    On May 18, 2023, my wife ********* and I closed on a 2-family house listed by Joseph P. Gilroy Real Estate *************************** ***********************************. The said Real Estate company was used as dual agent for the deal. However, during the walkthrough on May 18, 2023, my ******** noticed some new plumbing issues in the bathroom and the presence of ****************** as well as a white broken wicker chair in the living room of Unit 206. The listing agent, my wife and I as well as ******************************, the listing agent, took pictures and agreed to address the aforementioned issues at the closing. As a result, an agreement was reached with the Seller during the closing and a stipulation was drafted by ***************** and signed by the relevant parties. On May 19, 2023, my wife and I rented a moving truck from ******** to transport recently purchased gently used custom wood kitchen cabinetry, countertops, sink, and faucet and stored them in the basement of unit 206 and the garage (please see the attached receipt). Upon return to the property on May 26, 2023, the debris in the attic and the chair were removed. Unfortunately, the gently used custom wood cabinetry, countertops, sink, and faucet were also removed without our knowledge, consent, and authorization, in violation of the stipulation drafted by *****************, agreed upon and signed by the Seller and the Buyers. ***************** was contacted via text messages as soon as my wife and I noticed that the aforementioned items were missing. ***************** offered to reach out to the Sellers representative as he was unaware of what was left behind compared to what was newto see what was done with the items so that we can resolve this as quickly as possible. However, in a follow up text message, ***************** conceded that she spoke with her broker and as far as the items go he said its a matter that a lawyer would need to handle if you want to pursue given the situation is something above what we would handle. On July 24, 2023, my wife and I sent a certified letter and purchase receipts as well as text messages from ***************** to Joseph P. Gilroy Real Estate to give Joseph P. Gilroy Real Estate, its broker, and ****************************** the opportunity to act ethically and make my wife and I whole within (7) days of receipt of the documents. A copy of the above documents was also sent to the President of the ************************************** *************************-August (noting that the President-elect of the Association is Joseph P. ********************** **.).On August 1, 2023, I received as telephone call from an individual who identified himself as *** ********************** confirming receipt of the aforementioned letter and documents and stating that he "will get in touch with ******" and get back with me the next after 5PM. Since then, we have never heard from Mr. ********************** again. Moreover, we have not been contacted by the ************************************** (whose President-elect is Joseph P. ********************** ** according to its website) at this time.

    I do not accept the response submitted by Joseph P. Gilroy Real Estate. With regard to her claims, please refer to the evidence including text messages from ***************************** (real estate agent) that I submitted at the time the complaint was initially filed. Moreover, the items were removed about a week after the closing.
    Joseph P. Gilroy Real Estate failed to accompany the movers at the property to facilitate the removal of the rubbish left in the attic and living room of Unit 206. More importantly, Joseph P. Gilroy Real Estate chose to provide the code of the lockbox to others and therefore demonstrated unworthiness or incompetence to act as a real estate agent/broker in such a manner as to endanger my interest as the new owner of the property. Furthermore, the stipulation clearly identifies the area of the house where rubbish were to be removed. In addition, all receipts were submitted to Joseph P. Gilroy Real Estate and to BBB.
