    In January 2022, ****** **** Homeowners Association entered into a contract with Bricck Property Management to provide HOA management services. In November 2022, we wrote to Bricck informing them we would not renew the contract for 2023 due to several issues. Some of the main issues of concern were: -Financial reports were issued intermittently; per contractual agreement, these were to be provided on a monthly basis -Access to HOA funds was never provided to board members -They never visited the HOA site as they were supposed to within the contract -They took too long to resolve homeowner issues -Multiple instances of HOA vendors not getting paid on time which impacted service to the community -They did not make themselves available to discuss these issues nor did they improve The effective date of transition to a new company was to take place on February 1, 2023. While Bricck initially was cooperative, we reached an impasse when we asked them for further clarity on how to transfer our funds from them to our new company. Since mid-January, we have not been able to get in contact with the one individual at the company who holds the information to make the transfer. We have tried calling, texting, emailing and even having our HOA lawyer reach out to facilitate. This person has texted the HOA lawyer back, but has never responded to our requests to meet or given us the clarity needed. We were requesting a meeting to make sure we understood next steps to facilitate the transfer and that request continues to be ignored. To date, our new management company still does not have the funds--funds that belong to ****** **** HOA--to facilitate management of the community needs. We are seeking assistance from the BBB as we have concerns about the legitimacy of Bricck as a company. We have asked to speak to both legal and accounting which do not seem to exist and so we have not been able to make progress on a resolution.

    ******* **** ended their contract at renewal time with Bricck Property Management.  Bricck did not accept termination for cause, but rather non renewal.

    At the end of every contract, we have to reconcile the finances before we are permitted to release funds.  On several occasions, I advised the Board of Directors at ****** ****, as well as new management and their attorney, that they needed to request checks to start their new bank accounts. Invoices needed to accompany these checks.

    Prior Management requested the entire balance on two occasions and each time we told them this was not possible because there were outstanding checks that needed to clear the account.  We asked them to provide an invoice for a smaller amount.  We told them we cannot tell them how to run their business, but gave suggestions of $1,000 or $5,000 like other management companies do.

    In March 2023, we finally received invoices from prior management, AFTER Their attorney contacted us again.  I advised their attorney all we needed was the invoices.

    It is typical for accounts in our industry to take 2-3 months to settle and all checks to clear. All checks have been cleared and final closing has now been sent to the bank.

    If you require documentation of any of this, I can provide it.  But we would kindly ask that you remove this bad mark from our report.  We are conducting business in accordance with best practice and even helping a competitor with how to conduct their business, while safe guarding the funds of the Association by requiring proper invoice to release funds for audit purposes (which was explained to all parties every time).
