    April 24, 2022 I signed a Retainer Agreement and paid *********** $8000.00 for custody evaluation. The custody evaluation was completed on or around December 9, 2022. On January 31, 2023 I contacted ************ by email requesting a document used in the evaluation. February 1, 2023 in an email ************ told me my attorney has the document and if I wanted a copy from ************ I would have to get a subpoena and pay him an additional $125.00 per volume. I am also understanding from this email response that my attorney had copies of everything submitted by ***********. On February 1, 2023 I contacted my attorney (*********************) paralegal ************************* requesting this letter from his office. February 6, 2023 I received an email ****** looked through my file and cannot locate this letter. At this time she has now included ***** regarding my request. My understanding is my attorney was to receive all information used by ************ in this case. Without your assistance, I will have to go to the Courts get a subpoena and pay $125 for the file I have paid $8000.00 to ***********. I had to get my attorney involved which likely will cost me between $500-700 in additional charges. I would like the Better Business Bureau to get me my copies of three letters I have now requested from my attorney versus the original letter. I have paid ************ for services provided, ************ said my attorney has the letters he does not. I do not feel I should have to pay ************ an additional fee for a job he didnt complete by providing all documentation to my attorney as he said. I do not feel I should have to pay the attorney fees which had to be incurred because of ************** lack of completing the job.     Complainant is a party in a legal matter and he is represented by an attorney. The case is presently awaiting further litigation and requires a court order to be released. These matters are not at the discretion of me or my office but a matter ensconced in law. My only recourse is to refer the complainant to the process at hand.

    I am rejecting this response because:  I still want these three Collateral Witness letters.  Enclosed is documentation which states ************ has completed his report, which has been done since the first part of December 2022, The Court Document says the information can be requested by either party and released.  See Highlighted areas in attached documents.  

     

    These three letters I am continuing to request again I do not have a copy of, my attorney does not have either.  ************ is violating his own contract and/or rules.  Highlighted says ************ would not use any documents unless he could verify they have been shared with the other party.  ************ needs to show me where, when and how these were shared with either myself or my attorney.

    This issue is in active litigation. This issue is before a judge. The respondent is an expert afforded quasi judicial immunity. **************** needs to follow the courts procedure and work with his attorney. There can be no action on the part of the respondent that circumvents the legal process. The record is not the property of the respondent, the record is the courts jurisdiction. I am not sure how more clear to make this. **************** has an attorney and he needs to work with this attorney and use the judicial process. The respondent has no problem releasing any part of the file that is subpoenaed as is required for court documents. The BBB has no jurisdiction over ****** Courts and ****** legal processes.
