On 12/2/24 I contacted Bavarian Motors *** located at ************************************ about assessing my vehicle, a 2016 *** X6 due to me hitting a pothole while driving on my way work. I informed the person I spoke with that as a result of me hitting a pothole I was informed my vehicle was leaking fluids when I went to get my vehicle washed a *********** car wash, when I returned to the lube line to request an oil change after the car wash. I wash recommended by the auto shop lube supervisor to go to a specialist or dealership mechanic shop for foreign vehicles for assessment. I wash recommended able to make arrangements to drop the vehicle off on Friday, 12/6/24 at 9:30am. I presented my title of my vehicle and the mileage of my vehicle was recorded at the time of drop off. I informed the shop staff of the same issue I spoke to the owner anout , me hitting a pothole while driving that lead to my vehicle leaking unknown fluids. I was informed by the owner, who walked in prior to me leaving that an assessment would be done in about a week and I would be provided with an estimate for repairs. 4-5 days went by and I did not hear anything back and did not receive any updates. I called for an update and to receive an estimate to no avail. On 12/9/24 I received a text to contact Eden *********************** which I learned was the owner and received an estimate with no estimated timeframe of the repairs although requested. and was not able to be provided with onto call for twice a week for the two weeks for status updates as no outreach or communication was made on their end. Each contact after was initiated by me that was a short phone call with the owner talking over me. I was informed by the owner that my car would be ready by Fri 12/27/24 after testing if there were no issues. I was given the total cost that I elected to go through my insurance company. I informed the owner and he attempted to discourage me and tell me that my insurance company would not pay a claim.

Thank you for bringing this matter to our attention. We would like to provide a full response to the complaint filed by ****************** regarding her 2016 *** X6.
On December 6, 2024, Ms. ****** brought her vehicle to our shop, expressing concerns about an oil leak after hitting a pothole. Upon initial assessment, we informed her that her vehicle would be placed on the waitlist for further inspection. Ms. ****** indicated that there was no urgency, as she had an alternate vehicle to drive.
Upon inspection, we found that there was no physical damage to the vehicle from the pothole that would have caused an oil leak. Our team thoroughly examined the vehicle and identified that the source of the leak was a valve cover gasket and front crank seal, which are common areas that can develop leaks over time.
We promptly contacted Ms. ****** to provide the details of our findings and explained the necessary repairs. The vehicle was repaired and completed on December 23, 2024. On December 24, 2024, Ms. ****** decided to open an insurance claim to cover the repair costs.
At this point, we are awaiting the insurance company's review and approval to finalize the process. Ms. ****** is aware of the current status and understands that the next steps are contingent on the insurance company's assessment.
We apologize for any confusion or inconvenience Ms. ****** may have experienced. We are committed to providing the best service and working with her insurance company to ensure the repairs are properly covered. If there are any further questions or concerns, we are happy to address them.
Thank you for your understanding and for allowing us the opportunity to clarify this matter.
    Sincerely,
    Ed

    Customer Answer

    Good afternoon,

I had additional questions about my initial compliant.  Although I was contacted this morning by the business owner, of Bavarian Motors who appeared to be a little more pleasant and humble in explaining to me that he has communicated with my insurance company claims agent and elected to allow them to send a claims adjuster out to the business to assess my vehicle for any further damage underneath the vehicle.  My concern at this time is that the owner requested me to follow up with the Better Business Bureau to close out the claim, however, at this time I do not have a resolution.  During the conversation, the owner proceeded to remind me that I told him to take his time, as if I was not paying the business for a service.  When in fact I stated that I am aware that I am not your only customer, and I would like to know and be kept informed to know how to move forward.  The owner reminded me that I stated that I had another vehicle, as if I wanted the business to just to complete the repairs whenever they decide to get to it.  I am pleased that the business made outreach to me, however it does not appear that they have taken any accountability to date of the delay in providing me services in a timely fashion and further inconvenience me by delaying the process even further once I decided to go through my insurance company to pay for the services versus paying out of pocket.  The exact statement the owner said was " ********************** is not going to pay for the repairs".  I am not sure if this was stated to discourage me not to submit an insurance claim, when it was already submitted prior to me speaking to him and being informed of the total price of the services provided.  At this point, I am not and do not feel comfortable with closing out the claim until I have my vehicle, and payment has been completed by myself and the insurance company.   I am fearful of retaliation at this point.

I just received an additional phone call from the owner with an update of their assessment of what may have been damaged underneath my vehicle by me hitting a pothole a month ago.  The business and owner is currently waiting for the claims adjuster to come out to the business on Monday or Tuesday of next week.  My question is am I able to wait until I receive my vehicle to respond to the owner's response,?

    Unvalued Customer, ******* *.

     Complaint: 22755914

I am rejecting this response because:
My insurance company has completed their assessment and I was informed by the owner at Bavarian Motors that something else was found that needed to be repaired. I was informed of this prior to the insurance adjuster completing their assessment, so I do not understand why I have to be further inconvenienced and not have my vehicle repaired in a timely manner so that I can be able to drive it again.

On 9/29/2022 I dropped off my vehicle for a diagnostic check due to some recent issues I had been experiencing. I took my car there as I researched and found this shop had experience with ***’s the person who I had been talking to on the phone (I later learned was the owner) told me they would check car and get back to me. After 4 days of car being in the shop he informed me what the issue was and gave me a quote of $3000 + tax to repair valve cover, fuel pump, tune up, and an oil change. I didn’t have the funds so I asked him if his shop had any financing options he said yes absolutely we use **** finance, so I told him to give me sometime I would look into it, I applied and got approved for $3500 which was enough to cover repairs quoted. I then gave him the ok to repair vehicle and made it clear that I had gotten approval from **** finance to cover the repairs. After 2 weeks car is now repaired I attempted to use my credit with **** to pay for repairs, I then found out through **** finance he was not an active merchant with them. When I questioned him about it he went the same day which was 10/13/22 and applied to become a merchant with **** finance. Then told me that process should be done by Tuesday and everything would be fine to move forward with payment. It is now 11/1/22 I have been reaching out to owner of ship since last week with no answer. Today I finally get through to find out by his wife that they were denied by **** and couldn’t become a merchant, he refuses to take accountability for misleading me as a customer and scamming me. My car is now stuck there and I can’t get it back because I can’t pay him $3000 he states. This was not the original agreement and I made it clear to him day 1 that I could only pay for repairs with the financing option. This business should not be allowed to be open doing this to innocent customers.
