Hired contractor to replace roofing and siding. Verbal agreement was that cost would be paid by insurance money obtained for hail damage. No written contract was drawn up. Contractor performed suboptimal job. Contractor submitted invoice for cost which was higher than previously agreed upon amount. Contractor is threatening to litigate if remaining money is not paid in full. Repairs on house have not been done.

    Business Response

    Date: 08/25/2022

Fioravanti Construction Services met with her as a referral from one of our many satisfied customers. Her home was hit by a hail storm that came through her area in the summer of 2021. I have been working in the insurance industry for 15+ years and use the same software program that the insurance companies use to estimate claims.

In our initial meeting I told her "that as long as the insurance company has all the proper line items on her estimate that FCS can honor the insurance company's estimate."

After looking over her estimate from her carrier, I noticed that they didn't give her any money for her detached garage and missed several items on her main home. I documented the additional damages and sent them to her to forward on to her adjuster. Her adjuster then agreed to increase her claim an additional $8,000 (Approximately)

So, in total, her carrier paid for a new roof on both her home and her detached garage, new gutters and the replacement of the aluminum siding and window wraps on the LEFT elevations of both structures. (Left elevations only)

***************** wanted us to replace all four sides of both structures. This included all rake metal, soffits, fascia window wraps and siding. I told her, VERY clearly, that since she had tripled the scope of the covered claim, though we would use vinyl rather aluminum for the siding, that the project would end up costing more than what her carrier was giving her. I told her this expense would be minimal but would surely be more.
    She understood.

I sent her the updated estimate, prior to performing the siding work, breaking down the cost differences. (Which, after my discount, only amounted to approximately $4,000) After discussions, she told me "keep it as low as I could."
In good faith we completed the work.

Once the work was completed, she went on about how she just bought a new electric car and couldn't afford any extra costs.
After several attempts to collect our money, she paid me an additional $7,000, approximately $4,000 less than what was originally due.
She never paid me us for permit fees (approx $500) or any of the additional money she owed for work performed.

At that point, it is not worth my time to pursue the matter any further. I told her that I accepted her final payment as
"paid in full" and provided her with company and manufacturer warranty information.
This customer clearly took advantage of my company, waiting until all the work was done before she told me she wouldn't pay.

This project is closed on both our end as well as ********************* end.

Feel free to reach out anytime to discuss further.

    Best Regards,
    Matt F*********
