      to me

I built a back porch roof over a pre existing deck for these customers back in June/ first couple days of July in 2022. Due to fluctuating costs of materials per COVID-19 at a time these customers elected to have the porch built out of treated lumber opposed to Whitewood this decision saved them over $5000 in material costs.  once I built the porch and started installing the soffit the lady expressed her disapproval of how she didn’t like the way it looked after I was 3/4 of the way done which is originally how we talked about doing it, which was no big deal. I took it all down and redid it a different way to make the customer happy. Upon completion of the job, I gave them the final invoice, including labor to tear all the soffit down she disapproved up and reinstalling it in a different way than what was originally discussed. She refused to pay me and essentially I ate the cost of doing it. Fast forward two years, the treated lumber shrunk and dried warping the aluminum coil stock. the customer reached out stating he wanted it done. I told him no problem. I have a busy schedule. I’ll get to it as soon as I could on a weekend. Since then he had sent me two prices he had gotten to redo the coil stock. I had reassured him once again I’d be able to do it but it became apparent when I spoke with him over the phone that He wanted it done for free. the lumber shrinking causing the coil stock to move and crinkle isn’t my doing the customer is knowledgeable about treated lumber and knew at the time it was built that it would eventually dry and shrink a little bit. I can’t go buy the material and do the work for free. They elected to have it built out of that material and knowing what could happen to save money, fast forward a few years it did exactly what they were informed it would. there was no warranty for the coil stock being wrapped over top of treated lumber stating I’d come back years later and redo it for free!  Now they want me to spend my money on material to go fix it for free which isn’t fair for me. I already didn’t get paid for redoing the soffit. I would be more happy to go and do it for them. but I cannot do it for free.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

We were never given the choice what wood to use.  He chose the wood type and he stated that whitewood is more expensive but in fact pressure treated lumber cost more.   For example:  2x6x16 whitewood board cost $11.45 and a 2x6x16 pressure treated board cost $16.18.  These prices came off of Lowe’s website 6/20/2024.  Also, it never stated in the proposal what type of wood he would be using either.
When he started the soffit and was doing long runs that were overlapping and leaving large gaps where they were meeting. I stated my dislike of it and he stated that there wasn’t anything that he could do and suggested that we put wood and it would cost us more money.  When he left that day, the soffit wasn’t even half way done.  That night we did some research and found out that for long runs you should use j-channels.  We also called the manufacturer of the soffit and that is what they also suggested.   The manufacture stated that anything over 10 ft requires j-channels.  That night we sent him a picture to see if he could do it that way with the j-channels.  The next morning, he agreed to redo the soffit the way we wanted but never stated that it would cost us any more money.  We even agreed to go get the new soffit and pay for replacement soffit out of our pocket.  He then gave us an attitude and started tearing down the soffit that damaged our deck and wood swing taking big nicks out of both.
I never refused to pay him any money.  He came in with this crazy amount for the rework that wasn’t ever half way through.  When I stated that I didn’t think we should pay because I didn’t like it from the beginning he agreed that we didn’t have to pay for the rework.
On May 11, 2023 I noticed that the flashing was all buckled and I sent him a photo and ask why this was doing this and he stated that it was from “Heat, expansion n contraction of aluminum, I’ll redo it for you” He never reached out I just figured he was busy.
July 24, 2023 we reach out again an ask him if there was a warranty on the aluminum and now the nails are rusting and he stated that he would come and redo for free.  He also stated that he used white ring shank 1 5/8 nails and that he will replace with aluminum that will not corrode.  He also stated that it isn’t our fault that lumber dries and he will make it right.
      Never heard from him.
February 23, 2024 We reach out again and ask him if he wants to repair the coil stock and he stated that yes he will replace it and that he will call later.
We reach out several more times.
On May 4, 2024 he stated that he would be out the next day being May 5th he cancelled because of the weather.
We never heard from him again so that is why we filed a claim.

To assist us in bringing this matter to a close, we would like to know your view on the matter.]

we can't compare current lumber prices from June of 2024 to what they were in 2022! the pandemic caused lumber prices to skyrocket, and whitewood, was more than double the cost of treated at the time. I'm also curious as to how if I left that day with less than half of the work done as stated, outside of normal business hours, were the customers able to reach the manufacturer to ask them about using j channel, they didn't want seams in the soffit, therefore using j and dividing it into sections was not what was originally discussed! as to me damaging their property, i never ripped anything down or damaged their deck, nor a swing, i never even seen a swing while i was there working, i doubled up a few of the rafters and disclosed where one could be hung because the cx talked about hanging one up, she was excited, as any homeowner getting a porch built would be, but most definitely never seen, touched let alone damaged a swing. as far as the additional labor, yea she refused to pay me and got angry when I stated I wanted extra money for extra labor that wasn't originally part of our agreement, but it was easier to just let it be and accept my loss so I could just leave instead of arguing over a few hundred dollars. in conclusion,  if I had told the lady id would fix it for free a while ago even if I don't have the messages or recall saying it, if I said it, I will stand by it, however, I will only go there on a weekend or a holiday when I have availability in the very near future, and I will not do anything other than removed the wrinkled stock, replace it with new, clean up my mess, and leave, no further action will be in place ! not sure if you guys need a date or if you'd want me to call the customer and schedule something?
