Nature of dispute: Maintainitall did not provide the following items detailed in the contract 1) Excavate soil 8" deep for the driveway extension 2) Install 6" layer of modified stone base 3) The width of the expanded area detailed in the contract is not correct. 4) Charged for modified stones even though preexisting stones from the property were repurposed. 5) Paid for a 2.5" layer of new 19mm hot mix asphalt base course but only 1 1/2 inches were applied. 6) Paid for tar seam but none was applied. 7) The pitch of the new asphalt is not correct per the stormwater management system on the property

    Hello, 

    I have answered every question that *** ****** asked regarding the concerns of his driveway.  Every time he emailed or called, I responded in detail.  

    I am very willing to work out a solution to his concerns, but he has refused to allow me back to the property to assess the work.

    He has not made a specific request of what he would like as a solution.  

    He has refused to speak to me any further.  

    I need to visit the property to verify his complaints, and I will take corrective action.

    He is not allowing me to do that, so all I can infer is that he does not want to pay for the work completed.

    I am rejecting this response because the contractor has proven from the work performed on the property in April 2023 that Maintainitall does not abide by its contractual commitment. The company also does not offer work product insurance so there is property risk to having the company return to the property. The company offers a 100% satisfaction guarantee. I am 100% not satisfied with the work performed on ** ********** ****. Evidence of the items detailed in the contract that were not performed were shared in pictures with the owner of Maintainitall.

    I am rejecting this response because I did pay a 20% down payment.

    There is no value in a driveway that has many workmanship deficiencies, was completed without the proper Newtown Square, PA Township permits (violation is attached), and needs to be replaced by another driveway contractor. I did provide MaintainItAll an opportunity to review the work immediately after the work was completed in April 2023, but no one followed up with me. I spent a significant time sharing photos of the items that were included in the contract but were not performed on my property. At this point, the only resolution I will accept is a full refund of the deposit.

    To date, I have completed the following to rectify the matter with MaintItAll: 1) notified the PA Attorney General's Office, 2) opened a claim with MaintItAll's insurance, 3) opened a claim with ********** insurance, and 4) notified the BBB. 
    If I am unable to resolve this issue by November, my next step is to attempt to resolve the issue with the State Magistrate.

    I am rejecting this response because because *** ****** never gave me the opportunity to review any of his issues on site and made it clear that I was not allowed back to his property.  Please show me proof that you gave me an opportunity to meet you on site to review the work.  

    Also, *** ****** is the one who submitted and paid for the permit.  He specifically asked me to do extra paving work that was not included on his permit and I advised against this.  I told him that this would be in violation of township rules.  Permit attached.

    The driveway work we installed is functioning properly, shows no signs of disrepair, and he is gaining the extra parking he wanted.  He is receiving the benefits of our work but does not want to pay for it.

    I am rejecting this response because MaintainItAll completed the attached permit, not me. *** ***********'s name is signed. *** works for MaintItAll. 

    The following business day after the work was complete I provided an opportunity for the owner to come on-site to review the work the team completed in a text message and phone call, not email. The owner never followed up with me.

    The driveway is already showing signs of cracking and sinking an it's not functioning properly. The dimensions of the additional space was not the dimension included in the contact. I am not trying to receive benefits from MaintItAll's work. I can't pay for items that were not delivered in the contract.

    *** ****** dropped off the permit and edited the permit as per the text messages I have with him.  He did not want the township to know about the extra paving work which would cause additional storm water management and I have text messages showing our conversations.  

    I also have text messages of my response and to the request to meet on site.  When he texted me to stop by, I told him " I can stop down tomorrow around mid morning"  He responded that he could not meet that day and I told him we can reschedule for next week.  At that point is when I got the long emails from him and when I asked again, he told me I was not welcome on the property.  My invitation is still open to meet him at the property.

    I am rejecting this response because the complaint and contract have nothing to do with the township permit. The complaint with the PA Attorney General's Office and the Better Business Bureau is related to items six items included in a contract that was signed by both parties but never provided. I am demanding a return of the deposit before filing with the small claims court in Delaware County. MaintItAll has until 12/30/23 before my claim is filed with Delaware County.
