    On March 30 of this year, I went to the the office and signed the form to have my records faxed to another dermatologist's office since the LV one was not accepting my ins. any more. A week later I called the new office and was told that my records have not been faxed. I called LV office on 4/20 and 4/25 and was promised that my records would be faxed. I was out of the country for several weeks, returned home several days before my appt. at the new dermatologist's and went to that appt. on 6/13/2023. I was told that they never received my medical records from LV Dermatology. It is frustrating at the lack of such service and the lack of communication. I need my records to be faxed to **. ****** Dermatology, fax: ************ or ************. I was promised on 4/25/2023 when I spoke to someone named ******* that all my records would be faxed before I had my next appt. at the new office. Unfortunately this was not done and the new office needs my records to continue giving my appropriate medical service and advice.

    Dear *** *******, 
    Our firm represents Lehigh Valley Dermatology, and this correspondence is in response to your letter dated June 21, 2023. The allegations of ********* **** (hereinafter the "Complainant") set forth against our client in such correspondence are strictly denied. 
    In April of 2023, Lehigh Valley Dermatology sent the records to the Complainant's new provider, *** ****'s Dermatology (hereinafter "*** ****'s), on three (3) separate occasions. *** ****'s has since confirmed that it received the records on April 25, 2023. 
    More specifically, Complainant submitted a record request to our client with a date of March 30, 2023. On April 7, 2023, in accordance with the request, the records were faxed to *** ****'s via Lehigh Valley Dermatology's electronic medical records system using the fax number provided by Complainant on the record request form. See enclosed a copy of the record request submitted by Complainant, in addition to the cover letter sent with the records that is dated April 7, 2023, and confirmation that the records faxed by Lehigh Valley Dermatology to *** ****'s on April 7, 2023, were "successfully delivered". 
    On April 20, 2023, Complainant reported that the records had not been received by *** ****'s and Lehigh Valley Dermatology re-sent the records that same day. As reflected on the attached transmission form, the status of the transmission from April 20, 2023 is listed as "processing", which, in the experience of our client, "processing" indicates an issue with the receiving fax. Also enclosed is a copy of the cover letter sent with the records that is dated April 20, 2023. 

    On April 25, 2023, Complainant again reported that the records had not been received by *** ****'s. On April 25, 2023, the records were faxed to *** ****'s for a third time using an alternative fax number provided by Complainant. Enclosed with this correspondence is documentation provided by *** ****'s that confirms its receipt of the records on April 25, 2023. 
    Not only did our client promptly respond to the Complainant's record request, but it sent the records three (3) times. Further, the records were sent well within the 30 day period that healthcare providers have to respond to such requests under federal and state law. See 45 CFR 164.524; 42 Pa. C.S.A. §6152. 
    As there is no merit to the complaint, it is requested that the complaint filed against Lehigh Valley Dermatology and this response not be disclosed publicly as the complaint includes potentially defamatory statements that is damaging to our client's reputation.
