My 90-year-old neighbor presented me with a $25 gift certificate she purchased at Beer Mart (***************************************** ***********, **) as a 'thank you' for helping her around the house. Shortly after, we went into a lockdown for COVID. My neighbor passed away in November of 2020 at age 91. During this time, the gift certificate was put in my desk and I didn't realize I still had it until recently. When I went to redeem the gift certificate, I was told they would not honor it.I came home and reviewed the laws for Pennsylvania, regarding gift cards/certificates, and it is my understanding that my gift certificate should have been accepted because it is valid "for five years or more from the date of issuance if no redemption period is specified."I called the store back and asked for a contact number for the owner. In speaking with them, I was told they would not redeem the certificate because it was issued by the previous owner.I told them that according to my understanding of the law, when someone purchases a business they "assume liability for all business debts (including gift cards)". I made the analogy of a business having a lien against them. If it was not satisfied, the sale would not be allowed to go through as far as I understand.I was then told I need a receipt for the gift certificate. I do not have a receipt because I was not the one who purchased it and even if the woman who did was still alive, who would have a receipt from four years ago? They told me they would not honor the gift certificate without a receipt. I told them I do not believe you can require a receipt and that I would take it further if they would not honor the gift certificate. The only resolution I am looking for is to have my gift certificate honored because my neighbor spent $25, that she didn't have to waste on me, purchasing it because I would not take cash from her.*** ****** ************

    Business Response

    To whom it may concern,

On July 16, 2024, we received a letter from the ***************************** to which we replied with the letter, we have attached on this platform also. It was never disclosed by Seller (the previous owners) of the business that they used to sell out gift cards that is the reason why we are not honoring it.

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the response. If no reason is received your complaint will be closed as Answered]

I am rejecting this response because: The new owner purchased the business and should assume and accept ALL liabilities in the sale. They could easily contact the previous owner and verify the gift certificate is valid, since they are the ones that actually know who that is, but they refuse to do so because it is easier to not care.

It is a disgrace that a 92-year-old woman would spend $25 she didn't have and a business wouldn't honor it.  I have no idea who the previous owner is or how to contact them. A responsible business owner would take it upon themselves to make the situation right by first reaching out to them to verify the gift certificate's validity and then honoring it.

    Regards,
