    On or around August 15th 2024.we signed a contract with earl weaver contractors llc for installation of generac. Originally we were told the work was going to be done in mid-november. We were told we had to put 3000 dollars down then told they wouldn't be able to start until December. We had a hardship where we wouldn't be able to get generac. We sent in a contract to cancelled the contract stated the transaction had to be cancelled three days of purchase. There was no date on contract that we returned. It did not specify what the date of purchase was. The contractor called and stated he was going to keep a third of the down payment because we failed to cancel within the three days. We believe that the date of purchase is when they start. He stated that they did some work. They did nothing but give us an estimate.i called him and then he went from a third to keeping five hundred from down payment. I told him nothing was started and also said there was no specify date of purchase. He kept saying they did work. They didn't. They haven't even started anything. They haven't order nothing yet or planned anything.

    I have attached our proposal.

    They copied the signature sheet from the proposal and signed and dated it 08-17-2024 and mailed it to us with the down payment.

    Then on October 9, 2024 they signed and dated the Notice of Cancellation and mailed it to us.

    There was no mention of hardship or why they would wish to cancel. simply that they wished to cancel.

    We originally submitted our proposal to the customer on July 10. At that time we suggested November may be a possible install date.

    They waited till August 17, 2024 to sign. They copied the signature sheet from the proposal and signed and dated it 08-17-2024 and mailed it to us with the down payment of $3,000.00.

    By the time we received the signed signature sheet and the down payment over a month had passed and our schedule had filled for the original suggested time frame, thus the December date for installation.
    Then on October 9, 2024 they signed and dated the signing of the Notice of Cancellation and mailed it to us without filling in their original signing date.
    There was no mention of hardship or why they would wish to cancel. Simply that they wished to cancel.

    We graciously sent $2,500 of the down payment back even though we were not required to, and kept $500.00 for our investment in scheduling and planning the project.

    I am rejecting this response because:  I feel that they shouldn't keep 500. Out of my deposit. I would of had the work done if I wouldn't of had a hardship.  They done nothing with planning. All they did wad cane and gave estimate. Nothing else. We weren't even sure where the generac was going he just gave us ideas. They also wete trying to keep thousand until I had to have a phone call with them. He was very nice at all and not understanding of anything. I don't feel that they should be able to take 500 for nothing. It would different if they did something else . They didn't. Thank you *****
