      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.


      My dispute with the company is that in discussions with the salesman I made it very clear that I wanted doors with the steel building and was led to believe that they would be included. I asked twice about the doors and was assured they would be included. The preliminary quote lists the two doors required. I already had a quote from another distributor which included doors and would not have purchased the building from Olympia without the doors being included.

      I feel strongly that the salesman misled me and then pressured me to sign the contract immediately or I would no longer receive the pricing quoted. In speaking with the representative of Olympia I acknowledged that the doors had been removed from the final contract but were in the preliminary quote. They are highlighted on the preliminary quote I provided. 

      On the preliminary quote the description reads " (1) 10 x 10 roll up" followed by "(1) 3 x 7-man door."   However, on the final contract the wording was changed without anyone telling me that the wording had been changed. My issue is with the deceptive practices used by the company to get me to buy their building.

      I feel that Olympia should refund me $1500.00 so that I may purchase the doors locally.

While speaking with *** he refused to listen or help me with my concern, he was taking it very personal, he said he spoke for everyone within the company and no one else would do any better with helping me with my concern. I did ask *** if calls are recorded to go back and check **** and I conversation about the doors and he said calls are not recorded, he also stated he didn't have a copy of the preliminary estimate to look at. I was not treated fairly with my purchase and all I was wanting was a resolution to the doors I was told that I was receiving with the building. I want a refund for the (2) doors I was promised when speaking with **** and I will just purchase them somewhere else. Why would anyone order a building without doors, it's just not logical? If something is not done about this in a timely matter I will be forced to take other steps involving an attorney along with all notes, conversations and quotes. I expect the company to stand by what I was sold on

       On February 26, 2025, Mr. ***** and Universal Steel Buildings Corp. t/d/b/a as Olympia Steel Buildings (Olympia) executed the above attached Purchase Order and Terms and Conditions (Contract) for the purchase of a 25' x 30' x 12' pre-engineered steel building (Steel Building) for the sales price of $15,000.00. On May 26, 2025, Olympia delivered Mr. ***** Steel Building.

      Mr. ***** filed BBB complaint (Complaint) is that a 10' x 10' roll up door and a 3' x 7' man door (Doors) were not included when his Steel Buildng was delivered. However, as noted on the top half of Page 1 of the above attached Contract that specifically states that no Doors were included in the purchase of his Steel Building. Additionally, when Mr. ***** filed his Complaint, he attached a partially executed Contract (not signed by Olympia) and a quote emailed he received from our sales representative. Neither the partially executed Contract or the quote includes the Doors for this transaction!

      Oddly, yesterday in a call with Mr. ****** he acknowledged to me that the Doors were not part of "the deal". I then asked why he had filed a Complaint. His answer was "that he needed help with purchasing the Doors"! I assured him as did the sales representative in his earlier calls this week with Mr. ***** that we would continue to assist him in purchasing the Doors at cost plus freight.

      In the meantime, based on the above uncontroverted facts, the BBB must close their file as to Mr. ***** filed Complaint.

      On February 21, 2025, Olympias sales representative spoke with Mr. ***** about purchasing a steel building. On that same date, the sales representative emailed to Mr. ***** Olympias attached Quote for the purchase of a steel building which Quote made NO REFERENCE to the purchase of a 10 x 10 overhead door or a 3 x 7 service door. Later that same day, Olympia emailed Mr. ***** a Purchase Order and Terms and Conditions (Contract) which Mr. ***** signed and dated his signature February 21, 2025. You will note the attached executed Contract also makes NO REFERENCE to a 10 x 10 overhead door or a 3 x 7 service door included in the purchase price of Mr. ***** steel building!

      In ************** 23, 2025, BBB response, second paragraph,he states: The preliminary quote lists the two doors required. In the third paragraph he states: On the preliminary quote the description reads: (1) 10 x 10 roll up followed by (1) 3 x 7-man door.However, on the final contract the wording was changed without anyone telling me that the wording had been changed.  However, the written proof described in the above first paragraph by Olympias attached Quote and Contract to this response irrefutably proves otherwise. Mr. ***** has misrepresented the truth. Our sales representative has advised me that not until after the steel building was delivered on May 26, 2025, did Mr. ***** first raise his issue of missing doors.

