      On 03/15/2022, I contracted 3rd Generation Design and Construction to install two (2) windows in a bedroom for $1,000.00 because the current window bases were decayed and had caused a leak to the ceiling below. A roofer confirmed the decay in the windows was causing the leak. *********************** was my point of contact with 3rd Generation Design and Construction. These windows were of poor quality and had to be re-ordered twice due to the seams separating, even though ************** did not see this as an issue. However, I was insistent that it was a legitimate complaint and would not accept them as is. I had to be persistent in getting a copy of the warranty for the windows. Installation was not completed until May 19, 2022, due to re-order of the windows and a $50.00 credit was applied because one of the windows was dented during the installation. After installation of the windows water continued to leak from the ceiling due to improper sealing. ************** attempted to apply sealant from the inside of the windows. There are bars attached to the outside of the windows which prohibited him from viewing the outside of the windows to apply the sealant correctly. Due to the bars on the exterior of the windows capping was not applied because he could not remove bars. There is stucco on the exterior of the building, and it was applied in lieu of the capping. The person completing the stucco stated it was his first time completing that type of work.I feel the workmanship of this installation was poorly done because both windows are allowing water to get in. I have reached out to ************** and left voice mail messages; however, he has not returned my call. A reputable contractor would return to inspect the workmanship of the installation. The contract states the installation is guaranteed for one (1) year. *************** has ignored my calls; therefore 3rd Generation Design and Construction is not in compliance with their contract.

      The leak is not coming from the windows it's emenating from the roof above the windows, which would require the services of a roofing contractor. The customer (*******************) never paid the full balance of the window installation contract and therefore voided any warranties.

      I am rejecting this response because:  I paid the full amount for the windows on 05/19/2022 as evidenced by the attachment.   Therefore, I am not in default and the contract cannot be voided. Roofing work has been accomplished and I have been told the windows require additional caulking.
