      4/1/- Contracted for installing an in-ground (vinyl liner) pool on our property within the fence line located at ********************** Hanover, PA ********. Building permit submitted to the township 5/15 - Excavation done, pool shell installed. We advised that the pool shell is out of the ground. Indicated that we purchased an inground pool, not an above ground. They indicated they are working on a solution.6/5 - Decided to build a retaining wall (36-40" High) as a solution to the pool shell is out of the ground on the backside. This was not in the plan nor permit. 6/10 - Existing fence had to be taken out as retaining wall was too tall made fence too s 6/25 - Concrete deck poured, aggregate coming through due to not finishing it correctly 8/18 - The contractor's electrician broke into our basement - filed a police report. 8/25 - Notified contractor of retaining wall is sagging. 8/27 - Liner installed, Pool water delivered 9/21 - Second notification of wall buckling due to improper installation. 9/23 - 15 ft portion of 40 ft retaining wall collapsed. 9/26 - Afford A Pool visited on-site with their mason to gameplan a fix. 11/16 - Communications from the company stopped and they will not fix it to code. As it stands we have an inground pool with a collapsed retaining wall and the pool could not be given a final inspection approval by our township due to the retaining wall issue. We retained a construction attorney, attempted a demand letter, and offered to negotiate a resolution and the company remains unresponsive. We tried submitting a claim to his insurance company but received communication on 7/15/22 that this claim was denied. As a consumer, we've been very patient and more than reasonable. The pool was dug incorrectly and as a result, needed a retaining wall solution that failed. Additionally, their retaining wall solution impacted us to have to remove the existing vinyl fence as the height of the retaining wall was 40" and the fence behind it was 48".