      It is Mr. ****** not Olympia, who has been deceptive by filing his BBB Complaint containing multiple misrepresentations of facts that are contradicted by Olympias attached written quote and executed Contract.

      Accordingly, Olympia requests that the BBB close its file predicated by Olympias attached irrefutable written proof and as further noted above.

      Olympia Steel Buildings and I can write letters back and forth, indefinitely. Did I sign the contract as presented, yes.  But I absolutely believe that I was misled by the salesman into believing doors were included.

      The facts are, I asked the salesman twice if the building came with doors because that was a priority for me, and both times the salesman answered in the affirmative. When the preliminary quote was sent under Framed opening sizes there is listed (1) 10 x 10 roll up, (1) 3x7 man doors.  This describes doors not opening size.

      When I again confirmed that doors were included, I agreed to the price and a contract was emailed to me. I did not notice that the wording was changed to 10x10; 3x7 and doors were not included.

      No mention of the doors was made until the arrival of the building in **********, ******* because the expectation was that doors were included and upon inspection of the building package none were found.

      When asked to review a tape of the sales conversation I was told that they did not have any.  Had Olympia had such a practice it would be clear that I asked several times about doors and was assured the building came with doors. I would not buy a building without any doors.

      If Olympia looked at the preliminary quote they would see how I was misled into believing doors were included and then signing the contract. If Olympia would look at the actual facts and quit concentrating on saying I am misrepresenting the facts and saying it is not in the final contract they would clearly see that I was misled. I understand now that the doors had been removed from the final contract, and no mention was made to me that the contract was re-worded.

       My grievance is not with the final contract; my grievance is with how the wording was changed from the preliminary quote to the Final Contract and with their salesman misleading me into believing doors came with the building.

      We can continue this back and forth many more times just saying the same thing in different ways. So, in an effort to bring this to an amicable conclusion I would be satisfied if Olympia would send a check to me for $750.00, the cost of doors I can purchase locally,

      ****** ******* $2.57 per square foot. All of the metal siding on my building would need 2000 ft.. So the siding metal is worth approximately $5,000. When I told *** about my concerns, he just told me that that was the price. Then he stated that I wouldnt get my $500 partial payment back if I didnt agree on the new price or went with the old price of $16,500 that I cant afford at the moment. The payment of $500 was in no way a down payment of any kind. I have receipt proof that states it was for a payment towards the building. I have asked *** several times for my $500 payment back since they wont accurately adjust the total payment for the product Im receiving. They act like theyre doing me a favor by dropping the price $1650 for siding that cost over $5000. It feels like theyre just trying totake advantage of the situation since they have $500 of my money.

      1. Talked to the salesman about buying a building and he made the conversation about cost for the building and builder. I had to put down a $15,000.00 deposit to continue. Worked on the particulars and hung up. Called him the next day so I could get the builders name. He said they dont build them! I then said I wanted my money back and was informed that it was a non refundable deposit. They then cancelled my building and thought I was going away. I called two weeks later to find out they didnt order the building and made it out like they were keeping my money so I said I never cancelled the building.

      Mr. ***** BBB complaint (Complaint) has been filed in bad faith. It is vague, non-specific and is a misrepresentation of material facts. Until the filing of Mr. ***** February ******, Complaint, and for the preceding approximately last 5 1/2 months, Olympia was not aware of any issues with his purchase or delivery of his steel building.

      Here is the back story: On April 23, 2024, Universal Steel Buildings Corp. t/d/b/a Olympia Steel Buildings (Olympia) and Mr. **** executed a Contract for his purchase of a 30x 60 x18pre-engineered steel building for the purchase price of $27,500.00. A copy of the Contract has been attached and marked as Exhibit A. Shortly thereafter, on May 13, 2024, a Change Order was executed by Olympia and Mr. **** wherein he purchased two (2) 12 x 12 overhead doors for the price of $3,007.20. A copy of this Change Order has been attached and marked ************* June 26, 2024, a signed and a sealed set of engineered construction drawings (Drawings) were emailed to Mr. ***** Copies of these Drawings are attached and marked as Exhibit C.  On August 22, 2024, a 2nd Change Order was executed by Olympia and Mr. **** where he purchased R19 6 insulation for the roof and R13 4 insulation for the walls for the purchase price of $5,910.00. A copy of this Change Order has been attached and marked as ************* August 27, 2024, Mr. ***** building was delivered wherein he executed the Bill of Lading acknowledging receipt of the materials and components.  A copy of this Change Order has been attached and marked ******************* made three (3) purchases from Olympia in a span of four (4) months and four (4) days and received a custom-made pre-engineered steel building with the following warranties and specifications listed below and noted in Exhibits A and C respectively.

