    On 9/24/24, ******* ******** came out to do work for us on the property. He was instructed to do general yard maintenance, and when he was using his riding lawnmower towards the back side of our home, a rock was thrown into our window and shattered it. This was a 42" by 76" window, that cost us nearly 2 grand to purchase. And cost 1900 to replace. We spoke with ******* and advised him that we needed a resolution, and have text message proof of him acknowledging fault for the window. We offered him the option to work off the cost, and even tried to give him time to resolve the issue. Instead, he ignored out communication several times, told us he would pay only to give us nothing, and still has refused to get insurance involved. (He claimed he had insurance, but has not yet shown us proof of this.) His latest message to us, which again I can provide, advised us that we should 'do what we have to do' in regards to taking the issue to small claims court. We still have no compensation for the window broken, no resolution, and a refusal on his end to facilitate a way forward.

    I cannot say that it was done by me I do know that I was shown a broken window on the back side of there house and yes it was after I had mowed in the back they did not say anything about working the cost of the window off but I did tell them that I would pay for part of the window and I will I just dont have a lot of cash right now being it is the slow time of year o Im not exactly sure on how to proceed from here being that I am not 100 percent sure that It happened from anything that I did

    I am rejecting this response because:

    This is not an appropriate handling on the businesses part nor does it appear they even want to make an effort to resolve the issue to begin with. Weve requested insurance information from them at the least to ensure this situation is managed and they refuse. 

    as far as refuting that they are unsure if they caused the damage- 

     

    the damage to the window occurred on the same day and approximately one and a half hours before the text message seen in the screenshot provided where fault is admitted. The riding lawn mower the business was utilizing kicked up debris that hit the window and caused the damage scene in the photo. Not only did the business admit fault via apology but the damage is verified and confirmed based on photo and video evidence provided that match the date and time window necessary. 

    The business needs to either provide insurance information for a claim or they need to provide appropriate payment options accordingly.
