    I have been a season ticket holder for several years. I had previously been given credit for shows I was not able to attend. They would not do that for me this year stating it was only because of covid. This was not disclosed prior. They then told me they would credit my account. This was weeks ago and I have no credit in my account but they took my tickets away.

    I purchased tickets for ****** **** **** **** concert for June 17, 2022 as a Father’s Day gift for my husband. The concert was postponed rescheduled for June 23, 2023 which was also canceled. All efforts to get a refund have been futile. I’ve left messages at the ****** **** phone number but it always goes to voicemail and no one returns the call. Calls to the Kimmel Center are met with the response of “Sorry, I can’t help you!”. The tickets were purchased through Kimmel Center’s box office and their name is at the top of the tickets. Therefore, they should be held responsible for refunds.

    We are writing on behalf of the ******************************************* and Kimmel Center, Inc.(POKC) in response to your July 14, 2023 letter. We very much appreciate you bringing this to our attention as POKC is committed to ensuring a positive experience for all of its patrons. 

    *************** (the ****) is a separate entity from POKC and the Kimmel Center. Although tickets for **** performances are sold through Ticket ************, the Kimmel Centers ticketing service, the ****—and not Ticket ************, the Kimmel Center, or POKC—holds all funds from ticket sales.  In other words, the **** alone is in possession of the money that the guest paid for their ticket and is solely responsible for returning the guest's money. 

    By way of further background, the **** performs at the Kimmel Center pursuant to a license agreement with POKC and in exchange for paying a per-performance rent.  In January 2023, after more than five years of the **** repeated non-payment and delayed payment of rents the **** owed POKC, POKC suspended its license agreement with the ****.  This step was a last resort, taken only after the **** repeated and longstanding failure to pay POKC what it owed.  Initially, the **** publicly announced that it was rescheduling its remaining programming at another venue.  Ultimately, however, the **** announced that it was cancelling performances, including the June 17, 2022 ****** **** **** **** show.     

    We are very sorry to learn that the **** has not reimbursed the guest for the canceled show.  However, as noted above,the **** is solely responsible for doing so. We would encourage the guest to contact the **** to request a refund.  Unfortunately, as Ticket ************, the Kimmel Center, and POKC are not in possession of the guest's money, we cannot return it.