      Warranties:

      60-year Limited Warranty on steel beams.

      40-Year Limited Roof Perforation Warranty: Olympias roof coating is AZ55 Galvalume and requires no maintenance or painting to retain its original luster. It is comprised of 55%aluminum, 44% zinc and 1% silicone with the greater aluminum content creating a higher resistance to rust. There is a

      40-year limited rust-through perforation warranty on the roof panels.

      40-Year Limited Paint Warranty:The paint manufacturer and Olympia offer a 40-year limited warranty on wall panel paint against cracking, flaking and peeling. The Kynar paint applied is siliconized polyester over a substrate-galvanized coating providing further protection against rust. Paint reflects infrared radiation up to 70%. Less solar energy is transferred to the interior of the structure and saves cooling costs up to 20%.

      30-Year Limited Paint Warranty:The paint manufacturer and Olympia offer a 30-year limited warranty against chalking and fading. The paint is siliconized polyester over a substrate-galvanized coating providing further protection against rust. Paint reflects infrared radiation up to 70%. Less solar energy is transferred to the interior of the structure and saves cooling costs up to 20%.

      1-Year Limited Steel Building Warranty: Covering materials and components by replacement and/or by repairing same.

      Limited Lifetime Stainless Steel Fastener Warranty: Engineered for rapid drilling, Olympias self-drilling stainless steel capped roof fasteners are supplied with an assembled neoprene washer and carry a limited lifetime warranty against rust. The fasteners provide a watertight seal, are composed of 18 parts chrome and eight parts nickel and will not rust, tarnish, turn gray or black as those made from other alloys. Stops over drilling and tearing of sheeting, cracking of paint and less solar energy is transferred to the interior of structure.

      Materials:

      26-gauge steel

      Galvanized primary and secondary framing.

      Complete Trim Package:
      Olympia provides a complete trim package to enhance the beauty of the building. This package includes Jtrim to cover cut edges of wall panels around door openings, jamb covers for the galvanized jambs and a header.

      Base Trim Package:
      Olympias base trim package completely seals the bottom of the building against all leaks. The trim on the bottom of the building matches the trim on the rest of the building creating a beautiful structure and is included at no additional cost. Also Including a zinc coating (not a primer) is applied on all secondary framing for protection against rust and corrosion. This consists of all rafters, purlins, girts, base angles, eave struts, overhead doorframes (jambs and headers).

      Foam closures:
      Sit on the eave strut and trim preventing leaks.

      Mr. ***** total purchase price was $36,418.08 plus sales taxes which he has paid to Olympia. His Settlement request is $36, 000.00! For what? He already has a beautiful custom-made color coordinated pre-engineered steel building including doors, insulation, the industrys top of the line materials, components and warranties for a price, that few, if any manufacturer or producer could offer in todays U.S marketplace.

      Since Mr. ***** filing of his Complaint on February 5, 2025, on February 6, 2025, and on February 12, 2025,I reached out to him by email and text. Also on February 12, 2025, I called ******* and left him a voicemail message. His sole response by email on February 12, 2025, was that he would respond to me only when he was offered a suitable settlement.Again, I ask the question for what?

      As noted in my first paragraph above, Mr. ***** filed Complaint is in bad faith. It is vague, non-specific and misrepresentative of material facts. It is also unconscionable, indefensible,baseless, frivolous, ludicrous and absurd.

      Accordingly, and respectfully,Olympia requests that ******************* must be dismissed forthwith and his BBB file closed.

      What will the makeup of the exterior of the wall be?  We see masonry and vinyl dutch lap siding.  Is this material going to be attached to the exterior panels?  If yes I will need their specs and weights please.
       

