    Contracted with this company to provide landscaping around our patio - paid $2,941.00 for him to provide plant beds, mulching, metal edges and plants plus one tree (as outlined in contract), which were not planted until the end of October 2021. Tree is the issue. Was supposed to be a 5-6 ft. tree that would grow to be "the cornerstone" of his design for this area (his words). Charged us $430 for the tree. What was planted was a scrawny, sickly looking tree that as time went by, never did anything in terms of growth or looking like it had actually taken root (so to speak). And yes - we followed his directions about watering the tree, etc. We kept hoping as the seasons passed that it would thrive but it just "sat there" not growing, and our new landscaper told us early this year it was "dead". I contacted ***** twice a few months ago - no response. My husband (****) texted him and got a **** response "1 year guarantee on tree". Even sent him a photo of the dead tree. As an aside, he also planted some other small plants in the same area and despite us telling him that we had deer that frequented out backyard, he put in plants that half of them got eaten and/or pulled out of the ground (or maybe they were just not planted deep enough) within 5 weeks of planting date. After much haggling, someone in his crew came back and replanted the ones that were left, but most had died. We got totally ripped off by this business. The choice of plants (and for purposes of this complaint, the tree), were not done in a reasonable and workmanlike manner. He planted a tree that never grew, but was supposed to be a focal point, and obviously does not care or stand by his landscaping work. We want a new tree planted - one that is healthy and will actually grow, like many other trees we have had planted on our property over the years and have grown to huge heights.

    I clearly stated in the contract, estimate, and invoice that the plant material has a guarantee for 1 year. This client contacted me for the first time in May 2023, which was 7 months past the 1 year warranty. I have contacted this client and I WILL replace this tree for her despite that she thinks that rules don't apply to her, as clearly stated in the contract.

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.  However, his explanation that we don’t think the rules apply to us is untenable. The 1year warranty has a condition precedent that the tree was not a “dud” that never grew. But - moving on - he said he’s replacing the tree and that’s what we asked for.
