  In October 2021, Tri-State Waste & Recycling dropped off and picked up a large dumpster on my driveway for work being completed on my house. Tri-State did not place wood planks underneath the dumpster. As a result, when the dumpster was removed, the dumpster scraped large and deep dents into my driveway. (Please see the attached photos). I immediately reached out to Tri-State and spoke with their attorney, Jeffrey M***. Jeffrey acknoweldged fault and offered to patch and seal the whole driveway. Unfortunately, due to incliment weather, the driveway work could not be completed in the fall/winter. Jeffrey agreed to have the driveway patched and sealed in the spring instead. He said to reach out to him in the spring to coordinate. I have emails documenting this correspondence. This past March, I reached out to Jeffrey several times via email and phone. Jeffrey failed to respond to my emails and calls.

  Hello,

  All customers are advised by staff that we recommend that you protect any surface where the dumpster is being placed with a couple of 4ft x 8ft sheets of plywood or 2in x 10in pieces of wood. Containers are place in driveways by request only, understanding that the average driveway is not meant to withstand the weight of the container or the vehicle delivering it. We cannot be held liable for damages to driveway.  This statement is also sent via email to all customers along with our rental terms. This particular container weighed 13.27 tons which is exceptionally heavy for a construction container rental. An independent contractor was unable to survey the driveway for damage as the paving season was finished. A survey was conducted March 2022 in which contractor could not locate damage claimed or signs of driver negligence.

  I am rejecting this response because:
  

  I TRULY HOPE THAT THE PERSON WHO RESPONDED FROM TRI-STATE WAS MISTAKEN AS OPPOSED TO PROVIDING FALSE INFORMATION TO THE BETTER BUSINESS BUREAU. 

  FIRST, I PROVIDED JEFFREY M***, COUNSEL FROM TRI-STATE WITH PHOTOS OF THE DAMAGE ON OCTOBER 19, 2021.  I HAVE CORRESPONDENCE FROM M*** WHERE HE ACKNOWLEDGES THE PHOTOS AND THE DAMAGE AND HE STATED THAT "ONCE WINTER IS OVER WE'LL GET THE DRIVEWAY HANDLED FOR YOU."  SECOND, I AM NOT AWARE OF ANY CONTRACTOR COMING TO MY HOUSE IN MARCH 2022.  TRI-STATE NEVER TOLD ME THAT THE CONTRACTOR WAS COMING, THE ALLEGED CONTRACTOR NEVER INDICATED THEY WERE ON MY PROPERTY, AND I HAVE A SECURITY CAMERA AND THE CAMERA NEVER IDENTIFIED AN UNKNOWN CONTRACTOR ON MY DRIVEWAY IN MARCH 2022.  AND, IF THE CONTRACTOR DID IN FACT COME TO SURVEY THE DRIVEWAY, HE WOULD HAVE FOUND THE SAME DAMAGE TO MY DRIVEWAY THAT I PROVIDED IN PHOTOS TO M*** (AND I UPLOADED HERE).  

  M***, COUNSEL FROM TRI-STATE, MADE A VERBAL AND WRITTEN PROMISE TO ME IN NOVEMBER 2021 THAT THEY WOULD FIX THE DAMAGE TO MY DRIVEWAY SINCE IT WAS CAUSED BY THEIR DRIVER.  IN FACT, M*** STATED OVER THE PHONE THAT HIS DRIVER WAS SUPPOSED TO PLACE THE WOOD UNDER THE DUMPSTER, AND HE WAS SORRY THAT THEY DIDN'T DO SO AT MY HOUSE. 
  

  TRI-STATE SHOULD NOT BE ABLE TO GET AWAY WITH CAUSING DAMAGE TO MY DRIVEWAY, AGREEING TO FIX IT, AND THEN NOT LIVING UP TO THEIR PROMISE.  COMPANIES, LIKE TRI-STATE, SHOULD NOT BE ABLE TO OPERATE WITH ANY ACCOUNTABILITY AND MAKE FALSE PROMISES TO CUSTOMERS.
