We hired Kunco Landscaping to grade our yard in order to remove a swale that was creating water flow/drainage issues. The contract consisted of leveling/grading our backyard lawn, stump removal, rockhounding, finish raking, and hydroseeding. The contract was created on 4/7/23 and work was officially initiated on 6/13/23 and Kunco considered the job complete on 6/19/23.

Prior to the contract being signed, we came to an agreement with Kunco that the yard would be graded to one slope in which the swale will no longer be present. As the work began, it became clear that the original grade of our yard was remaining unchanged, therefore, the swale was still present. We made multiple attempts to contact the office and job supervisor to address our concern prior to the application of hydroseeding. We were finally able to get a hold of the job supervisor prior to hydroseed application, however, the supervisor failed to halt progress and notify the crew to make the correction, resulting in the lawn being seeded. As a result, Kunco considered the job complete.

When we confronted Kunco about the improper grading of the lawn and remaining swale, they stated that we agreed to keep the swale. This agreement was not made with the company as this was the primary goal of the job.

To date, Kunco has yet to make any attempt to resolve our concerns and is unwilling to escalate the issue to the owner. Several attempts were made to contact management and owner in request to have them come out to the work site, but Kunco has failed to meet this request.

The last statement provided by Kunco was directing us to pay the remaining balance on our invoice and then begin an entirely new job/quote to remove the swale as originally agreed upon.

    Business Response

    Date: 07/19/2023

We first quoted this job in April of 2022. (Estimate attached)

We were then contacted again in March of 2023 to requote the work because the scope of work had changed from the previous estimate in 2022. (Estimate attached)

The quote from 2022 included "installing topsoil" to remove the low areas of the swale.

The quote from 2023 did not include "installing topsoil" as the customer and estimator determined onsite, at the estimate, that the water was not able to flow properly from neighboring properties if it was filled in.

There was no agreement to fill in the swale, as this would have been listed on the estimate.

As the customer states, he did call numerous times and management met with him each time he called.

He was upset because the owner would not meet with him.

He was refusing to pay the remaining balance, even though the contract was completed.

He then filed a complaint with the BBB and then as of 7/19, he paid his balance due.

We are a little confused, but appreciate the payment.

Now that he has paid, we are able to touch up any seeding if needed.
