    On May 17, 2023 McMullen submitted a proposal to perform HVAC on my house. On May 19, 2023 McMullen cashed my deposit check (check number 862) in the amount of $9750, as a 50% deposit to perform the HVAC work as set forth in the proposal. McMullen assured me that he would be able to perform the work in June 2023. However, in advance of him doing so I needed to perform some work (run electric, pour a slab, install ductwork, and make an opening for a bedroom unit). On June 1, 2023 I sent McMullen a text indicating that I had completed the work and was ready to schedule. McMullen did not respond until June 12, 2023. I asked McMullen to call me. He did not do so. On June 22, 2023 I sent McMullen another Text and asked when he would be coming out to start to work on my project. McMullen did not respond. On June 25, 2023, I sent McMullen another Text and indicated that I needed him to respond. He did so in a text indicating he would have a date shortly. On June 29th he proposed July 11th through the 14th as the time slot to perform my job. I agreed. In response McMullen indicated he would put it on his calendar. On July 10th at 10 am I asked McMullen to tell me what time he would be starting work on Tuesday. McMullen responded at 8:30 PM and indicated that is worker was out and would like to reschedule for the 17th. I agreed. At 9:49 PM on July 17th McMullen sent me a text telling me he would be starting my job on Wednesday, July 18th. I texted McMullen at 8:35 AM indicating he could come through my garage. McMullen failed to show up. He indicated he was still working on another job. At 2:14 PM in a Text I asked McMullen to tell me when he planned to start my job. He did not respond. This morning I left him a voicemail informing him that I did not appreciate his failure to respond and if I did not hear from him today that I would have no choice but to assume he was not planning on completing my project, and in that event that I would need my deposit back.
