Commonwealth of Pennsylvania v. Austin & Amanda Smallacombe
The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency.
On April 22, 2024, Austin Smallacombe pleaded guilty to felony counts of theft by deception, criminal conspiracy to commit theft by unlawful taking, and receiving advance payment for services and failing to perform. On May 6, 2024, he was sentenced by the Court of Common Pleas in Bucks County to three to seven years in prison, ordered to serve a 10-year term of probation following imprisonment, and to pay roughly $118,000 in restitution.
On January 08, 2024, Amanda Smallacombe, Austin’s wife, pleaded guilty to misdemeanor counts of theft by deception, criminal conspiracy to commit theft by unlawful taking, and receiving advance payment for services and failing to perform. She was sentenced by the Court of Common Pleas in Bucks County to 60 days of total confinement, four months on home confinement with electronic monitoring, 40 hours of community service, and restitution.
According to court documents, the allegations underlying the guilty pleas included approximately 40 instances of taking deposits for furniture to be made by the couple, yet in most cases, consumers didn’t receive the furniture they ordered, and, in some instances, they received poor-quality furniture with numerous defects or promises for refunds which were not made.
