    Hired Earth Restorations (**********) to install ***** septic system with auxiliary connections to a summer kitchen and garage/shop. Auxiliary connections were made but **** could not finish the job so he passed it off to another company. The other company found mistakes and it cost extra money to fix those mistakes. **** and Earth Restorations would not acknowledge the mistakes nor refund money spent. For example, I now have two 4" holes in my garage floor because the pipe was graded uphill and in the wrong direction.********operates Earth Restorations LLC but lists the LLC under his wife's name so he can't be held liable. He lives at the same address as the LLC and uses an Earth Restorations email tag. He changed the company website and eliminated his work/pictures with septic systems. When confronted, **** says Earth Restorations is out of business but they are still listed as active and are operating. I have voiced complaints on such sites like "***********.com" and he has gotten them removed. I would like a refund for the initial money spent and the extra costs incurred to fix his mistakes. This incident has been well documented with pictures, invoices, and statements from the company that eventually fixed the problem.

    To whom it may concern,

    The complaint filed by ***************************** is completely false and it comes from racial anger and the fact that the project became more costly because Earth restorations wouldn't engage in illegal business activities.

    Earth Restorations installed a septic system for ******* during the summer of 2021. At completion, the work that was done & inspected by a licensed engineer / health inspector. ******* paid Earth Restorations for the work and was satisfied with our services . ***************** later requested a quote to do other projects including illegally connecting the septic to an unauthorized future bathroom in his barn. In addition, ******* asked if we can illegally install a paved driveway which violated the conservation districts mandatory Stormwater rules.

    Once we declined to have Earth Restorations engage in illegal activities, ******* became upset and insisted to talk with the owner of the company who is a female ***** American. Durning a phone call with the owner, ******* shouted racial profanity to the owner and demanded that she go back to her country. Soon after the disturbing phone call, he hired several other contractors to work on his property and tried to blame Earth Restorations for his additional expenses due to permitting & engineering.

    The owner of the company is currently in **** due to a family emergency and performing volunteer work at a childrens hospital. Although communication with the owner has been limited due to the distance and her schedule, she did mention the possibility of legal action against ***************** upon her return back to the United States if the harassment continues.

    This complaint is unfortunate because Earth Restorations strives in customer satisfaction. We've proven to be a good business and created a good environment for our employees and a great experience for our customers. Unfortunately, we cannot make everyone happy when they have alternative motives.

    I am rejecting this response because:

    There was no mention of race in any of our communications and **** can't prove it.  He represents himself as the owner of the company and makes all the decisions for the company, and uses his own name in a company email address.  He uses his wife's name on the LLC so he can't be sued.  His wife was never on site, and was never involved in any communication whatsoever during the construction process.  It was only when he was taken to court, he denied responsibility.

    1.  The driveway was not illegal and approved by the township.  

    2.  Connecting additional bathrooms to an existing septic system is also not illegal, and was also approved for permits and by the town.

    3. **** passed off the work to another company who found his mistakes, not me as the homeowner.  I have emails to prove so.

    4.  When the LLC was taken to court he lied to the constable and stated the company was out of business, even though they are still obviously operating.

    5.  This business should be investigated for fraud and theft.  Anyone using this business should be warned and proceed with caution.  There are plenty of other honest business that will stand by their work, this is not one.

    ***** Septic System design work performed by ************************* (ACA)12/23/21 *** emailed quote/bid from Earth Restorations, LLC for $33,688 (Email 1, 2) Spring 22 I requested updated bid from ER, rep John D************ (JD) 5/10/22 Received updated quote from ER/JD of $36,248 (Email 3) 5/30/22 My boyfriend and I met with JD at project site; had lengthy and detailed conversation about specs of septic design and work to be performed as we walked property 5/30/22 Informed JD in person that we agreed to his updated quote/bid; JD requested a deposit for confirmation of agreement of $1k 6/3/22 Deposit of $1k mailed (Email 4)6/16 and 6/17/22 JD confirmed receipt of deposit (Email 5, 6, 7)6/20/22 Emailed JD re another quote we req when on site 5/30 (Email 8)7/21/22 Received vm from Jerry at ER stating the scarifying inspection would be the next afternoon (*****@earthrestorations.com, phone ************) (Email 9) 7/22/22 Received vm from Jerry at ER stating inspection was postponed due to tech diff, and would contact soon with new date for inspection (Email 10) 7/22/22 to 8/16/22 I called both JD and Jerry to understand the tech diff and when is new date; no response until 8/16 after I left another vm for JD 8/16/22 Recd a text from JD asking if we could chat next day 8/17/22 I missed the call from JD and called back after work and left vm 8/20/22 Recd email from JD stating he made an error and agreed upon price is now be double (Email 11) 8/22/22 I sent email to JD stating my confusion/concern and req for exact number due to his "error" (Email 12) 8/22/22 JD replied (Email 13) and sent updated quote of $69,884 (Email 14) 8/23/22 I asked that he absorb the cost diff (Email 15) and contacted *** 8/24/22 JD said no but offered $5k deduction (Email 16) 8/25/22 JD req for call (Email 17) 8/27/22 Call with JD, req more time to do right by the agreement; I req response by 8/31 8/29/22 Email JD with option for subcontractor (Email 18) 8/31/22 JD email for $58,175 (Email 19)

    Good morning *******,

    Thank you for sharing this but its unfortunate that *********************** didn't attach all correspondence or mention our phone conversations in her complaint. 

    Perhaps I did make a mistake when estimating her project . Therefore, in good faith, I deducted the $5,000 mistake from the revised estimate. In addition, the document I sent her was an estimate and not a contract. 

    The company I work for did not start any work, did not take her money, and didn't make any promises but we provided an estimate. 

     Inflation is out of my control with rising construction materials, labor, and logistics .

    However, the revised estimate covered my mistake and was approved by the owner of the company but there was no acknowledgement by the homeowner.  The letter explaining the above is not attached in her complaint. 

    In addition to our increased estimate, other contractors that re-visited her project recently did an increase in their estimates also which again isn't mentioned in her complaint. Unfortunately, the global inflation is affecting everyone worldwide and I hope there's better days ahead of us.
