I bought a 2011 ******* MKS Ecoboost from Spitzers lower 40 lot on July 14 2023. Since then I have had 6 turbocharger failures. I have had to drop thousands of dollars into the vehicle and have reached out to Spitzer numerous times. The only thing they are willing to do is trade me out of it. But that's just going to make me have to pay much more for another vehicle. They are not willing to even look at my car. Ive been calling them since a week after I bought the car. And no one is being helpful. I just need them to fix this car. They sold it to me like this. And won't even bother to take it to look at it. I'm at my wits end.. I've maxed out credit cards trying to fix this thing. Just to have it break again. I've owned the car for 2 years now and have only put 7000 miles on it. They sold me a lemon and are now refusing to do anything but trade me out of it. Which is no longer an option because of my now poor credit.

I believe I responded to this complaint before, we reimbursed him the price of one the turbo , which was a one time thing ,if turbos are still going out then I would assume the problem is how they are being replaced or a parts problem. Either way the mechanic or the company that he is getting the turbo from should be the ones responsible.

I received a carfax when buying the vehicle that stated that it had a minor incident prior. I paid ********* check for a 2016 **** Fusion SE. I called to get insurance companies changed and they told me that due to the major disabling damage prior nobody wanted to insurance collision and comprehensive so it would cost me an extra 3-400$ a month! So as of right now I am paying 200$ a month for just liability with no collision or comprehensive. Spitzer never made me aware of how bad the damage was before selling me the car.

Attached is a copy of the car fax report on the 2016 **** focus.  As you can see Carfax reports it as being in an accident with minor damage.  This would be the report that we gave Ms. ************** No one here mislead or told her anything different .

    Date: 03/20/2025

I bought a 2016 **** Fusion SE with the vin # of ***************** on 9-21-24 from Spitzer Lower 40 of Dubois ************. On 9-20-24 I test drove the vehicle, I took it to my mechanic of Big Run, ** to check over the vehicle and see what issues it had. He said the car was overall in great condition. He couldn't find anything wrong with it except for my bluetooth in my radio would not connect or even turn on. I mentioned to the salesman I had which he and his coworkers all tried fixing it and told me that I would have to buy a new radio or get the **** dealership to fix it which regardless would cost me more money. So I said okay, we talked about the pricing of the vehicle and came out at ********* due to the radio not working properly and I would have to pay to get it fixed. The dealership wanted more but we agreed on that price. I got my new car on 9-21-24 when I wrote them the check and we went through all the paperwork. On 9-24-24 the check was deposited into the dealerships account. On 9-20-24 I had also called Insurance broker to get insurance. I ended up getting ************ as my coverage for $278.00 a month for liability coverage due to 2 points being on my license which were to drop off ********. So I called Penn Dot a few days after 10-18-24 and they said that my points had been removed from my license. I then called my insurance company to make the change since my points had dropped off my record. When I called Insurance they had informed me that there was no points on my license but due to my vehicle previously being in a bad accident it would be almost $****** a month for collision and comprehensive coverage on that vehicle. I said I was told it was a minor accident and I have the carfax report for it. He told me  that the ***************** searches the vehicle by the vin number and the car was previously in a accident in 2019 that almost totaled it. He said it was major disabling damage due to it being a very bad accident and that if anything were to happen to the passenger side of my car then it would crumple and smash instantly So if anyone were to be in the car it could severely hurt or kill anyone in vehicle. It is a liability for the insurance to cover the vehicle for collision and comprehensive coverage due to the prior accident so thats why it would cost so much. I just got this car not long ago, I can not afford to get a different one. The trade in value is a lot less than what I paid due to the damage on the vehicle prior. I paid them everything I had saved for this vehicle. I cant afford ****** a month just for insurance. I have been taking care of my family for over a year now, they pay me what they can and I had to find a reliable safe vehicle for transportation to dr ************ and hospital visits to ********** which is 2 hours from where I am located. I was aware that the vehicle was in an accident BUT the reports I was given from Spitzer Lower 40 completely mislead me by telling me that it was a minor accident with minor damage. The body is in perfect condition exactly as it was when it was at the dealership. I attached pictures of where it shows there is no damage cosmetically to the vehicle except for a little paint chip on the hood which is shown in the pictures I attached. I would also like to add in the previous response from Spitzer they had said **** Focus, I would just like to make it clear that the vehicle that I bought from them is a **** Fusion. I have also attached pictures of the underneath of the car from when I had taken it to my mechanic showing there was no damage.

    Business Response

    Date: 03/20/2025

My apologizes for calling the car a focus when it was a fusion.  The Carfax report i sent previously , was for the right car.  I can not say why the other report  has it being in a major crash, while Carfax, dose not.  Carfax also uses vin number to tract a car history , and is a independent car history report.  Since our mechanics and her own personal mechanics looked at the car a did not notice any structural damage and her picture shows no damage I believe the other report is inaccurate, and that Carfax has the correct information.

    Thank you

We purchased a used ******* Tucson from Spitzer Lower 40 on March 17, 2023. During the course of the purchase, we were told that as a stipulation of our loan, which was through *********, that we had to purchase a warranty through ***. The car began to give us trouble almost immediately, which we corrected each issue as it arose. Then the car starting burning oil and it was determined by our mechanic that the engine was the problem. On April 28, 2024, we began the process with the warranty company to try and get the engine replaced, which is still not resolved. We have not been able to use the car since April. In trying to get all this resolved, it is evident that Spitzer was very deceitful in the process of the sale of the car, warranty coverage and bank stipulations. Spitzer sent us a letter stating that they do not require the warranty as a stipulation of the loan, but they absolutely did during our sale. I feel they took advantage of our situation and provided false information during the sale process. They also did the paperwork wrong the first time so we had to go back down (taking off work) to sign the new paper work. We are currently having issues with the warranty company -***- that they made us purchase. All we want is for our car to be fixed and for it to be covered under the warranty that was REQUIRED for us to purchase.

