    This company tresspassed on my property and damaged my tree. The owner, *********************, refuses to give me his insurance information.

    The tree in question is a multi-lead silver Maple tree. The tree is approximately 75 years old, and the height is estimated around 110 feet. *********************** who resides at ********************************************** is our client. The Maple tree sits in between her property and *************************. The resident at ************************* is the complainant named *************************.  Our client was concerned about dead branches hanging over her driveway. Recently, a large branch has struck the clients car causing significant damage.

    On Tuesday, June 20,2023, I evaluated the silver maple tree and determined that a significant amount of dead was hanging over the clients driveway. As a Pennsylvania Certified Arborist (# ********), I was able to determine that the branches were completely dead and needed to be removed as soon as possible. If the branches were to fail, they could cause serious bodily harm or death.

    The work was performed using the clients driveway. No vehicles, equipment or employees were on the property of the complainant other than one employee knocking up on the front door and asking if she could move her car, which sat directly underneath the tree on her property. She refused; however, we were still able to remove the dead branches without causing any damage to the properties. It should be noted that when the complainant speaks about the damages to her property, she is specifically talking about damage to the tree branches that were removed. She acknowledges that no damage was done to her home, lawn, vehicles, etc. The complainant did call the police while the tree was being trimmed. They responded and advised that in Pennsylvania law, we have the right to trim a tree that hangs over the property line.
    Not being satisfied with the police departments decision, she then contacted ********* Township Codes Department. They responded and confirmed that the branches in question were growing on the customers property, and the customer had the right to remove them.

    In the State of Pennsylvania, homeowners have the right to trim a tree that extends onto their property. We removed the two dead branches in accordance with the law. Attached,you will find two pictures of the tree before the two branches were removed and a picture of the tree after the two branches were removed. You will notice in the first picture that the branches in question are clearly growing over the customers driveway at *************************** Morton PA *******. In addition, you will be able to see that the branches are dead and do not have any leaves. It is my opinion that due to the ongoing battle between these two neighbors, we were unfortunately brought into the middle of it by *************************. According to the neighbors this ongoing battle has been escalating for 10+ years.

    I am rejecting this response because:
    ********************* did nothing but deny any wrong doing. I was able to get his insurance information from the township but no resolution has come as of yet. I am including pictures of the tree before and after, you can see how the tree was topped, the top was not hanging over the neighbors side and now the tree is damaged because of his negligence. It is unethical to top a tree, as a certified tree arbonist he had to have known this. The township also told me that he did not apply for the proper permits, which I have in an email. I want ********************* to fix what he damaged.

    The complainant is uneducated in understanding how to treat or trim a tree. She is upset that there has been no resolution with my insurance company, Springfield Township, or her neighbor. ************************* clearly does not know the difference between removing 3 hazardous dead branches above a neighbors driveway versus topping a tree.

    I would strongly encourage BBB to contact the witnesses that were provided in the previous report. They include my client, the local police department, and local codes department. They agreed with my assessment and permitted the dead branches to be removed. I would also encourage the BBB to reach out to *********** Township Tree Commission director who is familiar with the incident and confirmed the trimming was done correctly. Furthermore, the complainant has not been able to confirm that she even owns the tree, as it sits on the property line. To this date, she has not been able to provide a land survey.

    I want to make it clear that the tree was never topped and that only dead hazardous branches were removed. This is evident in the pictures attached in the last response.

    I believe that her complaint is an act of retaliation to her neighbor in an attempt to deter any future arborist from trimming this tree. Even though the statements from the complainant are ludicrous and lack evidence, MG Tree will offer to fertilize the tree by injecting nutrients into the root system. This will help the tree to continue to flourish as it has been doing since removing the dead hazardous branches over the clients driveway.

    This is from a certified arbonist saying that the tree is topped. He states that what ********************* did was improper and not an accepted practice. He could not believe a certified arbonist would do this to a tree.

    I am rejecting this response because: The nutrients will not help the tree.  The damage is already done. ********************* is not admitting fault. I have attached a statement from a true certified arbonist which states that the tree was topped. I am told that the tree will fail and most likely land on the neighbors property and cause damage or worse, death. The tree is clearly on my property. I am worried about the safety of my neighbors and my home.

    I am rejecting ******************* response. ************************* continues to lie about the work that was done to the tree on the property line. She is furious that my insurance company, the township, the police department, and the local tree commission all dismissed her false accusations.  

    The attached statement/report that ******* provided is a paragraph copied directly out of the **** **** handbook, not from a certified arborist that she claims she spoke to. If she did in fact have another certified arborist evaluate the tree, I request that she provides the report in full, not a screen shot, along with their certified arborist certification number. 

    The fact that ******* and her supposed arborist contact are suggesting that fertilization will not benefit a tree serves as a clear indication of her lack of education on the matter.

    In addition, ******* contradicts herself when she stated that she was concerned for her neighbors safety. Her neighbor along with several other residents have a very tumultuous relationship with *************************. As I mention before ******* and the neighbor have been in an ongoing battle for over 10 years. ************************* has never been concerned for her neighbors safety. If she was then she would have been content with MG Tree removing the dead hazardous branches above the driveway.

    I am rejecting this response because:

    ********************* continues to lie about the facts. My relationships have nothing to do with his terrible tree work. He tresspassed on my property and damaged my tree. Multiply Certified Tree Arbonists have come to look at the tree, they could not believe that any certified tree arbonist would do what he did to my tree. After they ask who did this terrible, unethical work and I reply MG TREE, they actually tell me that they are not surprised and that **** has a terrible reputation. On the contrary, ********************* is the one that actually doesn't care about my neighbor. The tree is damaged and could fall and potential hurt or kill someone. **** is just mad because he is known to bully anyone that calls him out on his actions. Multiple residents have told me how he refused to give his insurance information when he caused damage to their property. Any reputable business owner would not do that. I went right to ********************* after the damage was done, actually **** was on vacation and I  told his secretary to let him enjoy his vacation and just get in contact with me upon his return on Monday. Monday came *** went with no return contact. When I called his office I was told that he was asked multiple times to call me, I asked for his cell number. When I called ************* actually laughed and told me that he was never going to call me and wished me good luck getting any insurance information from him or the township. The township did the right thing and gave me his information. The township even agrees that **** handled the whole situation wrong. Please call the Township Manager, ***********************, and he will confirm. **** seems very upset from my certified arbonist's statement, I will provide BBB with the entire report but based on ****'s bullying techniques I don't want to put that person in any danger.

    I reject ******************* response. MG Tree did not trespass on her property, nor did we damage the tree. The tree does not belong to *************************. The township did request that she get an official land survey to identify her property lines, and ************************* refused to do so. ******* did contact a certified arborist to have the tree evaluated. The arborist personally reached out to me and advised that her accusations were false. When the arborist attempted to explain that her accusations were false, ******* became irate.

    The statement from ******* that "the township agreed that MG Tree handled the situation wrong" is a lie. I encourage the BBB to contact *********************** to confirm that ******* has fabricated this statement. It should be noted that MG Tree did hire counsel, and the law firm is currently taking action against **************************

    I am rejecting this response because: Lies,Lies,Lies ...... You can clearly see his bullying techniques.  Read his reviews online, he recently had another unsatisfied customer who said that **** needs anger management classes. Just post all of this on the BBB website so others can be warned.
