      On April 16th 2024, a McClain Bros. Vehicle struck my wife's car as it was parked in front of our home on ***************************************************************. The driver, *********************, a McClain Bros. Employee stopped to check the damage on his vehicle when my neighbor ********************* *************) who witnessed the accident told ***** to approach our house as we are the owners of the vehicle. ***** wrote a note and was about to place it on our vehicle when my wife and I approached him. *** was very concerned that he would lose his job and begged us to allow him to cover the cost of damage himself. We told ***** we would allow him the opportunity to cover the cost but if not we would proceed through his employerer's insurance. ** took pictures of *****, his work vehicle and his ID, however he did not provide us with the insurance information. After approximately 2 weeks of intermittent communications with ***** it became clear he would not be able to handle the situation personally and we requested the insurance information. When ***** did not provide it we contacted his employer and explained the situation. We were treated very poorly and disrespected by the staff at McClain Bros. They were not going to help us. We had filed a police report and the Manager ***** at McClain Bros. Would not even provide the insurance information to the ******* ****************** We were told by ***** that his employee ***** stated it happened in his personal vehicle and not his work vehicle. After I spoke with ***** and told him that legally he would be financially responsible for the damages he told us that he did come clean with his employers and told them the truth that he was indeed in the work vehicle when he struck my wife's car. Even after ***** told his employer the truth, we made several attempts to contact them for the insurance information. Each time they gave me the run around, treated me disrespectfully and continued to withhold the insurance information.

      - Date of Transaction: April 28th, 2023 - Amount Paid: $2,800 (2 installments of $1,400 each)- McClains Scope of Work: Repair / replace collapsed sewer line - Nature of Dispute: McClain Bros. is holding $2,800 of mine, and will not refund it even though the agreed upon work was not completed. We had to have another company come in and complete the job.- Has McClain tried to resolve this issue?: NO. The sheer number of phone calls I have made to McClain Bros. is staggering. They consistently tell me that the office manager is in meetings all day, and will call you back. I have NEVER received a returned phone call, and they even told me that they had already refunded me even though I have proof that they did not. I have been battling this company, along with my insurance company, for over 2 months now. All I want is my money back. In my attachments, I have included (1) PROOF of the 2 payments I made to McClain Bros. (where you can also see that I never received a refund back from them); (2) A photo of the giant hole they abandoned in my basement - with raw sewage underneath; (3) A receipt from the plumbing company that actually completed the work that was supposed to be done by McClain Bros.
