rent, then they raised the unit rent more than the rent would have been raised because they say the unit is newly renovated it was not, is was half done i have more pictures if needed, i just want the repairs done and done correctly, also shortly after i moved in they came in April 17th and tore down the walls and they have been like this every since.

      ************** unit became inhabitable as a result of a plumbing leak.  ************** was instructed to file a claim on her renter's insurance to provide alternate housing.  ************** previous unit would not be repairable in a timely manner as a result ************** was offered an opportunity to move into a newly updated unit or move out of the apartment completely.  The newly remodeled unit was a unit that had previous water damage from a busted water line in the attic.  All sheetrock, walls, ceilings, cabinets, flooring, was new.  The appliances were not new and at no time were new appliances offered to ***************  As a result of the plumbing issues in this building the property owner felt it best to replace all plumbing in the building.  As a result a plumber was hired to do the work and access notices have been submitted to the occupants.

      I am rejecting this response because:
      The pantry was not properly cleaned or primed there is a problem with moths, I sent photos and can send additional photos if I need to the only updated items in unit 122 was the floors, kitchen cabinets,  toilet,  bathroom sink, cabinet,  mirror,  everything else is falling apart and I've sent them pictures of the things that are not fixed, I was not prepared to jump up and move so being given the choice to move was not within a time frame for me, the bursting of the pipes caught me off guard.  All Tindell  & ** have to do is fix the issues that is wrong or reimburse me for paying someone for fixing them, it's not right having dirty shelves painted over or having a kitchen pantry full of white worms,larva eggs that turn into moths and ruined my cake boxes and cake rounds and bags of powdered sugar which costs me out of pocket around $200 at no fault of my own cause they didn't clean properly they painted over the filth,  the fridge was dirty, the oven was dirty, the window seals were dirty, I spent a lot of time paying a cleaning service to assist in cleaning,  unit 120 I made sure it was clean, base boards the gray siding is coming off , has gaps so as listed above that Is all that was updated, closet doors are not new, they fall off track, cracks on doors, I should have a place nice and clean like they do I should be reimbursed for my cake boxes/ rounds/powdered sugar, these walls have been down since April 17th and they just updated me today on the fact that it's going to take another 2 weeks I had to contact them because first email said it be done by May 30th, I just want the same respect and repairs done they would want this over is old and so is this fridge, the tub is old, they feel that new floors, kitchen cabinets,  bathroom cabinets,  sink, toilet,  mirror is updated I'm going to keep pushing cause it's wrong what their doing.  I'm educated I have several degrees I work very hard to pay my way in this world,  I'm tired of people looking at my skin color and making a decision about me, I let people see and know what I want them to know.   I don't destroy people property at all. Also their is a huge Crack in the patio foundation no one has even came and looked at that, Tindell  & ** states they did me a favor my rent gets paid that's not a favor.

      The most recent reply on the BBB's website is the first report made to the effect of a pest problem at the property for bugs of her description. We have continued pest control service provided at this building and all that is needed for service is for ************** to ask ad submit a written maintenance request. Furthermore- All of ************** maintenance requests submitted have been completed and closed.  ************** has not summitted a maintenance request for the items she identified in her last reply.  If ************** would like to submit a maintenance request, we would be happy to provide service for all issues.  We pride ourselves in treating all owners, tenants and consumers equally and fairly and we are appalled that ************** would indicate otherwise.   She has resided in three units in this building and we have had a long standing tenancy with her.   We value ************** tenancy and we will continue to treat her and all other residents equally, fairly and  with dignity & respect and we will respond to any and all written maintenance requests submitted.

