    Signed a contract with *******************, **** Construction and Renovation, LLC in November of 2022, to complete a build out for 3 Salon Suites, ADA ******** and maintenance room.Prices of the job would increase through out the project.Very difficult to resolve any issues that I had concerning discrepancies both in writing and work that was completed by his company. Despite the issues coming from estimates sent to me.Work was not completed or completed improperly and needed changed.***** received money for work I needed to have redone as and work he didnt complete. he refused to fix. In addition, I needed other contractors to complete the work.Not to mention, he exceeded his deadline. Work was finally completed in the middle of July 2023 by other contractors.

    My side is not assumptions, as ****** response. My side is actual FACTS. I had a problem with the work ************** did from the beginning with his inaccuracies of the size of the room, to a damaged unsecured and inoperable HVAC system.  The electric wasnt even hooked up in hallway. The plumbing wasnt exposed to the pedicure area.  ***** changed the square footage to increase the pricing on materials. He also overcharged for a conduit.  He charged for two dumpsters that he used for other jobs and stored on my property, (This was a fresh build out, not a rehab).   The doors was paid or and again were not able to be used because he ordered the wrong size.  Not only that, the sink in the ADA ******** was improperly placed.  I had two companies that confirmed the shotty work that was done and wasnt completed. The intake was not completed. Most likely, because it wasnt done.  The job was completed by other contractors who had to fix all of the mistakes made by ***** company. ***** saw a big job and way to take advantage. ***** is operating a business that is unethical.

    Good evening, I read through and looked at the pictures provided.  It is a very simple answer from **** Construction, **** breached the original contract when she decided she was going to try and be the General Contractor.  We roughed in the plumbing, heating/cooling system and electrical and passed our inspections to that point and then proceeded to hang drywall and sand that in preparation for **** to start painting.  This is where she then started to paint and then added to say she was now going to do the drop ceiling grid system and install the ceiling grid tiles. She also proceeded to say now she was going to do some type of concrete floor finishing, but what I see in the pictures it looks like that changed again as well and went to a tile product.

    Price gouging is not true at all.  A contract was agreed upon and then the item she is referring to for the main power supply which had to come from the main control room several units over from hers and had to come across a already occupied unit and through a firewall.  The price was more then fair for the materials and labor which she agreed upon.

    The HVAC on the Roof clearly shows someone moved it off the pad that it was sitting on when we left.

    Not sure about the 1 wet ceiling tile picture?

    The plumbing for the pedicure station was there like she told us to do, meaning the water lines were capped off right behind the drain because she did not know when she would get a pedicure chair installed.

    The bathroom sink we did install and all I can see in the picture is that she moved the sink and put her own sink in place.

    Each room was framed and yes we did resize the room to be a little larger for her and kept the smaller room original pricing, I did show her on a separate estimate that it would've cost more because she insisted I was over charging her but in reality... we only charged for the smaller room for framing materials and drywall.  

    Lastly the project was not going to be done in 8 to 10 weeks once **** decided she was going to try and do a bunch of items on her own.  We passed All our inspections for rough-ins as stated and I don't know what she did after we left.  I had one phone call from ***** Heating asking me what happened and I told the man what was going on and that was it.

    I am rejecting this response because:

     

    Upon rereading my previously submitted statement, I believe I clearly indicated why I should be reimbursed for this work done by ***** and his company.  

    ***** has difficulties in taking ownership in any work that was done accurately.  I began choosing to take on jobs because as I didnt feel confident in his work comfortable with ****** approach in handling these matters and he would not listen to my concerns.  On top that, he was using the dumpsters for other jobs but adding the cost onto my new estimate as shown in previously submitted documents.  He adjusted the estimate from a 9 to 10 ceiling in order to raise the materials and labor.  (See submitted estimates). Instead of taking ownership for work improperly completed, he dances with his words and is in aggressive in demeanor, all while the supporting documents are evident hes wrong.

    i am reiterating my complaint

    The agreement was supposed to be two suites measured at 180 sqft and the 3rd suite 245 sqft.  Along with a maintenance room and an ADA ******** all designed to code, with outlets in the hallway. *******************, owner of **** Construction and myself communicated via email, text and in person. Before construction the space was just a shell. The space required installing plumbing, electrical and an **** system as well as framework, drywall and a drop ceiling.  Theres additional items needed to comply with codes set forth by ****************.  

