    We had a payment plan arrangement with I.T. Landes in ************, ** to pay our outstanding balance to pay $50/**. for our oil burner repair. They accepted our payments. Then we required further service for a malfunctioning controller on the oil burner, that they had installed previously. It was replaced and we were billed, adding onto our outstanding balance owed. Soon after we received a letter from a collection agency demanding full payment. I. T. Landes was not honoring our payment plan and reported it to a collection agency without any communication as to why they were demanding payment in full

    The alleged verbal agreement was not honored by the customer with a consistent $50/month payment, so it nullified the supposed agreement. We don't have any documentation backing up this supposed verbal agreement. The customer did not reach out to us when we sent out the final notice letter to discuss their payment plan.  I attached copies of his Invoices as well as the final notice letter mailed to the customer. If you look at the Invoice ********* from 11/7/22 he was making $50 payments pretty consistently from Jan 2023 to July 2023 (he missed Feb and Apr). But after July we didn't receive another payment until 11/9/23 $50 which finally paid off that Invoice with $1 of that payment going towards Invoice ********* from 12/28/22. No payment in December and then after we sent him the Final Notice letter on 12/29/23 we received another $50 on 1/8/24 that was applied to Invoice *********. A statement is mailed on the 1st of every month that he receives showing his balance. We sent emails for payment on 5/26/23, 9/20/23, 10/26/23, 12/27/23. Due to the inconsistency of the payments and the customer not responding to our payment inquiries we then sent him to our collection agency.

    I am rejecting this response because:
    Although some payments were late we tried to honor the payment plan as much as we could afford at the time and Landes DID  ACCEPt the payments . Landes did not communicate that if we tried to catch up on payments they wouldnt send it to collections but they did any way for a measly $50 / month on approx $387 balance . For a company that makes millions  a mere $50 isnt going to bankrupt them but only to ruin a consumers credit status is underhanded. Court may be the next step for us
