I contracted with ************************************* of SDP Mulch and Mowing to remove existing shrubs from flower beds and plant new ones. On Monday, June 26, 2023, while attempting to remove an existing shrub in the back of my house, he damaged my large casement window. He said that he had liability insurance and assured me that he would make things right. I called our regular contractor out to inspect the window and was told that the window had to be replaced, because it was all one big window and the integrity of the window was compromised due to the damage. I obtained an estimate for the same type of window and forwarded it to ************************. The estimate was for $3900. On July 24, 2023, **************************** response was "Sorry, I cannot help you. I thought that I might be able to repair it." He stated that he did not wish to use his insurance as his rates would go up.I have not heard from him since.

When I first informed **************** about the damage to the window, he said it's not a big deal and he did not want to get my insurance company involved. He said he totally understood that accidents happen. He subsequently had a window installer take a look at it and they allegedly said the window was structurally compromised and had to be replaced. He told me it would cost $3900 to replace the window. I told him I know someone who could fix the window for $500 and you would not be able to tell it was ever damaged. I can attest to this contractor's skills as I have seen them firsthand. **************** failed to mention that he met with the contractor I recommended. **************** claimed that my contractor said the window would probably eventually fail even after he fixed it, but that was an outright lie. My contractor said he would not have any issues with the repairs. I was willing to pay to have the window fixed, but **************** feels he is entitled to a new window. The damage to the window is minor and will in now way effect the performance of the window. If you get in an accident and dent your car's fender, do you replace then entire car? You fix it, which is what I was willing to do to ******************** window, but that was not good enough for him.

********************* damaged the window.  He doesn't get to choose how or who fixes my window.  My contractor who I always use said the window could not be pefmanently repaired.  A new window was needed. The argon gas between the double paned glass may have also leaked out causing condensation this winter.  The contractor ********************* had come over and I allowed out of courtesy is his friend and never said he could fix the window for 500$. He said the estimate for a new window was fair.  *********************** said he had insurance but didn't want to use it because he was afraid his rates would go up.  ********************* doesn't get to determine who I use to fix my large casement window.  Note I evev paid ********************* for his landscaping work with a $100 bonus figuring he would use his insurance so I could get my window fixed with my contractor