    This project was supposed to be an 8-10 week project, that has yet to be completed.  Do to **** Constructions carelessness, improper and incorrect product installation, charging for items not completed and price gouging. As well as inconsistencies with estimates presented. Below are the charges that fluctuated, comparing to ESTIMATE DATED 3.21.2023; 10:16pm. 


    First, room 1 and 2, (middle room) were supposed to be 180 sqft or near it, 15x12x9.  The 3rd room, (large room) is supposed to be 245 sqft.


    January 4th, I checked the progress.  The length of the rooms were 12 not 15.

    Immediately I messaged *****. He insisted I was wrong and I should come in the morning.
    I did. He greeted with an attitude.  I mentioned about each room needing a sink as well as the shampoo bowl, per the text message. I showed ***** the message. He was angry. So, I left.   He called later, where he apologized. ***** continued to say how expensive a conduit was, but wouldnt give me a price, until finally he gave me the figure of $2995. Wanted the previous owner to cover part of the cost. Since time was ticking I had him do, as I did research and spoke with an electrician he said, I was way over charged it should only cost about $800-$1,000 with labor.
    Estimate dated February 17, 2023, 11:07 am, ***** changed the height of the ceiling from a 9 ceiling to a ******************************************************* dimensions, subsequently increasing the price of services, such as: 

    Framework and drywall

    (See text conversation page 8 and email correspondence dated 2.21.2023)

    After many back and forth communications, by text, email and in person, the final in person meeting on March 22, 2023, ***** adjusted the mentioned items totaling a credit of 
    ($4,777.71). On estimate dated 3.24.2023. 
    There were materials that was provided by the previous owner that was not accounted for, ***** eventually credited these items on estimate dated 2.26.2023 at 3:44pm, line 100 $441.20 and line 101 in the amount of $262.50.  However, on ONE of the final estimates, dated 3.21.2023, (This estimate was presented in person on 3/22/2023 notated As of now) they were removed. Yet, on 3.24.2023  an email was sent with work needed to be completed, the credit was notated again on line 88 & 89.

    Commercial Electrical in middle room price increased without reason.

    Charged for a ******** door that was not installed.

    ***** ordered Wrong Size door and was not installed.

    ***** charged for 2 dumpsters and was using it for his other jobs and charging me.  In the contract he stated (1) dumpster at $952. On February 22, 2023 at 3:44pm he charges me (2) at $800 each. 1 Dumpster was quoted by the company at $250 for the 1st 2 weeks and $50 each week after. On 3.22.2023 1 dumpster was removed and the other was charged $800.


    The above charges BOLDED was presented incorrectly on Estimate 3/21/2023 timed 10:16pm

    Below are services that **** Construction completed inadequately and resulted in replacement and repairs, (prices are based on Estimate 3/21/2023 timed 10:16pm.

    **** Construction, improperly installed an **** system that was inadequate and not conducive for commercial use.  Much less, salon use where vapors, chemicals and such are circulating in the rooms. This was an expressed concern of mine and specified in a text message, with no response from *****.   There were no returns also expressed in a text message.  The equipment was damaged, not secured, leaked, oversized and used materials that was against code. This system was inoperative and not functioning.  The air handler was not assessable and was not placed in the location where the drawings stated when submitted to the *****************  In addition, the roof was not sealed after installation causing damage on tile to the Large Room. A new system had to be installed by ****************** and Cooling, because ***** did not respond when asked who completed the ****. 

    The **** unit wiring was improperly installed by ****. Again, the hole that was drilled through the roof by **** Construction for the **** system, was not sealed resulting in water leaking through the roof and ceiling.  

    In addition, It was verified by 2 different professional **** companies that specialize in installing **** systems for a living confirmed the damaged unit was not bolted down and properly stabilized on the designated pad. Professionals are not going to move a damaged installed system.


