    My husband and I are currently residents at ********************, Apartment ***** in Akron, PA, a property managed by Wolf and Kline. Our lease is month to month, but they require a 60 day notice upon lease termination. We are in the process of purchasing a home and, due to the competitive market, the seller requested a 30 day close. We are set to close on the home November 17th, at which point we will be working on moving our belongings into the new home. We are so excited to finally be purchasing a home of our own We provided our current property management company with notice of our planned move for the end of November on October 25th, this was the earliest notice that was possible for us to provide. We understand that our lease requires a 60 day notice, however, in our current situation, this was not possible. Had we asked for a longer close, we likely would not have gotten the house that we are purchasing.We have made multiple, respectful requests for negotiation on this matter, including lease termination on November 30th, lease termination on December 15th, forfeiting our entire security deposit, etc. However, they are unwilling to compromise at all. They are also requiring that we keep the utilities on in our name in the apartment through the end of December. While we plan on being moved out of our apartment and into our new home by the end of November, they insist that we keep the utilities on in our name. They intend to show the apartment to potential residents through December. Any showing that takes place in the month of December will involve the use of utilities that we will ultimately have to pay for, while we will no longer be residing there.Additionally, we have remained respectful tenants throughout our tenancy. We have always paid our rent on time, we are careful to be quiet and mindful of our neighbors, and we have kept the apartment in good condition (aside from normal wear and tear). We clean regularly, and have taken great care of the apartment.

    As *** ****** acknowledged, the lease agreement signed by ***** and ******* ****** for the rental property located at *** ****** ******, Apartment ***, Akron, PA *****, does required a 60-day written notice when vacating a property. Wolf & Kline does not own any of the properties we manage which is why it is imperative to be consistent with how we enforce our policies.  We do recognize that the current home buying process can be expedited rather quickly in today’s market however that does not allow us to waive the written contract we have in place for our clients’ properties.

    The ******* provided their written notice to our office on October 25, 2023 and requested to be released from their lease agreement no later than November 30, 2023. We did enforce the standard 60-day notice policy which resulted in an end date of December 23, 2023. *** ****** then reached out via email on October 27, 2023, again explaining their home buying situation and requested to have the lease agreement end on December 15, 2023. *** ****** was informed that same day that we were willing to be flexible with his request and were ok to end their responsibilities on December 15, 2023. This arrangement is allowing for the lease agreement to be ended 8 days early and will be saving them $360.00 in rent as well as the utility charges for those final days that otherwise would have been owed.

    If needed, we can provide a copy of the ******’s lease agreement that will reference the policies in question about the 60-day notice to vacate and the tenant being responsible to pay for all utilities and services until the last date of responsibility.
