    I saw an ad for a used *** *****  compact tractor for sale on the website for $5900. It was listed as being in excellent condition. I contacted them and found out the mower deck was not operational and that the bucket was bent. I told them that if they could fix or replace the bucket that the mower deck did not matter much to me. I was told that they were going to check the tractor out and let me know when it would be ready for sale. I was contacted today and said that the tractor now has transmission problems and they will not replace or repair the bucket without raising the price. I told them that the posting in their website said excellent condition and they said that was done in error. They have since changed the listing to say fair condition not excellent condition. This is false advertising in my view because with a tractor a bent bucket makes it pretty much unusable to anyone without extra cost, not to mention the transmission problems and the unoperatable mower deck.. I talked with ****** and he told me at first they would work with me to complete the purchase. They made a lot of promises and now they are backing out of. I have a copy of the posting saying excellent condition and believe they are commiting fraud and bait and switch. I believe this is not the first time they have done this to customers. I believe that this company should honor their employees statements and make the necessary repairs to the transmission and fix or replace the bucket so they can honor their claim if it being in excellent condition as they stated. If the mower deck is not operational then they should adjust the price. If these were done I would buy the tractor.

    The person that lists the used equipment here is not a mechanic, so as a courtesy to the customer, we will try to check it out and let the customer know if there is anything that the shop found wrong with it. At that point, we can choose to fix it or sell it as-is. The tractor in reference here has not been in production for quite some time, and unfortunately, some parts are obsolete, which contributed to our decision not to fix it up and therefore was sold as-is. As the owner of this piece of equipment, I reserve the right to fix it or sell it as-is. The fact that we told you what was wrong with it, should make it obvious to the BBB that we are not out there to take anyone across. It is similar to an auction advertisement, where it is common to say that "any announcements the day of sale take precedence over anything advertised" and that is the same thing here. Another way to look at it: if a car dealer advertises a used car for $10,000, and while I am test driving it, the engine or tranny gives out, they are not obligated to sell me the car at the advertised price after putting a new engine in. In fact, I'm not certain that they have to sell me the car at double the asking price if they decide they want to send it to an auto auction or something like that. In other words, just by advertising something does not prevent the seller from changing his mind and keeping the item if that's what he feels is the best thing to do.

    In April of 2022 I bought an atv from Perry Power Equipment. On may 23rd I took it to my local and trusted shop to be looked over. The atv ended up needing extensive work totaling $4,000. The problems were all obvious issues I can provide copies of the work done. I barely rode the atv, I never even got the chance to get insurance on it meaning I cant ride it off of my own property. Mileage from when I bought the atv and when it left the repair shop are recorded. I attempted to contact the owner of Perry power and the sales manager who sold me the atv and neither responded. I even provided them with copies of the repairs. No issues with the atv were disclosed at sale. Keep in mind I havnt even fixed all the issues due to the already massive repair bills.

    ****** sent me an email but did not request that I contact him back although it was on my to-do list to reach out to him. As you can tell by our website, www.**********.com, we are a lawn mower and tractor dealer and not an ATV dealer. We do get some ATV's that are traded on tractor's but we do not pretend to be experts on them. It was driving and working fine as far as I could tell when I listed it and ****** also test drove it before he bought it. We do offer to buyback machines at the selling price if there is a problem, however, I was not contacted about any issues till after the repairs were made.

    Sorry about the delayed response. I am involved with building a new school and there are alot of deadlines which makes it pretty hectic right now with school starting in a few weeks. But I do want to help you even if there are things that could have been done differently.