     I specifically asked for a system that would circulate the air as necessary for a salon.  He put in the cheapest **** that was ok for residential and charged for a commercial system.Price gouging.

     ADA Bathroom

    to reaffirm Jasons lack of knowledge in a commercial property, it was also indicated when the distance from the toilet to the sinks was inaccurate. As stated previously,
    ***** ordered a basic sink, that I did not select and was improperly mounted with a 2x4, nearly 15 to close to the wall closest to the toilet.  60 is code.

    While the rough in was approved the sink was not in place at the time and was NOT to code, due to the placement of the sink.

     This work was performed by *********************, as ***** refused to respond to my message requesting the name of who completed the work. The sink was removed, toilet installed and drywall will be fixed by ****** Services and Renovations, LLC.

    Pedicure Plumbing
    The rough in for the pedicure chair was complete.  However, when the drywall was done, they covered the plumbing.  When I text *****, he stated it was done like that for after inspection. (Doesnt make sense, since Ill have a pedicure chair sitting in place for inspection). ****** Services cut out drywall, ****** Plumbing completed pedicure plumbing hook up.

    Regardless of when I was getting a pedicure chair, I knew I was getting a pedicure chair and knew exactly where I wanted it.  ***** said he hid it until after the inspection.  I wasnt clear why that would be, considering I would have the chair sitting there when the inspector did his final inspection. Seems very suspicious to me. As the plumber opened the wall it was clear why the plumbing was covered. It was improperly installed for the pedicure chair.  I sent ***** an image of the chair that I was looking to get.  His lack of experience and unwillingness  to research how to properly pipe for adequate water flow caused additional expenses.  It makes sense why ***** chose to hide his workmanship for the pedicure chair.



    Electrical in Hall way

    Electrical work was charged for the hallway. However, there were no wires to the outlets. **** Construction charged for services not completed. Plus the wiring wasnt complete for the light switches. The wires for the switches was supposed to operate the s ounce in the hallway and an option for the light in each room.  But, the switch for in the room isnt operational.

    Incomplete Drywall Finishing  

    **** Construction was supposed to have the walls sanded in order for me to paint.  However, I had to sand before I could paint.

    Maintenance Room and Bathroom Doors

    Charged for wrong size doors for ******** and utility room that was not installed and couldnt be installed.

    ***** cut corners and charged high dollar for cheap products that was not conducive for a salon. 

    The inspector said he doesnt check the entire system for operation and there are times when the contractor changes things after they come in to inspect. The **** failed inspection on 4.24.2023.  The returns (Jasons responsibility), were not complete before the ceiling was completed.  Communication with ***** was extremely difficult. His arrogance and lack of listening skills made for a lot of errors. ***** was well aware, I potentially would take on some projects when we signed the agreement.  As time went on, it was confirmed, I had very little confidence in Jasons ability, his dishonesty, unprofessionalism and bullying attitude was too stressful.  For these reason, I began taking on some of the projects that I could do on my own.

    I HAVE MORE ESTIMATES THAT SUPPORTS STATEMENTS BUT UNABKE TO SEND IN THIS MESSAGE DUE TO THE AMOUNT OF DOCUMENTS PERMITTED. WILL SUBMIT SEPARATELY, IF POSSIBLE.

    I have enclosed additional documents that clearly validates my complaint.  If ***** is able to pay careful attention to the documents he sent to me as well as other communications submitted he will see his errors. ***** and his companys negligence caused disruption in the operation of my business. This cost me a great deal of additional expenses.  Not to mention, the money he bullied and deceitfully received for work he did not complete as well as work I was wrongfully charged for.

    There were items on ****** invoices that he either did not complete, did not do or was done incorrectly.  I have attached the invoices of other contractors that completed the work.  Not to mention, items I purchased in order for the job to be completed, that ***** charged me for.

    I am not replying on there anymore.  **** breached her contract and paid for the work that was completed and we went our separate ways.  Again, I have explained this to the fullest and it is her fault she breached the contract, not mine.