      Are there any required deflections for interior fit outs and weights, purlins or girt spacings, etc. Details please.
       

      We are showing a collateral load of 5psf.  What is this for?
       

      Please confirm these are the codes you need:  ************************** 2021 based on IBC 2021 (7-22 loading).
       

      Your drawings page 4a show R-15 walls and r-30 roof.  It will be your responsibility to makes sure that the building is insulated to meet these requirements.  We do not calculate the overall thermal efficiency of your building.
       

      Drawings show stairways and interior framing by others.  What is the loading for the mezzanine?  Specifically what is its collateral load and live load call outs?
       

      Also with a 26' -6" wide ***** in a by pass condition for masonry walls the adjusting of the ***'s will need review.
      Standard are 3'-0" from the corner with 1'-0" between them. (3'+10'W+1'+10'W+3' = 27'-0") This could be possible but side door clearances or straight main frame columns might be required. The other issue will be the top of mezzanine and mezzanine framing interfering with the *** tracks. Right now the change to a 10'W x10'H will also have issue if the top of mezzanine is at 11'-10 1/2" per the clients drawings. Page 4c. Typical *** runners required 15" clear on a low rise system.

However, please note that Mrs. ****** filed her BBB complaint under her name and not American *****************, who is the Buyer named in the above Contract.

      Please be advised that American ***************** and Universal Steel Buildings Corp. have mutually reached an amicable settlement wherein Mrs. ****** signed off for American ******************

      ***** ***** promised me with a building permit on November 1st which they failed to provide me with so I can pay in person on November 1st to continue with the process and they stopped responding so thats why I filed a complaint with BBB on the advice of *********** police department.

      As indicated in Seller's above 11/25/24 response to Buyer's BBB complaint, the Parties mutually reached an amicable written executed settlement of the issues. 
      Attached is an executed copy of the Cancellation, Settlement and Mutual Release Agreement (Release Agreement), dated November 22, 2024, whereby the Buyer and Seller terminated their Contract at Section 1. At Section 2 of the Agreement, Seller credited Buyer's American Express Card (AMEX) $2,500.00, which monies represented one-half of the $5,000.00 deposit (Deposit) received by Seller pursuant to the attached Contract. Please be also advised that pursuant to the Parties attached Contract, that at the bottom of Page 1, the fourth sentence above the signature lines states: "Upon acceptance by Seller the Buyer shall not be entitled to a refund of the whole or any part of any payments made to Seller." However, as a matter of courtesy to the Buyer, Seller, having no legal obligation to the Buyer to do so, credited Buyer $2,500.00 to its Amex account pursuant to Section 2 of the Parties attached Release Agreement. A copy of Seller's November 25, 2024, Amex $2,500.00 credit receipt is attached. 


      Shortly after the above Release Agreement was executed by the Parties, the Seller received the above attached credit dispute notice (Dispute Notice) in the mail from Amex, dated November 20, 2024, and received in our offices on December 2, 2024, wherein the Buyer had also filed a credit dispute with **** in the amount of $5,000.00 which monies represented the Deposit that Seller received from the Buyer as above noted in their Contract. Please note on the Dispute Notice that Amex on November 20, 2024, charged back $5,000.00 to Seller's **** account. Inexplicitly, the Buyer in bad faith signed the Release Agreement two (2) days later on November 22, 2024! Once the Buyer filed its Dispute Notice claim with ****, Buyer breached Section 3 of the Release Agreement, which provision, pursuant to the Contract, waives all Parties claims against each other! In violation of the Release Agreement, the Buyer incomprehensively continues to file additional baseless grievances with the BBB and refuses Seller's written demands for it to drop its pending dispute with AMEX notwithstanding that the Parties had already executed the above attached Release Agreement. ****** has recently filed its response to the **** dispute and has provided them with a copy of the Release Agreement. 


      Consequently, what we have here is that the Buyer has knowingly double-dipped its claim against Seller with Amex and Olympia Steel Buildings. To date, Buyer's repetitive and continuous filings against Seller with Amex and BBB are illegally pursuant to and they are predicated by Buyer's breach of Section 3 of the above-mentioned Release Agreement. 
      In this matter, Olympia Steel Buildings has acted professionally and with sensitivity to the Buyer. On the other hand, Seller alleges that the Buyer has fraudulently, willfully, intentionally and unconscionably breached Section 3 of the attached Release Agreement and continues by its misconduct to this date by doing the same. 
      Accordingly, Seller respectively requests that the BBB, "and in all fairness" to the business interests of Seller, that they close its file as on this matter.

