      I consulted with Dr. C****** about a surgery. At first she was ok with it so I went ahead and paid for the surgery and scheduled a date. Two consults later she wasn’t wanting to do the surgery anymore so I asked for my money back since she was the one not wanting to do it anymore. She sent me back only 3,500 of the 4,000 I paid. To me this is stealing since I wasn’t the one who broke the contract and she no longer wanted to perform it. I have attached emailed conversation of her taking the money from the surgery that she didn’t want to do after I paid her for that specific surgery. She discussed doing a different surgery that was not anywhere near the same service. She also then didn’t want to perform that one either. Since she is fully admitting to not wanting to do the surgery she needs to refund all of my money paid toward that since she was the one breaking contract. I am fine with her keeping the initial $100 consult fee, but I am not ok with her keeping $500 of the surgery funds since she told me she didn’t want to perform it after I already paid well in advance. It’s unethical, stealing, and fraud.

      This patient paid $100 for a consult regarding 1 topic.  After 3 more no-charge consults, she signed up for a particular surgery. Our surgical contract notifies the patient that 25% of any deposit is non-refundable because we want only patients who are serious about undergoing surgery.  On a fifth consult, after I fully had informed her of the limitations of the original surgery she wanted, she changed her focus and started discussing another procedure. When we supplied her a cost for that, she balked and said she was cancelling all surgeries. Even though I could have kept $1000 of the 4000 deposited, I return more, holding back only $500 for all the effort and time we had extended to her at no-charge. At all times was I empathetic and patient, and in reality she knows the risk/benefit  ratio for the "deformities" she has to be corrected is high. She is beautiful and doesn't need this surgery.
