    We hired Tito to remodel our bathroom. We found out about him through a good friend. He was there family member. He showed us bathroom he did and he looked like he did a good job, it did worry us that he wanted cash. But we felt that it would be ok because he was our good friends family member. I showed him the picture of the bathroom I wanted. He said no problem. I showed him the tile and grout he said no problem. He said the job would take 2-3 weeks to complete. He did the wrong design in my shower. I sent both him and his wife several pictures of the design and even before he started I said you are sure you know the design. When I questioned him he said he wanted to do something different what he knew I would like or something like that. He blamed me too that I should have caught it, I was trying to stay out of the bathroom because it looked like a war zone and I was disgusted! He didn’t get the grout off the tile. Even though I was stressing over that to him daily as well, I kept saying is that going to come off, he kept saying yes its going to come off. Well, it didn’t come off. The tile is ruined. Both on the floor and wall. There is a haze on both. And the products he used to try and clean the tile discolored they grout. He installed the shower door incorrectly and damaged it. The shower niche is different sizes and he damaged the sleuter. The shower is not sealed in several places. The shower is leaking. The plaster job is awful. He damaged my quartz countertop because he was laying his tools all over it. He spray painted in the bathroom so now my fan is not working. The whole job is just awful. I paid him 3/4 of the money. He wanted cash. We want him to turn the job into his insurance. We are getting bids of anywhere of 8000-16000 to repair and refinish the Bathroom. I don’t want him back in my house. I don’t think he knows what he’s doing. He was following me around my kitchen wanting the rest of the money on the final day, I didn’t I don’t trust him.

    Please be advised that this office has been retained to represent T&B Construction with regard to the above mentioned matter. Kindly accept this letter as a response to the customer's complaint. 

    1. T&B was retained to provide the following services: 

    a. 
    Demo: 
    Remove tub 
    Remove tile from tub area 
    Remover shower diverter 
    Remove toilet and sink 
    Remove tile flooring 

    b. Install: 
    Install custom shower pan 
    Install tile from floor to ceiling in shower area 
    Install new shower diverter 
    Install new shower drain 
    Install new shower doors 
    Install bathroom file floor 
    Paint bathroom Mudd if bathroom if necessary 
    Reinstall the toilet (unless customer wants to replace toilet) 
    Two cubbies install in shower area 
    Reinstall sink (unless customer wants to replace) 
    Install towel racks if customer chooses to 

    c. Materials provided by T&B Construction Waterproofing membrane for shower 
    Shower Pan 
    Plumbing 
    Motor 
    Hardware 

    2. The design of the tile was discussed between my client and the property owner. After a few tiles were set, my client discussed the design with customer who indicated she liked the design and to continue with work. The tile work took approximately five (5) days and each day customer reviewed the tile work without complaint relative to any design. After a discussion with a family member, she changed her mind. Text messages confirm her regular viewing of the bathroom during all phases of the job. 

    3. The tile was purchased by customer at Tile Source in Plum, Pennsylvania. She also purchased 
    the grout at that location. 

    4. The tile was a porous material and as such, my client indicated that it would be necessary to seal the tile prior to putting in grout between the tiles. Customer indicated that she did not want any sealer on the tile and that her conversation with Pro Source indicated that sealer was not required. 

    5. My client then installed tile as requested by the property owner and grouted with the grout provided by the property owner. The grout, due to the porous nature of the tile, stuck to the tile leaving an unpleasant appearance. 

    6. My client discussed this with customer and then went to Pro Source to discuss with the sales person that customer dealt with. My client even asked the salesperson why he would sell this product to a consumer for a bathroom install. My client and customer then contacted the manufacturer and got information about how to remove the grout from the tile. 

    7. My client then purchased all cleaning materials out of his own pocket to clean the tile and spent several days cleaning the grout from the tile. Again, the grout was chosen by customer, and she requested that it be used at all times. My client offered to regrout if customer would purchase a different gout. My client did not want to use the same grout due to the unpleasant appearance it left initially. 

    8. My client even offered to regrout the entire shower which customer refused. 

    9. Customer indicated at the beginning of the job that she had a top dollar that she could not exceed and therefore my client indicated a few items that he could do to try to save her money which included the plaster work on the wall. Customer did not want to spend the money to 
    have a plasterer come out and T&B indicated that he could attempt his best to match the plaster on each wall. After he left the job, and after the painting was done, Customer did not even mention any issues with the plaster in review of the job with her. 

    10. Customer complains about a bathroom fan not working. She attributes that to spray painting that was done in the bathroom. The only spray painting that was done was to paint the underside of a sink which was done in the bathroom; however, the fan was not running at the time. Prior to the start of the job, my client tested the fan, and it was in poor working condition. 

    11. The shower door was installed properly. Customer complained prior to the ending of the job that the shower door was installed improperly and prior to him leaving the job it was corrected and installed properly. She indicates that the shower door was damaged when it was installed; however, he was not aware of any damage and did not see any damage when it was installed. 

    12. The niche that she refers to was not damage when he left the job. 

    13. My client quoted Customer a price of $7,200 and up to $7,500 if she wanted lights installed above the shower. She paid a total of $4,500 to my client; however, the job was finished and item that was discussed was finished. She owes the remaining balance to my client.

In addition, my client had to do extra work which included an attempt to install an inset mirror that Customer changed her mind on due to plumbing behind the mirror location in the wall and had to reset back to the original condition. He also installed a toilet twice because the client changed her mind and purchased a new toilet in the middle of the job. He added no fees for the additional work. 

    15. Additionally, to help Customer, my client installed an extra shut off as well as cut the counter client tops. Customer never indicated she was unhappy with the extra work provided by my until the end of the job but paid $1,000 at the same time. 

    16. Although Customer said she would not bother the workers, she was constantly in the 
    bathroom while they worked making comments and texting T&B. 

    17. Customer also indicates that my client followed her through the house which is patently false. She walked down the stairs ahead of him as he was leaving the residence on his final day on the job. 

    My client also provided additional uncompensated work including adding a shut off valve for a range and cutting a countertop so the range would fit. 
    It appears from my lengthy discussion with my client about the work that was done, review of photos he took of the job, and emails and complaints from the property owner, that this matter is purely a civil dispute between the property owner and my client. He worked on this job for approximately a month and was at all times responsive to the property owner, including going out of 
    his way to speak with suppliers of materials. At the end of the job, Customer then spoke negatively about my client to his workers while they finished cleaning up the job.
