The Fairshare Solutions LLC harasses two senior citizens (77 and 75 years old one with ********* disease) who do not owe this money. Multiple letters mailed to the company disputing this charge were completely ignored.Business Response

Dear Better Business Bureau,
Fairshare Solutions, LLC is a fully licensed collection agency and a domestic ************************* registered in the State of *************
We have been contracted by ********************, a vacation timeshare community located in ********, ************, to assist in the collection of past-due annual membership fees that are legally owed to the resort. According to our records, **** and ***** ****** have outstanding membership obligations spanning multiple years.
In accordance with the Fair Debt Collection Practices Act (FDCPA), Fairshare Solutions mailed a validation notice to the Shahins on December 14, 2024, for a balance of $1,890.00, inclusive of past-due fees, late charges, and collection costs. Since that time, we have sent two additional notices:
-A default notice dated March 12, 2025.
-A settlement offer dated April 10, 2025, which proposed a reduced payment of $900.00 in exchange for the Shahins signing deed-back paperwork to end their ownership obligations. We have not received any direct communication from the Shahins in response to these notices, aside from the BBB complaint now under review.
We understand that the resort also received a complaint from the Shahins. In response, their Project Manager informed us that the owners could resolve the matter through the walk-away settlement program offered to similarly situated owners. We have attached a portion of that internal resort response below for context: **** ****** is in default and was contacted by our collection agency, Fairshare. To summarize the complaint, they are asking to end their timeshare because other people (who are Mexican) were using the pool in 2022. They can end their responsibility and collection efforts by working with Fairshare on a walk-away settlement to return their deed. We are offering this to everyone currently.
From Fairshares perspective, the claim of harassment is unsubstantiated. To date, we have made only three formal attempts to contact the Shahins:
-The initial validation notice
-The March 12 default letter
-The April 10 settlement offerAll communications were sent in compliance with federal and state regulations and were intended solely to provide resolution options for the account in question.
We welcome the opportunity to resolve this matter amicably and remain open to working with the Shahins to complete the deed return process and conclude their financial obligation to the resort.
Please let us know if additional information is required.
Sincerely,
****** ******

I am rejecting this response because:
Resort violated contract terms and therefore we are not responsible for any contractual obligations!!! The answer did not address that issue and fraudulently claimed that we awe something!!!

The member entered into a legally binding agreement with ******************** and has a clear contractualand moralobligation to uphold the terms of that agreement. Rather than engaging in a constructive dialogue to resolve their outstanding balance, the member has repeatedly attempted to divert attention from their obligations by raising unfounded issues.
Despite multiple good-faith efforts by the resort and its agent, Fairshare Solutions, to provide direct contact information and encourage open communication, the member has consistently chosen to bypass these opportunities, instead seeking intervention from the Better Business Bureau and/or the Attorney Generals office.
At this point, the member is being offered a straightforward path to resolution: a one-time, reasonable settlement that will allow them to permanently walk away from their ownership responsibilities. This offer is fair and in alignment with the dues owed.
All it takes is a phone call. Should the member continue to avoid engagement, further collection activity may be initiated to enforce the resorts legal rights under the agreement.Customer Answer

I am rejecting this response because: problem is that the resort violated the terms of the agreement mentioned and therefore terminated it. Claiming after those violations that we are still under the agreement is a fraud and a lie!

I was lied to by ****************** Vacation Program and after numerous attempts they cancelled my contract. I do not have a membership with ***************** Vacations any longer. Now I am being harrassed by Fairshare Solutions for the balance of the contract. Why would I have to for something that the company themselves cancelled. *********************** ******** Assurance Supervisor for Royal ********************* in the *********** Office stated that the account was deactivated on February 1, 2024. Now this company is harrassing me and I am not giving them a dime.Business Response

Dear *****************************,
Fairshare Solutions, LLC is a licensed collection agency and customer recovery business with offices in ************ and ************* The Royal ********************* is our client.
****************************** and ********************** purchased a vacation membership from Royal Holiday. In April of 2024, Royal Holiday placed the Pinion's account with ********************** for collections because of non-payment on their loan promissory note and thier annual membership fee obligations. When we received your letter dated June 21st, we immediately reached out to our client to seek their insight into this matter. We were informed that their agent *********************** did in fact have a conversaton with the ****************. ****************** did not state to **************** that the account was canceled. Instead, she informed **************** that because the account was in arrears that the account had become 'inactive', meaning that they wouldn't be able to use the membership until they paid or reached an agreement. Because neither a payment or a solid agreement was reached, The ****************** placed the account with ********************** for collections.
Fairshare Solutions is different from most other collections companies. Our company is truly customer focused and we realize that there are always unfortunate reasons for non-payment. We work with our customer to easily manage a repayment plan and we reward good payment behavior. Fairshare has sent hundreds of our customers on 'accommodations paid' ******* resort vacations just for working with us to resolve their debt obligation. We invite Mr. and ***************** to have a conversation with us to discover what we can do for them.
At the same time, unless there are legitimate reasons for ceasing collection efforts, Fairshare has a responsibility to our clients to continue to pursue collection activity. We promise to be courteous to our clients but we also must be firm and persistent in emphasizing their obligation.
Thank you for bringing this matter to our attention. We invite the Pinion's to contact us at ************.
Best,
************************* - President

Problem is about a maintenance fee when I pd 2 in a row. I pay every other year, and by accident I pd two years. They couldn't find me because they typed my address wrong. My address was *******, *** and they typed it as * ** ***** so I have not gotten mail until the collection letter. Also, dispute the amount due. I've called 3 times recently with no response. This should not have gone to collections.Business Response

Fairshare Solutions is a collection agency. We are at the mercy of our clients when we receive placements from them. Our general assumption is that the accounts they are placing with us are accurate and valid. We see from ********************** complaint that this may not be the case. Fairshare Solutions has ceased collection activity, and we have returned the file to our client, The ******* Club.