      I ordered a steel building from Olympia buildings McKees Rocks PA. When talking with sales manager Joey ********* * who was very informative and nice ( in the beginning). He told me that they have builders that they work with that install my building for an additional charge. He stated they are just right across the river from you. To put up my building it would be approximately 4500.00. So my building is scheduled to be delivered at the end of August. Mr ********* will not answer my phone call. I have left several messages, he will not call back. Now I have no builder. Olympia Steel buildings defraud people and say things to make it sound good so you will purchase a building and then blow you off after they get their money .

      On August 14, 2024, ***** ******* (Buyer) and Universal Steel Buildings Corp. t/d/b/a Olympia Steel Buildings (Olympia) executed the attached Contract for the sole purchase and delivery of a pre-engineered steel building with the dimensions of 15.3’ wide x 56’ long x 10’ high for the sales price of $19,900.00 as reaffirmed on Page 1 of the attached Contract.
       
      Shortly after the execution of the Parties Contract, the Buyer did indeed discuss with Olympia’s sales representative (Sales Rep) of her need to secure the services of an Erector. Our Sales Rep specifically told the Buyer if she could secure an Erector locally, her cost would be around $5.00 a square foot which = $4,284.00 slightly less than the $4,500.00 noted Buyer in her complaint.

      In Buyer’s complaint filed August 16, 2024:

      She states: “So building is scheduled to be delivered at the end of August. The Sales Rep “would not answer my phone call. I have left several messages, he will not call me back.”

      We have checked the Sales Rep phone logs which go back to May 30, 2024, and there are no calls to date from Buyer.

      Notwithstanding the above events, Senior Management has already reached out to the Buyer and gladly assisted her as well as provided her the name of an Erector. The Erector and the Buyer have verbally agreed for the Erector to install Buyer’s Steel Building and insulation. The written contract will be drafted by the Erector and will be executed solely by Erector and Buyer.

      Olympia has stepped to the plate and has addressed Buyer’s BBB complaint issue and will continue to assist her to the finish line.

      In the interim, Olympia respectfully requests that the BBB to close its file on this matter.

      On April 1, 2024, Universal Steel Buildings Corp. t/d/b/a
      Olympia Steel Buildings (Olympia) and ***** ******* (Buyer) entered into a
      Contract wherein Buyer agreed to purchase from Olympia a 40’ wide x 62’ long x
      16’ eave height pre-engineered metal building (Steel Building) for a sales
      price of $36,000.00. The Buyer paid a deposit to Olympia in the amount of
      $10,800.00 with a balance due of $27,630.00 (COD) upon delivery of his Steel Building.
      On April 10, 2024, Buyer executed a Booking Letter confirming the COD amount
      due and a delivery date of July 1, 2024.

      Coincidentally, prior to the above executed Contract, Olympia
      had executed two (2) other Contracts with each Buyer’s name of “***** ********
      for a total of three (3) Contracts with same Buyer’s name but from three (3)
      different states! Unfortunately, one (1) document from one (1) of the of the
      other ***** ******* deals was misfiled in this Buyer’s file.  At 11.51 a.m. April 11, 2024 (one (1) day
      after Buyer executed his Booking Letter), our Customer Services Department (CS)
      mistakenly emailed Buyer that his COD had increased from $27,630,00 to
      $30,307.71. At 2:33 p.m. that same day Buyer emailed Customer Service 2:54 p.m.
      stating “why the increased cost”? At 2:54 p.m. CS emailed Buyer that Olympia
      had not increased the sales price. After business hours Buyer emailed CS at 5:20 p.m., 5:23 p.m., 5:26 p.m., 5:32 p.m., 5:37
      p.m., and 7:50 p.m. and then that evening filed a complaint with the BBB. On April
      12, 2024, and before business hours, at 7:56 a.m., Buyer emailed CS. At 10:33 a. m. this
      matter was escalated by email from CS to me. I was in meetings at that time but
      when they concluded I called and spoke to the Buyer at 1:22 p.m. and 2:53 p.m.
      Buyer was very agitated and had advised me that he had had a sleepless night. I
      apologized to him for Olympia’s unintended mistake and reminded him there was
      no way CS could have responded to his multiple emails more expediently since
      they were sent either after or prior business hours. I reconfirmed with him
      that his COD is $27,630.00 and delivery of his Steel Building is still on track
      for a July 1, 2024 delivery. The tension and the angst at the outset of our
      initial call took a 180 degree turn by the time our second call concluded. As a
      courtesy to the Buyer, I also reduced his COD by $250.00 from $27,630.00 to
      $27,380.00 which he sincerely appreciated.