      I am rejecting this response because:First I have not resided in 3 different units at Wellington Square,  I first looked into Wellington Square and was mislead into a unit that I did not apply to so I had to get *************** ****** who contacted the very first owner and informed him of the fact that the pictures that was used was misleading and therefore I was offered and moved into unit 120 I only spent about 2-3 weeks in unit 114 I have a witness that was with me when I was scheduled to move into unit 114 I believe it was dirty, not cleaned, carpet stained, cabinets stained, the fridge was stained, the bathroom wasn't cleaned I had my movers there and the unit was not cleaned,  *************************** had to call ******* Tindell and get the carpet cleaners out there, also get a cleaning agency out there cause they stated they depended on the tenants to clean the units clean so I had to move everything Into the kitchen for the carpet to get cleaned and I have several witnesses for that from in April 2019, also I have witnesses from when I moved into unit 120 about how that unit was and how I got into the unit.  Now Tindell and ** has not done anything to unit 122 since I've been in there I finally got the gut to put the walls back in I was tired of the black tarp and the bugs and I saw him and asked him to do my unit he told me my unit was 2-3 weeks out I told him no, I can't wait any longer so he started June 1st and finished June 10th and that's because I pressured him.  I've submitted several work orders but Tindell and ** says they've never received them, also their head maintenance guy called me I was at work accusing me of slander, stating I'm running around slandering Tindell and ** name when they did me a favor and I could've moved but instead I choose to stay to slander their name,  and he stated how I need ***** and to repent,  forgiveness and a few other words when he doesn't even know my religious beliefs or preferences,  he was on speaker so my coworker heard my call I put him on speaker so she could be a witness to the call.  I advised him it's not slander if it's the truth and the photos speaks the truth, Tindell and ** photo shops pictures to advertise units at ********** Square,  I can get several previous tenants who can attest to what I'm saying.  Also it seems like there are other issues that comes up with Tindell and ** that happens multiple times and I don't know why, the foundation on the patio is badly cracked,  the closet doors falls off the hinges, they just hired a new pest control agency,  ***** the head maintenance guy told me that about 2 weeks ago when he called me, because the first guy did not do anything when he came out but told me what to do.  I don't trust nothing they say, due to their actions I've spent April 2019 til March 2023 in unit 120 so no I haven't lived in 3 units I don't consider being in a unit fir 2-3 weeks a full term and being in 122 and not quite 6 months in 122 yet , Tindell and ** seems to think they are doing me.a favor I keep being told that and I have emails to prove it I will send the emails, I pay Rent that is not a Favor they don't want to except responsibility for what happened,  I was okay in unit 120, ********** Square has 10 available units they have a high turn over I know several tenants right now who is very unhappy with Tindell and **,  I'm still fighting bugs, and other issues,  they have not tried to replace things that I've lost, my cake boxes, my cake gold cake round, 10 pounds of powder sugar, my baking supplies that Is part of my baking business,  I almost lost money on ***** cake orders I took for Mother's Day as you can see I have a business I had to throw out all the boxes and rounds and buy new ones they have not even offered to make good with me, I'm not excepting there response it's not true nor factually,  I have pictures to prove my statements and the light fixture in the dinning area water came out don't know if it works,  but they prefer to blame me and bring God into this at ***** the maintenance guy does maybe he should see what a tenant religious preference is first.  They seem to be focused on the kitchen cabinets,  the hardwood floors throughout the unit, the bathroom sink and mirror that is all that was updated in that unit and it had water damaged and they would've had to fix it to rent it out anyway so why do they think they did m a favor and my renters insurance covered my hotel, Tindell and ** offered $33 a night they rushed cause they didn't want to lose money so they did it for their benefit and blaming it mine benefit I would've waited.

      ************** has a signed leased agreement that outlines the terms and conditions of her rental.  She accepted the property and has been residing in the property.  In the event she submits a maintenance request it is addressed and outstanding items are repaired.  Per her lease agreement she is not *********** compensation if the unit is not satisfactory to her. 

       

      ************** has reported that she is conducting a business in the unit and that is a direct violation of hear lease.  She is not permitted to run a business out of her property.

      March 3rd 2023 my unit 120 flooded I was offered to move into unit 122 which I moved into not realizing there were a lot of unfinished areas in the unit, also not knowing that there was water damage in the unit or that there was a huge Crack in the patio foundation, there was problems with the base moldings coming loose in the bathroom, kitchen, livingroom, bedroom closet doors coming off the tracks, a bug problems, the pantry shelves were greasy and had bugs, water came through the dining room light fixture, the spare bedroom closet has a board missing were the itching kind of Insulation is coming out, a lot of the light fixtures are brown and very used, the bathtub drain was plugged and had this black greasy stuff coming out of it, and none of it has been fixed, I have pictures to support my statements. Now they put hardwoods floors in this unit, kitchen cabinets appear to be new, bathroom sink seems to be new, the bathroom mirror is new that is all that is all that has been updated in this unit, the shower head is updated as well. I had to use many of my nice towels In unit *************************************************************************************** a hotel that my renters insurance covered.

      Here are additional details and photos of issues in the unit, tenant wasn't aware of the water damage to this unit,  tenant is not running a business out of the unit, Tindell and ** has made it difficult for tenant to send correspondence via email,  they are requesting a copy of tenant renters insurance which tenant has but they claim has expired,  tenant renters insurance is good through 2024.

      I realize that the BBB can't make Tindell and ** fix the issues but to close the case when they haven't been forward about this matter they have not tried to resolve any of the issues,  they have blocked all communication via email addresses,  yet they seem to think my renters insurance is expired and it is not true,  they state I'm running a business from my unit which is not true, I've listed an agency to assist me as well I'm hoping they can help me as well as the BBB, Tindell and ** has a huge turnover at Wellington Square and many unhappy tenants,  they don't treat me like the other tenants,  they say they will be doing work on the landscaping and the front of my unit never gets cleaned,  trimmed or cleared up and there are raccoons,  possum running not to mention homeless people who can hide in or around the trees and bushes,  I maintain the patio, but the fence between my patio and two other tenants seem to keep being opened,  that makes me feel uncomfortable,  two days ago I left for work the fence was closed I returned the fence was opened that concerns me that allows for others to enter onto my patio and have access to break into my unit and they have not addressed that issue and this complaint is being closed which I understand because they will not fix or address the matter in a professional manner anytime a company blocks a tenant from emailing them which is a mode of communication is unprofessional and I'll have no choice but to use other agencies to assist me in resolving these issues.