Dear *************************************   Enclosed you will find a copy of the final acceptance statement, which shows which products that were choose to purchase and what products were not.

Any aftermarket warranties or insurances are done so as a accept or decline by the consumer and not a precondition of the loan.  A GWC warranty was purchased , since the diagnosis, was not done here at our service department i cannot comment on whether it should have been a covered item. Warranty companies do require evidence that there was a mechanical failure , and not a Maintenace issue. Since we haven't been the service department servicing   the vehicle over the last ****** mile ,again I cannot comment on it. I did check with our parts department and they were able to find two used motors for that vehicle.

     Truley Yours,

I used the ******** app to look for cars for sale. A few really good deals came back to me from the spitzer auto group. One example is a manual transmission Ford focus with 55000 miles for 8500. I emailed and a few phone calls were exchanged back and forth. I drove 150 miles, when I got there a lot of excuses were given why none of the advertised cars were there. Oh we have several lots, oh ******** messes things up all the time ect. The bottom line is, cars are advertised with 50-60 thousand miles in the 8 to 12 thousand dollar range. Most of the selection is 10 to 15 thousand dollar range with 150-160 thousand miles. The salesman claimed he couldn't show me the (focus) car, because he didn't have a title for it but would show me something for four thousand dollars more.

Test drove and purchased a car with warranty, went to leave the dealership and engine light and traction control light came on. They kept it for a week, got it back and it continues to do this. I dropped it off for service again 5 days ago, still not fixed. They said they deleted 4 codes and tried to tell me nothing was wrong. I said it needs fixed, they said they'd drive it more, but then head nothing back. I've missed several days work because of this. I'd like a different vehicle or the loan cancelled. It's senseless paying $470 a month for a car that I can't use.

This vehicle was purchased at the lower 40 on 10-15-2022 at 49,704 miles and came back in on 10-17-2022 with an engine light on at that time it needed a spark plug and a coil which Lower 40 took care of. Customer brought it back on 3-1-2023 at 58,865 miles with an engine light, traction control light and does not want to shift at times. When we looked at it nothing was current and it road tested fine we put about 22 miles on it currently it has 58,887 miles without any kind of a current failure. This vehicle is still here. ***** **** (****'s wife) reached out to me earlier this week I guess this is her niece or nephews vehicle and I told her that without vehicle acting up there isn't much we can do as far as diagnosis goes if they would like us to drive it more we can or they can drive it more and if and when anything happens we can look at it while it is current. Bill has also been talking to ***** and has left messages for ****. Bill also contacted ***** and let her know that he has left messages for **** and **** has not called him back.

I bought a 2012 F150 May 20, 2022 from Spitzer auto in Dubois PA. Almost immediately I had problems with the vehicle. The spray paint they had covered all the rust with wore off and the rust came through. There was a shake several weeks after that. I took it to the garage where I was informed that it needed brakes pads rotors calipers and new lines all the way around. And that it would not pass inspection. I had a scheduled vacation planned and took said truck which on the trip only managed to get 10 mpg. And it was slipping badly the vehicle broke down in Michigan the warranty they convinced me to get was very limited in the nearest garage was 100 miles from where I was at. Once at garage I was informed that the transmission was shot differential seal was leaking, the coils were bad the transmission lines were all rusted and needed to completely be replaced. Also the intermediate shaft was worn out and rust was falling out in plate sized pieces. I also had them do a tune-up thinking it would help with gas mileage. I contacted Spitzer's and left numerous messages and always was left to voicemail. When I finally contacted Kate the girl who sold me the vehicle she informed me that the truck was never even looked at before put on the lot. I had to pay everything out of pocket because the warranty paid nothing. I was stranded in Michigan for 6 weeks because I did not have the funds to fix the truck at that time. When I finally managed to get back to Pennsylvania and took the truck back to the dealership, the manager, Dave N*****, informed me that I was lucky he was going to do anything and that he did not have to do anything. And said it was the first he had heard about my truck and I had been calling for weeks. They eventually gave me my down payment back and paid off the car note. Which still left me $4,000 in the hole. Their service center looked at vehicle and said it was not worth fixing and we're taking it to auction. They refused to compensate me for all the money invested in the truck. So they are taking it to auction on my dime I live on a very fixed income and was very excited about my two truck. I have never been treated so badly in my life. And now only have $4,000 towards a new vehicle. Spitzer has corner of the market in Pennsylvania and I guess they don't feel they have to treat their customers with any respect.

    ****** ******** *******

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.
I was refunded the money, but NOT REIMBURSED the thousands I had invested in the truck. The vehicle was purchased at the END of May and the trip to Michigan was round trip 1100 miles. I was stranded for 6 weeks due to not having the funds to fix all that was wrong. Unfortunately I did not take a picture of the odometer but there is no way that 7,000 miles was put on that truck. Obviously they can say whatever they want and their word is taken as law. I hope whoever reads my complaint takes heat and does not buy any vehicles from these people. I knew this would come to know good end it was just the principle of it for me.