      Frankly, Olympia was and continues to be timely responsive to
      any of Buyer’s inquiries.

      I find it very odd that the Original reply was done by a contractor who Apparently has no affiliation with this Company. I have screenshot of the original message. And then it was changed by another person within olympia steel company. This shows clearly how shady of a company they are. I have numerous items that were incorrect or are missing brackets. That they could even say we're from another building. The building company sent damaged parts and the wrong building materials for numerous buildings. They didn't send the clips. They didn't send the right girders. Which I have a picture of which I will post if necessary. About one side having the bracket in the other side. Not I have brought this to their attention. And they basically ignored me and wouldn't answer my calls or messages.

      As we discussed earlier today, I prematurely and inadvertently hit the “Proceed Button" in the BBB program before I had completed my response. Please also have this introductory paragraph included with the filing of the below full response. Thank you.

      On April 10, 2023, Universal Steel Buildings Corp. t/d/b/a Olympia Steel Buildings (Olympia) and *** ***** executed a Contract for the purchase of a 40’ x 50’ x 14’ pre-engineered metal building (Steel Building) for the sale price of $48,150.00. It is apparent that *** ***** filed a complaint with the BBB that is deceitful and a misrepresentation of any material facts.

      During the course of this transaction, Olympia’s Customer Service Team (CST) and this respondent had multiple interactions by email and by telephone with *** *****. On multiple occasions he stated to us that “I do not know what I am doing“ which in itself was strange, confusing and difficult to comprehend. He did complain about damaged materials and components delivered by Olympia specifically the ridge caps, trim, door jambs and underneath panels. Upon closer inspection of photos provided by *** *****, it was determined by CST and *** ***** that there were no damaged materials and components which is a 180-degree reversed position from his complaint!

      However, when the erection company arrived at the jobsite, and after completing their inventory of the delivered materials and components, they advised *** *****, who advised Olympia, that the corner pieces for the Steel Building were the wrong size. The correct size corner pieces were promptly ordered by Olympia and delivered to the jobsite.

      Below is the written report and above attached photos furnished by the erection company relative to their installation of *** *****’ Steel Building. Except for the above noted mis sized corner pieces, their report confirms that the Steel Building was erected as contracted with *** *****, using all the materials and components delivered by Olympia to the jobsite. With an impending storm to hit Maine, the report also states at the request of *** *****, that the erection company returned on short notice to the jobsite to install the corner pieces wherein *** ***** thereafter refused to pay the erection company their final payment due in the amount of $5,000.00 which to date remains unpaid. Otherwise, I will allow the below erection report to speak for itself:

      “We were contracted to erect a building for *** ***** and upon arrival we had determined the anchor bolts were not located as per plans. Brandon, the crew leader, had a discussion with the owner, letting him know we could either leave and he get the anchor bolts right, we could install the anchor bolts for an additional fee or we could install using as many of the right bolts possible and he could get his concrete guys out there to fix anchor bolts. He agreed to having his concrete guys due it later because they "screwed" up a lot and they have other things to fix and he didn't want another delay.  

