    The contractor has walked off the job without completing it. Our executed contract states "the third and last payment will be made once the job is complete." The contractor harassed me via text and an unannounced trip to my house to make a final payment before the job was completed. The contractor has now entered a civil complaint against me for $4,500.I sent a letter (delivery confirmed) of proposed final settlement on October 1, 2022. This was not responded to in any way by contractor. The letter listed the things that have not been completed. Some of these things include restoring the yard to its original condition before the work began. With assistance, I have completed these restorative measures because the contractor told me that he was finished and was walking away. (see text in attachments) In addition to these restorative measures, the contractor did not complete all of the contracted work which included the installation of a stone step on the existing sidewalk and the replacement of gate hardware that was not easily used by my children.

    According to the contract the job is done 100% done I do have a proof and that's why now we are in court and the customer he trying to look for excuse and he trying to get away with the las payment and I think he's doing the complain because he's mad because I bring him to the court. So please send me the letter on my email so I can get it back to you I'm a little busy right now that's why I haven't get it back to you.

    I am rejecting this response because: the job was not completed.

    I am sorry to hear that emotions are again clouding the judgement of this business owner.  I am not mad, as alleged, I feel very sorry for this person.  I tried to give business to this individual who lives in modest conditions, as a true attempt to do good in this world.   What a mistake about this person's character.  I have long since stopped trying to communicate in text messages, as I am unable to have an adult exchange with this person.  I have tried two times in settlement letters to get the business owner to finish the job that was not completed  The business owner has confirmed in his civil complaint (attached) that he has not completed the job, yet still continues to ask for the final payment.

    The last contact (delivery receipt confirmed) I made included a bank check payment of $3,250.  That letter is attached and again shows the work that he did not complete.
