    The contractor (*****************************) built deck railing for us which has since split and cracked. He refuses to communicate and replace the defective materials. He told us he couldnt afford to replace it. We are senior citizens who paid him in good faith and he refuses to fix his defective work. We have reported him to Home Advisor and we are pursuing litigation. We just want him to deliver what he promised; but he refuses.

    *** asked me to build him a cable railing system for his 2 decks that had recently been finished.  Being in business for only a few months at that point I was only giving estimates for work, not quotes. But *** talked me into locking down a price against my better judgement.  In so doing I did all of the labor for his deck for Free and paid my wife a couple hundred dollars to help me (more than $3000 in labor). In keeping with the budget I chooose a prefabricated wood post that is treated and rated for exterior use on railing systems.  They were all stained and sealed properly with Cabot stain and sealer. But after a winter in an extremely wet environment the posts are weathering.  They are not structurally compromised, my hardware is not falling out and the cable system have not failed. I went over to ***'s not too long ago and we discussed all of these facts and even came up with a solution of using apoxy to fill the cracks.  But days later, after purchasing the very expensive apoxy, he said instead he wants me to tear apart the $2500 worth of work and start over, and pay for it all myself. That doesn't seem right to me. I was not adequately paid the first time but I completed our contract and did so with appropriate materials to the best of my ability and thier initial satisfaction.  There are some railings that lifted a bit that I offered to take care of for free and I offered to split the cost and lower my rate to $25 an hour. I asked him for details on how many posts he wanted repaired but he says I'm being unreasonable.  Now it seems like they want me to come back and do never ending Free maintenance.