      We moved forward erecting the building. On our contract we do the work then invoice the customer in progress payments.  The owner stalled out in paying in a timely manner and then proceeded to discuss the amount we were charging for erecting the building with the crew, which was the first sign he wasn't going to pay. He then proceeded to complain to Brandon that I was expecting the progress payment. Anyways, very inappropriate conversations to have with my workers. Moving forward, he paid each installment as it was completed and we erected the building and he did nothing but compliment the crew and complained he was going to have lawsuits with everyone else and we were the only ones.....typical owner trying to encourage the workers. We did find the corner pieces were not the right size and upon completion of the building let the owner know. He called Olympia and they indicated they would get new corner pieces created and sent out asap.   Owner was happy with building but didn't feel he needed to pay the final installment because he was concerned we would not make it back up to Maine to install the four corners.  Last week he called and said Olympia sent the corner pieces and a big storm was coming. He was worried the building would get damaged if the corner pieces were not installed immediately. I had Brandon on a jobsite seven hours away and had him close up that jobsite and drive directly to Maine to get those corner pieces on. Brandon arrived the next morning installed the corner pieces and owner was satisfied. I invoiced owner again and he delayed in his response till he finally said he was hoping we would just call it even because of the scratches on a panel, I explained he owed over $5,000 and that was well over the value of a panel. Time goes by and he starts to send texts about all the problems with the building and how he is going to sue everyone. It was well over 3 weeks from the time the building was great to now the building is horrible and he wants my insurance and is going to file a lawsuit against JCS too. He reached out to Brandon today asking for details saying he wouldn't tell anyone if Brandon would share the company insurance etc.    

      I offered a payment installment plan to get the final amount paid. He said no, see ya in court! In the end, I do think it is all about the money, not the building or workmanship. If there are scratches other than the one panel,  they happened after we left. I have attached the pictures of the project. Brandon and same crew finished a project in Maine the job before this and another in New Jersey right after. Both customers are willing to talk to anyone about the quality of work, they were pleased and tipped the crew for a job well done!

      Please note that ****** ***** stated in his Complaint and
      Response the following:

      (A)
          “they sent pieces
      that weren’t even for my building that you could tell they recycled for another
      project, there were lots of universal pieces with lots of holes drilled in
      them. They sent pieces that didn’t even belong to my building.”

      The above statements are false and
      misrepresentative. On multiple occasions, whether by
      telephone or emails, *** ***** stated to members of our Customer Services Team
      and to me that he had “no idea of what he is doing” (referring that he did not
      understand anything about Steel Buildings) I have attached an inter-office
      email, marked Exhibit A, which confirms his statements as just noted in the
      prior sentence. But if *** ***** has no knowledge of steel buildings, how does
      he justify his statements in paragraph 1 above.
      By the way, the holes drilled
      into the materials are not due to negligence but intentionally to provide the
      necessary space for attaching screws, bolts, fasteners, etc.

      (B)  
      *** *****
      further stated in his Complaint that: “And then tried to claim that I stole
      clips from old building.” What does that statement even mean? Why would any
      Olympia Steel Buildings (Olympia) employee ever have a discussion with *** ***** stealing clips from his “old building” when that assertion has no
      relevance or materiality to the recent production of *** *****’ Steel Building
      purchased from Olympia. Prior thereto, Olympia never had a business
      relationship with *** *****. *** ***** is a very confused individual.

      (C)  
      In *** *****’
      Response he stated that:

          “The building company sent damaged parts and the wrong
      materials for numerous buildings.” I have attached Exhibit B, a copy of the
      Contract between Olympia and *** ***** which is solely for the purchase from
      Olympia of one (1) Steel Building 40’
      wide x 50’ long x 14’ high. Once again, a very confusing statement by *** *****.

         I have also
      attached Exhibit C which is the erection report prepared by JCR Construction
      Services LLC (JCR), dated September 21, 2023, who *** ***** contracted with to
      erect his Steel Building. On page 1 of that report Paragraph 2, second sentence
      states:

         “All of Olympia’s materials and
      components were delivered to Josh Lewis jobsite were in good order with no
      damages and timely installed accordingly without issue.”

      However, I must clarify
      JCR’s above quoted statement. Oympia acknowledges that there were some minor
      damages of materials and components delivered to the jobsite, but Olympia
      promptly delivered replacement parts and installation was not delayed but
      “timely installed” as noted in the erector’s above quote.

      As further
      noted in the erector’s report there were four (4) corner pieces which were the
      wrong size and were reordered from Olympia and were delivered were installed without
      any further labor cost by JCR in a return trip to the jobsite. The photos
      attached were provided by JCR upon completion of their installation.
